Mgr. fc SUBJECT: Planning Fees STATEMENT OF THE MATTER: The City Council, at its meeting of October 14, 1980, directed staff'to prepare the necessary documents approving new fees for planning applications. Attached is 1) an ordinance which amends appropriate sections of the municipal code to establish the new fees by resolutions and 2) a resolution so indicating the new fees. By having all the fees in one resolution rather than in several different sections of the municipal code, it will provide much more convenient information for applicants as well as making it easier for the city to make changes should they become neces- sary in the"future. The City Council action in this matter is exempt from environmental review pursuant to Section 19.04.060 of the Municipal Code. EXHIBITS ITOrdinance Nb.__ 2. Q CO «•§ §o - 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 f- > i cZ £ 8 Q J-O111 > H cc < < 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO.9568 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 20, CHAPTER 20.08 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 20.08.010 AND 20.08.020 AND AMENDING TITLE 21, CHAPTERS 21.06, 21.38, 21.45 AND 21.54 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 21.06.060, 21.38.050, 21.38.120, 21.45.050, 21.45.160 AND 21.54.040 TO ESTABLISH FEES FOR PROCESSING SUBDIVISION AND PLANNING APPROVALS. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 20, Chapter 20.08, of the Carlsbad Municipal Code shall be amended by the amendment of Sections 20.08.010 and 20.08.020 to read as follows: "20.08.010 Tentative map fee. A tentative map examination fee in an amount established by City Council resolution shall be paid to the Planning Department at the time a tentative map is filed with the Planning Commission. 20.08.020 Revised tentative map fee. A revised tentative map examination fee in an amount established by Cit^j? Council resolution shall be paid to the Planning Department at the time that a revised tentative map is filed with the Planning Commission." SECTION 2: That Title 21, Chapter 21.06 of the Carlsbad Municipal Code shall be amended by the amendment of Section 21.06.060 to read as follows: "21.06.060 Filing fees. A fee in an amount established by City Council resolution shall be paid to the Planning Department when the site development plan application is filed." SECTION 3: That Title 21, Chapter 21.38, of the Carlsbad Municipal Code shall be amended by the amendment of Sections 21.38.050(3) and 21.38.120(a)(5) to read as follows: "21.38.050(3) A fee in an amount established by City Council resolution shall be paid when the application is filed. 1 2 3 4 5 6 7 8 9 10 11 12 J I •« is 11 " — t- < u. SECTION 4: That Title 21, Chapter 21.45, of the Carlsbad Municipal Code shall be amended by the amendment of Sections 21.45.050(2) and 21.45.160(a)(5) to read as follows: "21.45.050(2) A fee in an amount established by City Council resolution shall be paid when an application for a planned unit development permit is filed. 21.45.160(a)(5) A fee in an amount established by City Council resolution shall be paid when an application to amend a planned unit development permit is filed." SECTION 5: That Title 21, Chapter 21.54, of the Carlsbad Municipal Code shall be amended by the amendment of Section 21.54.040 to read as follows: 21.54.040 Filing fees. A fee in an amount established by City Council resolution shall be paid when an application is filed for a conditional use permit, variance, zone change, reclassification or amendment." ~ EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. BE IT RESOLVED by the City Council California, as follows: 1.
