Subject: MOBIL EHOME RENTS Statement of the Matter On Deoember 16, 1980 the City Council adopted Ordinance No. 9572 extending the moratorium on rental increases on mobilehare spaces within the City of Carlsbad for a two month period to expire,February 28, 1981. At that time it was contemplated that one of three things would happen prior to the expiration date. 1. An ordinance regulating mobilehcam park rents would be adopted and becoaaee effective. 2. The -moratorium would be=re unnecessary because of either a voluntary agreement between the tenants and the park owners or a decision by the Council not to impose smbilehome rent control. 3. An agreement in the individual: park between the owner and the tenants, resulting in an exemption from the moratorium. For a number of reasons it now appears, it will not be possible to resolve< the matter prior to the expiration of the moratorium. The factors which . lead the Council to initially impose a moratorium and then extend it still exists. These and other reasons for extending the moratorium have been recited in the attached ordinance. It is recatraeended that the moratorium be exttended for a six week period, to expire on April 10, 1981. That date will allow the full Council to make a final decision on an ordinance at your March 3, 1981 meeting and give sufficient time for that ordinance to beeane effective prior to the expiration of the moratorium. Expiration of the moratorium before the effective date of an ordinance could create significant hardships and difficulties and it is reeomnended that be avoided if possible. The ordinance continues the provision that any rent adjust n-ent will be fully retroactive to January 1, 1981. Exhibit Ordinance No.. The City Council of the City of Carlsbad, California hereby finds and determines as follows: 1. The findings and determinations of Ordinances No. 9565 and No. 9572 continue to be true and are incorporated into this ordinance. 2. The City Council will not have the attendance of all Council Members at the Council meetings scheduled for February 17, 1981 or February 24, 1981 but will have the attendance of all Council Members at meeting scheduled for March 3, 1981. Because of the importance of the issue of mobilehome rent control to all citizens of Carlsbad, it is necessary and desirable for all Council Members to participate in the meetings at which a permanent rent control ordinance is considered. 3. That additional time is needed to allow public review and comment on the proposed permanent mobile home rent control ordinance; particularly, review by the persons most affected by the ordinance --park owners and tenants. 4. That additional time is needed to allow ongoing efforts, between the park owners and the mobilehome owners to agree on a private solution to the problem thereby obviating the need for a city -imposed solution, to be completed. 5. The time is also necessary to allow sufficient time for an ordinance to become effective, if it is determined an s i ti i 0 1 ordinance is necessary, to avoid the hardships and confusion 2 that would result from a gap between the moratorium and the 3 availability of the dispute resolution processes of the ordinance. 4 NOW, THEREFORE, BE IT ORDAINED by the City Council of the 5 City of Carlsbad, California, as follows: 6 SECTION 1: Ordinances No. 9565 and No. 9572 are extended 7 to April 10, 1981. This extension is subject to the terms and 8 conditions of said ordinances which are incorporated herein by y reference, specifically including the provision that the 10 resolution of the rent increases noticed to go into effect on 11 January 1, 1981 sball be retroactive to that date. c 12 SECTION 2: This ordinance is hereby declared to be an a g 13 emergency ordinance adopted as an urgency measure to protect the CEa 0U0 3.4 public health, safety and welfare and shall be effective a - < a 3.5 immediately upon its adoption.
