Mgr. - S rATEMENT 'OF THE MATTER : ?Inis itan is a request for a 10 unit tentative tract map and conddium pmit on property located on the southwest corner of Cxfield Street and Jtiniper Avenue in in the R-3 zone. The'Planning Carmission found this item to neet all developent standards and design criteria of the condcainim Ordinance and subdivision ordinance. Further, the Cam- mission found that the on-site amenities and design of the project justified the projects density of 25 dwellinq units per acre. At the public hearing, no opposition to the project was stated. Planning Director has detdned this project will not have a significant effect on the environment and therefore has issued a Nqative Declaration on July 17, 1980. Through staff review and Planning. Request for approval of a Tentative Subdivision Map and Condominium Permit to develop ten units on property generally located on the southwest corner of Garfield Street and Juniper Avenue in the R-3 zone. Continued from the Planning Commission meetings of 'July 23 and August 27,' 1980. --__ SUBJECT: I. PROJECT DESCRIPTION AND BACKGROUND' -. ---- The applicant is requesting approval of a tenL2.til-e subd.ivision map and condominium permit to develop ten units, on three par- cels comprising .39 acres, located, as described above. The subject property is a previously improved corner lot occupied by two single family homes, a duplex and two garages. As the Commission will recall, this project w;is origin.ally . . reviewed by the Planning Commi.ssion o:i July 23, 1980 as an eight unit condomini.um development. The Commission expressed ' .concern with regards to the relationships of visitor ~:..rkixig, parking garages and entrances to the units. Based on these concerns, the Planning Commission continued tElis item to the meeting of August.27 to allow the applicant an opportunity to redesign the project. The applicant was unable t.0 finalize the design wi,thin the t.ime set and requested an additional contin- . mace to the meeting of October 22. The applicant has redesigned the proposed developnm-~t to include ten units. The two-bedroom units would range in size from 1234 to 1570 square feet. Each unit would consist of two stories of Living area over a private garage. 11, ANALYSIS - Planning Issues - 1) Does the project meet all development standards of the con domin i um ordi nan ce ? 2) Does the project meet all aspects of the design criteria of the condominium ordinance? D i s cus s i on - The proj cct meets or exceeds all development standards of the condomjnium ordinance. Resident parking, laundry facilities and storaie areas (ranging from 493 to 1473 cubic feet) would be located in private, two-car garages below the individual units. As indicated on Exhibit B, individual utility xeters would be furnished. One visitor required parking space will be provided on site and the other four required spaces can be conveniently provided on ,Juniper Avenue. 'Open recreation requirements would be satisfied by a combination of private and common areas. The two "A," units would have private patios and balconies. The remaining units would have large private deck areas extending over the interior driveway area. Not only would these deck areas provide a large amount of private recreational area but would also break-up the view from the units of looking down on a continuous driveway area. The balance of the recreation space would be provided in a common pool and jacuzzi patio area. t The proposed development also satisfies all aspects of the design criteria of the condominium ordinance. Staff feels the project, as redesigned, constitutes a significant improvement o.ver that originally subnitted. The overall design is more comprehensive, better integrating the buildings, parking areas and recreation space. Additional patios and terraced planters have been provided for the units. Because of these design factors, staff feels that .. the proposed density of the p-roject is just if ied. Staff is satisfied that all aspects of the development standards and design criteria cf the condominium ordinance have been met, as shown on attached exhibits. I I I. RECOE.IMENDRTION Staff. recommends that the Planning Commission adopt Resolution No. 1671, recommending APPROVAL of CT SO-Zl/CP-Y9, based on the findings and subject to the conditions contained therein. PLANNING COPDIISSION RESOLUTION NO. 1671 A RESOLUTION OF THE PLANNING COMblISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT TO DEVELOP 10 UNITS ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF GARFIELD STREET AND JUNIPER STREET. APPLICANT: BEHRENDSEN CASE NO: CT 80-21/CP-99 WHEREAS, a verified application for certain property to, dit: Lot 13, Block E, Palisades, in the City of Carlsbad, . according to Map thereof No. 1747, filed in the Office of the County Recorder, February 5, 1923. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 23rd.day of July, 27th day of August, and on the 22nd day of October, 1980, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of CT 8@-22/CP-99, based on the following findings and subject to the following conditions: . A 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 l8 19 20 21 Findings : I I 1) The project is consistent with the General Plan since the proposed density of 25 du/acre is within the density range of 20-30 du/acre specified for this property in the Land Use Element of the General Plan and is justified based upon the reasons contained in the staff report. 2) The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate residential development at the proposed density and still meet all the requirements of the condominium ordinance. 3) The project is consistent with all city public facility - policies and ordinances since: a. The Planning Commission has, by inclusion of an appropriate condition to this condominium permit insured that building permits will not be issued unless the City Council finds that sewer service is available to serve the project, and building cannot occur within the project unless sewer service remains available thus, the Planning Commission is satisfied that the requirement" of the public facilities element of the General Plan have been met insofar as they apply to sewer service for this and condominium permit approval. d. All necessary public improvements have been provided or will be required as conditions of approval. e. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. The condominiums meet the design criteria of Chapter 21.47.110 as the overall plan is comprehensive, embracing land, building, landscaping and their relationships, and sufficient circulation and on-site amenities are provided b. Storage space, laundry facilities, open recreation areas, parking facilities, refuse areas, separate utilities and requirements of Section 21.47.130 have been met or will by conditions of approval. The design of the subdivision and type of improvements will not conflict with easements for public use or public access through the subject property. Conditions - Approval is granted for CT 80-21/CP-99, as shown on Exhibit dated October 17, 1980, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. ?IC" ?tD?t and "EIf "A" dated October 2, 1980 and Exhibits *lBr1, Y This project is approved upon the express condition that building permits shall not be issued for development of the subject property unless the City Engineer determines that sewer capacity is available at the time of application for such permits and will continue to be available until time of occupancy. This project is approved upon the express conditfon that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision, This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, dated April 16, 1980, on file with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 'The applicant shall prepare a reproducible mylar of the final condominium site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Department prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Department prior to final map approval. Said CCER's shall be submitted to and approved by the Planning Director prior to final map approval. The applicant shall install street trees to city spec- ifications at 40 foot intervals along all public street frontages prior to final occupancy of any building. The variety of said trees shall be subject to the approval of the Parks and Recreation Director. The applicant shall pay park-in-lieu fees to the city, prior to the approval of the final map as required by Chapter 20.44 of the Carlsbad Municipal Code. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to city standards. Location of said receptacles shall be approved by the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and sound-buffered from adjacent properties and streets to the satisfaction of the Planning Director and Building Director. Approval of this request shall not excuse complihce with all sections of the zoning ordinance and all other applicable city ordinances in effect at time of building permit issuance. The applicant shall install a wheelchair ramp, at the corner of Garfield Street and Juniper Avenue, to city standards prior to occupancy of any units. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. The grading for this project is defined as "regular grading" by Section 11.06.170(a) of the City Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any required erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11.06 of the City Code. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the location, shall be submitted to the Fire Department for approval prior to construction. I' 19) Water for fire protection to be in before combustibles are on building site as required by Fire Marshall. !O) In order to provide for fire protection during the con- struction period, the applicant shall maintain passable vehicular access to all buildings. In addition, adequate fire hydrants with required fire flows shall be installed on and off site as required by the Fire Chief. !1) The area under the decks extending over the driveway area - shall have an automatic fire sprinkler system or shall be otherwise protected to the satisfaction of the Fire Department.
