SUBJECT : CARLSBAD MUNICIPAL SWIM COMPLEX CONSULTANT AGREEMENT
STATEMENT OF THE MATTER
On April 1, 1980, City Council approved a consulting agreement providing for the design only of the Carlsbad Municipal Swim Complex. contain a clause which would allow the City to retain the consultant on an advi- sory basis through the contract administration and construction phases of the project. The fee for such services was set at 35 dollars per hour. was made for travel time. for travel expenses in the amount of $14 per round trip.

Since the architectural'consultant has done such good work on the design of the swim complex, staff feels the City would be well benefited to take advantage of the contract option and retain the advisory services of the firm of Bird, Fuji- moto and Fish through the contract administration and construction phases of the project.
FISCAL IMPACT
It is estimated that contract consulting services would not exceed $6,bOO by the end of the project. account. The money would be paid out of the swim complex project

Engineering Department Subject: Community Swim Complex
In response to your request of October 24 for an estimate of fees for
our services during the construction phase of the pool project, we offer
the following for your consideration.
Our present agreement for services includes provision for our assist-
ance during construction at a maximum fee of $35.00 per hour. Such
consultation is "on call" by the City. Since our current hourly charge
for consultation by principals of the firm is $50.00, it is to the City's
advantage to work within the framework established by our existing
agreement .
An approximate estimate of the cost of our services during construction,
based on one site visit per week over a nine-month construction period
would be :
4 hours/week x 39 weeks = 156 hours @ $35/hour = $5,460.00
Mileage: 39 round trips at 70 miles = 2730 miles @ 20$ = 546.00
Approximate total: $6,006.00
The estimate of four hours per week is based on one and one-half hours
of travel time, one and one-half hours of on-site time, and one hour of
follow-up work and report preparation. While actual time expenditure
may vary widely from week to week depending on need, the four-hour
average is supported by our past experience on projects of similar
scope.
Mileage charges are not mentioned in our agreement; however, in view
of the distance involved we will request mileage as a proper expense
reimbursement.

Submittal review is included in our basic services and is not considered
a part of the services described above.
On occasion it may be necessary to involve one of our consulting engineers
(structural , mechanical, or electrical). At your discretion, they may also
be involved in final inspections of their areas of design. Their time would
be "on call'' and charged to the City as reimbursement to us at their bill-
ing rates.
Because frequency and duration of "on call'' job visits would be beyond
our control, we feel we cannot propose a lump-sum amount for these
services.
We suggest that provision for our services during construction remain as
specified in our existing agreement, with the hours and amount expended
remaining under the City's control, and working against an estimated maxi-
mum of about $6,000.00

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORRIA, APPROVING AN AMENDMENT TO THAl CERTAIN AGREE-
MENT WITH BIRD, FUJIMOTO & FISH TO PROVIDE FOR MILEAGE
ALLOWANCE --
The City Council of the City of Carlsbad, California, does hereby resolve
as follows:
1. That Amendment No. 1 to that certain agreement between the City of
Carisbad and Gird, Fujimoto E Fish providing for the addition of mileage
compensation to the existing consultant agreement, attached hereto marked
Exhibit "A" and incorporated herein by reference, is hereby approved.
2. The Mayor of the City of Carlsbad is hereby authorized and directed
to execute said agreement for and on behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad held the 2nd day of December , 1380, by the fol-
lowing vote, to wit:

19-J by and between the CITY OF CARLSBAD, a municipal corporation (herein-
after referred to as "City"), and BIRD, FUJIMOTO & FISH, a California corpora-
tion (hereinafter referred to as "Consultant), doe5 hereby amend that certain
'agreement between the City and Consultant for provision of plans and specifi-
cations for the construction of the municipal swimming pool on Monroe Avenue
south of Basswood Street, dated April 16, 1980, by the addition of the fol-
lowing clauses to Article XII:
"Mlleage shall be compensated at the rate of $14 per round trip to the City. The City will not pay the Consultant for mileage in ex- cess of one trip per week unless specifically authorized by the
