SUBJECT: Acceptance of Improvements - Plaza Camino Real
Carlsbad Tract 76-18
STATEMENT OF THE MATTER
May Stores Shopping Centers, Inc. has requested the acceptance of public improvements
for the subject subdivision. A final inspection has been conducted and the improve-
ments are found to be acceptable for maintenance. "As built" drawings are on file in
the Engineering Department and final accounting is completed.
The City shall retain a $347,000 bond to ensure that the parking lot improvements
are completed as required per the conditions of approval for alternate precise plan
24B and an $80,000 bond for the construction of the future traffic signal at Marron
Road and future Monroe Street. Release of these bonds shall be at the discretion of
the Planning Director and the City Engineer respectively.
FISCAL IMPACT
City Maintenance Department will be required to maintain the water lines and traffic
signals.

RECOMMENDATION
Council accept the Public Improvements as completed, direct the Utilities/Maintenance
Director to commence their maintenance, the City Clerk to record the Notice of Comple-
tion and release the applicable bonds, and the Finance Director to refund the balance
of the Trust Account of $7,600.00 to the developer.

Dear Mr. Evans,
In response to your letter of November 18, 1980, please find
attached the Buena Vista Channel Maintenance Agreement as draft-
ed by your office, which has been duly executed by May Centers,
Inc. on behalf of Plaza Camino Real. We are forwarding this do-
cument to you for execution by Carlsbad and Oceanside, and would
request that you provide us with a copy of the agreement as signed
by both cities.
Also, please be advised that we have completed the repair work
on the 36" V.S.D. sewer line (see Lee Davis' letter of 11/21/80,
copy attached) and have finished setting all tract map monuments
for CT 76-18 (see Larry Rogoway's letter of 11/25/80, copy attach-
ed). With the completion of these two items, we have satisfied
all requirements and conditions stipulated by Precise Plans PP-24A,
B, & C (Council resolutions §5166, 5499, 5676, and 6212). Accord-
ingly, we hereby request your acknowledgement of satisfactory
completion of these obligations; acceptance of those works con-
structed as public improvements (i.e., Marron Road street light-
ing and traffic signals: on- and off-site water lines and ap-
purtenances) ; release of all surety bonds submitted in connection
with this project; issuance of permanent certificate of occupancy;
and release of trust fund deposits in the amount of $48,633.00
being held by the City (see attached audit confirmation letter).
We would appreciate your processing the above items at your ear-
liest convenience. If you have any questions regarding the fore-
going, please feel free to contact us.
