ANNEXATION OF THE KOLL PROPERTY
APPLICANT: KOLL COMPANY
STATEMENT OF THE MATTER
This item is a request for City Council approval of an annexation of 194 acres of
land owned by The Koll Company generally located west of El Camino Real and north
of Palornar Airport. The City Council adopted a Tax Exchange Resolution on
November 4, 1980 establishing a property tax exchange agreement between the
County of San Diego and the City. On December 1, 1980, the Local
Agency Formation Coimiission adopted a Resolution of Annexation for this property.
A copy of this Resolution is attached for your review. The last remaining dis-
cretionary action to complete the annexation is the adoption of a Resolution of
Annexation by the City Council.
At the LAFCO hearing, two people owning property near the Koll Property expressed
opposition and suggested that LAFCO deny or delay the proposed annexation. However,
LAFCO approved the annexation authorizing the City to conduct proceedings without
the need for noticing and public hearing.
ENVIRONMENTAL REVIEW
Both the Planning Commission and City Council conducted environmental review for
a General Plan Amendment for the property (GPA 50 (A) ) . An Environmental Impact
Report (EIR 80-3) containing mitigation measures for potential environmental
impacts was certified on August 5, 1980.
FISCAL IMPACTS
The annexation of this property will generate additional revenue from property taxes.
A favorable tax exchange has been negotiated with the County of San Diego and the
Council has previously adopted the attached Tax Exchange Resolution which should
offset the additional City expenditure's required to provide public services to
the property.

RESOLUTION NO. 6383
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING THE ANNEX-
ATION OF CERTAIN UNINHABITED TERRITORY HERE-
INAFTER DESCRIBED AND DESIGNATING AS THE KOLL
ANNEXATION.
WHEREAS, an application for approval of a proposal for the
initiation of proceedings for the annexation of territory herein-
after identified and described as Koll Annexation to the City of
Carlsbad, County of San Diego, State of California was filed with
the Local Agency Formation Commission Reference No. CA 80-8; and
WHEREAS, a resolution of the said Local Agency Formation
Commission, after a hearing held in the manner required by law,
was duly passed and adopted on the 1st day of December, 1980,
approving the application for annexation of the territory
hereinafter described by metes and bounds to the City of Carlsbad;
and
WHEREAS, said resolution provided that said annexation was
approved without notice and hearing and further provided that
the City Council of the City of Carlsbad was authorized to
annex said territory without notice and hearing by said council
and without an election as provided in California Government
Code Section 35151; and
WHEREAS, a written petition containing the required
signatures and a description of the uninhabited territory
hereinafter described has been presented to the City Council
of the City of Carlsbad, requesting annexation under the
Municipal Organization Act of 1977; and
WHEREAS, said petition has been signed or consent thereto,
has been filed by the owners of all of the land in the territory

proposed to be annexed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.A
2. That said petition contains a description of
certain uninhabited territory sought to be included and
annexed to the City of Carlsbad and that said petition is
g signed by the owners of not less than 25% of the land in the
territory by area, and by assessed value as shown on the latest
]_Q equalized assessment roll of the County of San Diego, in
which county the City of Carlsbad is situated.
v 3. That the City Council hereby declares that said
petition has been signed or consent to the proposed annexation
filed by the owners of all of the land in the territory proposed
to be annexed and, therefore, no protests may be filed against
the annexation by persons owning property in the territory.
A. That the territory proposed to be annexed to the

the Government Code and is contiguous to the boundaries of the

hereafter be known as the Koll Annexation.
6. That upon the completion of said annexation all of
the property included therein shall be taxed accordingly with
the other property within the City of Carlsbad to pay the
bonded indebtedness and any and all general indebtedness of the
City of Carlsbad contracted prior to, or existing or outstanding

APPROVING A PROPOSED ANNEXATION TO THE
CITY OF CARLSBAD
"Roll Annexation"
On motion of Commissioner McClellan , seconded by Commissioner
Hostler , the following resolution is adopted:
WHEREAS, a petition of landowners was submitted to this Commission
for annexation of territory to the _Citv_ pf_, Carlsbad._._
(hereinafter referred to as the City), which petition was certified
sufficient by the executive officer on November 3. 1980 I

WHEREAS, the executive officer of this Commission has filed his
report on said proposed annexation, which report has been considered
by this Commission, NOW THEREFORE
BE IT RESOLVED THAT THIS COMMISSION HEREBY FINDS, DETERMINES
AND ORDERS as follows:
1. The territory proposed to be annexed (hereinafter referred
to as the Territory) is as described in Exhibit A attached hereto,
2. The description of the boundaries of the Territory is _jjgt_
definite and certain, but may be made so if modified to conform to
Exhibit B attached hereto.
3. The description of the boundaries of the Territory _jioes___
conform to lines of assessment and ownership.

writing to the proposed annexation.

the information contained in the EIR prepared by the City of Carlsbad,

of the State EIR Guidelines for each significant impact identified by
the EIR, as stated on Exhibit C attached to.
8. The Commission hereby approves the proposed annexation subject
to the proposed conditions, if any as stated on Exhibit j) attached
hereto.
9. The Commission hereby designates the City as the conducting
authority and authorizes the Legislative Body of said City to
initiate annexation proceedings in compliance with this resolution,
without notice and hearing and without an election.
10. The Executive Officer of this Commission is directed to
mail and file certified copies of this resolution in accordance
with Government Code Section 35159.

ENVIRONMENTAL FINDINGS
for Significant Effects of Koll Project
(Carlsbad Industrial Park)
Geology/Grading
Impacts: Grading activities on-site will alter existing landforrns,
creating potential aethetic impacts. Some geologic hazards exist.
on-site, including credible soils and soils with high shrink-swell
characteristics, and potential groundshaking from a seismic event.
Findings: Pursuant to Section 15088a(2) of the State EIR Guidelines,
find that the mitigation measures for this impact, namely that
1) all recommendations of the geotechnical report will be included
in the project design; and 2) an erosion-control program will be
prepared, including groundcover planting, have been adopted by the
City of Carlsbad, and that the mitigation is within the jurisdiction
of the City of Carlsbad and not LAFCO because the area to be graded
will be within the incorporated area of the City.
Drainage/Urban Run-Off
Impacts; Construction of the proposed project will incrementally
increase surface run-off, and affect the quality of the run-off
through addition of urban pollutants.
Findings: Pursuant to Section 15088a(2) of the State EIR Guidelines,
find that the mitigation measures for this impact, namely that
1) a regular streetcleaning program will be implemented;
2). a master drainage plan will be prepared for approval by the
City in consultation with the Regional Coast Commission and the
Department of Fish and Game, have been adopted by the City of
Carlsbad, and that the mitigation is within the jurisdiction
of the City of Carlsbad and not LAFCO because the affected
resources will be within the incorporated area of the City,
Biology
Impacts: The proposed project could potentially destroy 13 on-
site vernal, pools--10 of which contain the rare and endangered
coyote thistle—as well as large portions of the rare and
endangered Del Mar manzanita, and three other rare plants.
EXHIBIT C
Finding^: Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measures for this impact,
namely that 1) the 10 vernal pools contai.ni.ng coyote thistle will
be left undeveloped until the San Diego Vernal Pool Protection
plan is completed; and 2) 106 acres of natural canyon area and
grassland will be preserved as open space, have been adopted by
the City of Carlsbad, and that the mitigation is within the
jurisdiction of the City of Carlsbad and not LAFCO because the
affected biological resources will be in the incorporated area
of the City.
Archaeology
Impacts: Implementation of the proposed development plan will
adversely impact the archaeological sites identified within the
project area. Grading and construction activities will severely
alter and most likely destroy sites CA-SDi-7229, CA-SDi-7230,
and portions of CA-SDi-6833/W-1893 and CA-SDi-6832/W-1892/W-601.
There could also be indirect and/or direct impacts on site W-123
and the main locus of CA-SDi-6833/W-1893, both of which lie
outside the project boundaries.
ing£: Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measures for this impact,
namely that prior to the issuance of a grading permit, 1) a
qualified archaeologist will conduct a surface collection of
CA-SDi-7230; 2) test-level archaeological investigations will
be conducted on sites CA-SDi-6832Av-1892/W-601, CA-SDi-7229 s
and the portion of CA-SDi-6833/W-1893 within the project
boundary to develop final mitigation measures; and 3) the
developer will refrain from any activity which may cause any
indirect or direct impacts to site W-123, and temporary fencing
will be installed around the perimeter of the site if necessary,
have been adopted by the City of Carlsbad, and that the mitiga-
tion is within the jurisdiction of the City of Carlsbad and not
LAFCO because the affected archaeological resources will be
within the incorporated area of the City.
Paleontological Resources
•Imj5act_s: A portion of the site contains the only known exposure
of fossiliferous Cretaceous marine sediments north of the
La Jolla area.
Pursuant to Section 15088a(2) of the State EIR_
Guidelines, find that the mitigation measures for this impact ,
namely that 1) a qualified paleontologist be present during
grading operations; and 2) paleontological sites uncovered
during grading and termed significant will be left exposed
until fossil collection and appropriate investigations are
accomplishedj have been adopted by the City of Carlsbad,
and that the mitigation is within the jurisdiction of the
City of Carlsbad and not LAFCO because the affected paleonto-
logical resources will be within the incorporated area of the
City.
Land Use
Impact: The northwestern portion of the site is adjacent to an
area designated for future residential development, which may be
incompatible vith industrial development.
Findings: Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measures for this imyact,
namely that 1) prior to recordation of the final map, a \ Ian
will be submitted which will include special setbacks, land-
scape requirements, and other design features which will
provide for a more compatible interface; and. 2) the developer
of the residential lands to the north which interface with the
industrial park will also be required at the time of development
to provide for an adequate buffer zone between the two land uses,
have been adopted by the City of Carlsbad, and that the mitiga-
tion is within the jurisdiction of the City of Carlsbad and not
LAFCO because the affected land uses will be within the incor-
porated area of the City.
Traffic Circulation
Impacts: Increased traffic from development of the project
will require the construction of College Boulevard from El
Caraino Real to Palomar Airport Road and may impact some future
intersections.
Findings; Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measure for this impact,
namely that all recommendations contained in the traffic study
be incorporated into the project, has been adopted by the City
of Carlsbad, and that the mitigation' is within the jurisdiction
of the City of Carlsbad and not LAFCO because the affected roads
will be within the incorporated area of the City.
EXHIBIT C
Air Quality
Impact; Construction activity will have temporary impacts as
a result of increased dust emissions.
Finding; Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measure for this impact,
namely that in accordance with the San Diego Air Pollution
Control District's Rule 50 and local applicable ordinances,
a dust control program will be implemented during all stages
of construction, has been adopted by the City of Carlsbad,
and that the mitigation is within the jurisdiction of the
City of Carlsbad and not LAFCO because the source of emissions
will be within the incorporated area of-the City.
Sewage Disposal
»
Impact; The site is within the service area of the Encina ;
Water Pollution Control Facility, which currently is experiencing
severe capacity limitations; no sewer hookups are currently
available.
FJjndin&: Pursuant to Section 15088a(2) of the State EIR
Guidelines, find that the mitigation measure for this impact,
namely that the applicant will design an on-site satellite
treatment plant (which will be .subject to further environmental
review) in accordance with the City of Carlsbad's Master Water
Reclamation Plan, has been adopted by the City of Carlsbad,
and that the mitigation is within the jurisdiction of the
City of Carlsbad and not LAFCO because the affected sewage
treatment facility will be within the incorporated area of
'the City.

WHEREAS, Revenue and Taxation Code Section 99 requires the

negotiation of any exchange of property tax revenues occasioned

by jurisdictional changes between the areas affected; and
7
WHEREAS, under such circumstances the City Council is
8
authorized to negotiate such property tax revenue exchanges
9
on behalf of the City of Carlsbad; and
10
WHEREAS, the attached jurisdictional change between the
11
County and the City is proposed; and

WHEREAS, the County has negotiated with the City of Carlsbad

to determine an equitable exchange of property tax revenue appli-
14
cable to such jurisdictional change and the Board of Supervisors
15
has adopted a resolution approving the negotiated tax exchange;
16
NOW, THEREFORE, BE IT IS RESOLVED AND ORDERED that the iuris-

dictional change shall result in the property tax exchanges shown
18
on the attached Exhibit "A".

IT IS FURTHER RESOLVED AND ORDERED that the
20
City Clerk of the City of Carlsbad shall, on behalf of the City
notify the County Auditor and the Local Agency Formation Commis-
sion of such negotiated exchange of property tax revenues by

forwarding to them a copy of this resolution
