SUBJECT: ENCROACHMENT AGREEMENT - 3093 OCEAN STREET
STATEMENT OF THE MATTER
On October 28, 1979, a condominium permit and minor subdivision was approved
for the Craig and Deen property at 3093 Ocean Street. Presently, the owners
under construction on a three-unit structure. The south property line of th
lot is adjacent to an unimproved parking area and the lot frontage is a radit
which curves around an existing pine tree.
Mr. Deen has asked that he be permitted to continue an approved six-foot
block wall across the frontage of his property and to the east of the pine tl
In order to put the wall in existing right-of-way, an encroachment permit is

FISCAL IMPACT
The maintenance of the tree and a small section of public right-of-way will
become Mr. Deen's responsibility rather than the City's.

That the City Council approve the Encroachment Agreement and authorize the
Mayor to sign on behalf of the City.
