Mgr. —1-4— Subject: ADOPTION OF THE 1979 EDITION OF THE UNIFORM FIRE CODE Statement of the Matter The City of Carlsbad is presently operating under the pro- visions of the 1976 Edition of the Uniform Fire Code. The 1979 Edition of the Uniform Fire Code has now been promulgated and it is now appropriate for the City of Carlsbad to take the necessary steps to adopt the updated version. A series of amendments has been prepared by the Carlsbad Fire Department to address certain local conditions. Included in the Ordinance is a repealer of chapters of the Municipal Code dealing with a) adoption of the 1976 Edition of the Uniform Fire Code, with amendments b) recognition of a Volunteer Fire Department c) regulation of Open Burning d) establishment of Fire Zones Fiscal Impact The adoption and enforcement of the 1979 Edition of the Uniform Fire Code is not expected to generate any costs to the City in addition to those presently being incurred while en- forcing the 1976 Edition. No appreciable increase in costs to the public are foreseen. Exhibits 1. Ordinance No. a o j ,5` repealing Chapters 17.04, 17.08, 17.12 and 17.16 and adopting the 1979 Edition of the Uniform Fire Code, with amendments. 2. Analysis of local amendments. Recommendation The Fire Department recommends the adoption of the 1979 Edition of the Uniform Fire Code and the proposed amendments and the repeal of the existing Municipal Code chapters cited in the ordinance. The City Attorney recommends that if the Council con- curs, your action is to read the title of the attached ordinance and then, by motion, set a public hearing to consider its adoption. The Clerk should be directed to notice the public hearing according to Government Code Section 50022.3. Council Action: 1/27/81 - Council requested further information on fire hazards and past experience in the City with regard to the requirement for fire -retardant roofs. ANALYSIS OF LOCAL AMENDMENTS Repeal of 17.04 (Adopts 1976 Edition of Uniform Fire Code) Allows adoption of the updated 1979 Edition, incorporating the results of the latest technology and research Repeal of 17.08 (Volunteer Fire Department) Since there is no Volunteer Fire Department in existance, this removes a needless section of the Municipal Code Repeal of 17.12 (Outdoor Burning) San Diego County Air Pollution Control District preempts local authorities in the regulation of outdoor burning Repeal of 17.16 (Fire Zones) Fire Zones are deleted in the 1979 Editions of both the Uniform Building Code and Unifo--if, Fire Code. Therefore, there is no need to carry the designation in the Municipal Code. MUNICIPAL CODE SECT_.,. 17.04.010 Adopts 1979 Uniform Fire Code 17.04.015 Deletes section of fire code naming specific references to be included in the code. Saves City the cost of buying three (3) copies of each referenced standard for purposes of filing with City Clerk. 17.04.020 Language is identical to existing Municipal Code section. Only section number has been changed. 17.04.030 Expands section to include all fire protection equipment. 17.04.040 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.050 Section has been amended to conform with the re- quirements of Title 24, California Administrative Code which governs alarm systems in residential occupancies. 17.04.060 Section has been amended to conform with the proposed requirements of the Uniform Building Code. In addition, requirements for lock boxes and super- vised alarms have been added. 0 ANALYSIS OF LOCAL AMENDMENTS -2 17.04.070 Will enable a fire officer to have a vehicle removed rather than tying up an engine company for an extended period of time. 17.04.080 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.090 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.100 Section is nearly identical to existing Municipal Code section except that restrictions regarding open flame and flammable liquids have been added. ' 17.04.110 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.120 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.130 Language is identical to :I sting Municipal Code section. Only section number has changed. 17.04.140 Language is identical to existing Municipal Code section. Only section number has changed. 17.04.150 Enables control of disposal of flammable liquids. 17.04.160 Adds violation section. i
