SUBJECT: REQUEST FOR TEMPORARY ASSIGNMENT OF EDUs
MINOR SUBDIVISION 493 - McCOY
STATEMENT OF THE MATTER
Carlsbad Development Corporation is the developer of the Royal Homes subdivision
at various locations in the City. The developer recently completed a portion of
Elm Avenue east of El Camino Real in cooperation with two other developers. The
completion of Elm Avenue left Carlsbad Development Corporation with a small parcel
of land at the east corner of Elm.Avenue and Appian Road which they would like
to subdivide into four lots. The proposed minor subdivision is within the Lake
Calavera Hills Sewer Service Area.
The Council has previous'ly "temporarily assigned" 142 EDUs of Encina capacity
to CT 76-12, 225 EDUs of Encina capacity to CT 74-4, arid 108 EDUs of Encina
capacity to CT 74-14. All three subdivisions are in the Lake Calavera Hills
Sewer Service Area.
The Council has previously determined that the sewer moratorium in the Lake
Calavera Hills Sewer Service Area will be lifted at such time as (1) the Lake
Calavera Hills Sewage Treatment Plant is complete; (2) the right-of-way for the
effluent disposal line has been acquired; and (3) the construction of the efflu-
ent disposal line is guaranteed. These requirements should be fulfilled in the
spri ng.
The Council has not previously "loaned" Encina capacityfor processing tentative
tract maps.
FISCAL IMPACT
Should the Lake Calavera Hills Sewage Treatment Plant not be in operation at
the time of completion of the homes on the four lots of MS 493, sewage flows
would be diverted to Encina. However, the majority of the sewer connection fees
for the four homes would be paid to Lake Calavera Hills in accordance with our
agreement.
