ZONE CHANGE FROM P-C AND C-2 TO RD-M AND A MASTER PLAN AMENDMENT

STATEMENT OF THE MATTERl
This item is a request for a Change of Zone from P-C and C-2 to RD-M (see location map) ,
and an amendment to the La Costa Master Plan to delete the subject property, located
on Centella Street in La Costa, from this plan.
The Planning Commission found the Change of Zone to RD-M to be consistent with the
recently adopted RM-H (10-20 du/acre) land use designation of the site indicated on
the General Plan. Also, the Commission felt the deletion of this site from the
La Costa Master Plan would not adversely affect this plan. . Staff originally proposed
a Q overlay designation with the Zone Change to ensure that development of the
property would be compatible with surrounding single family residences. The
Commission opposed this recommendation because they felt residential uses adjacent
to each other were compatible and further site review was unnecessary. NQ.
opposition was expressed at the public hearing.
Through staff review and Planning Commission hearing, all issues on this matter
have been satisfactorily resolved. "**
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any
significant environmental impacts and, therefore, has issued a Negative Declaration,
dated December 30, 1980, which was approved by the Planning Commission on January 28,
1981. A copy of the environmental document is on file in the Planning Department.
FISCAL IMPACT
This item does not constitute approval of a development project; it only allows
the necessary zoning for future development. The applicant will be required to
provide necessary public improvements for any development of the property. Also,
the payment of public facility fees has been made a condition of approval of the
Zone Change.
RECOMMENDATION
Both the planning staff and Planning Commission recommend that this application
be APPROVED and that the City Attorney be directed to prepare documents APPROVING
ZC-225/MP-149(F) , per Planning Commission Resolution Nos: 1756 and 1757.

CITY OF CARLSBAD, CALIFORNIA, APPROVING A ZONE
CHANGE FROM C-2 AND P-C TO RDM ON PROPERTY
GENERALLY LOCATED ON CENTELLA STREET, SOUTH OF
LEVANTE STREET IN LA COSTA.

WHEREAS, a verified application for certain property, to

Lots 180, 181, 182 of Santa Fe Glens according to

has been filed with the city of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provided
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 28th day of
January, 1981, hold a duly noticed public hearing as .,-.
prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to
the Zone Change; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of ZC-225, based on the
following findings and subject to the following conditions:
Findings:
1) That the Zone Change to RDM is consistent with the
RMH land use designation of the land use element of the
General Plan.

2) That the subject lots are adequate in size and shape to
accommodate uses permitted in the RD-M zone.
3) That the project is consistent with all city public
facility policies and ordinances since:
a) The Planning Commission has, by inclusion of an
appropriate condition to this zone change insured
that building permits will not be approved unless
the City Council finds that sewer service is
available to serve the project. Since building
cannot occur within the project unless sewer
service remains available, the Planning Commission
is satisfied that the requirements of the public
facilities element of the General Plan have been
met insofar as they apply to sewer service for
this zone change.
b) All necessary public improvements have been provided
or will be required as conditions of approval.
c) The applicant has agreed and is required by the
inclusion of an appropriate condition to pay a
public facilities fee. Performance of that contract
and payment of the fee will enable this body to
find that public facilities will be available
concurrent with need as required by the General
Plan. •''
4) The project will not cause any significant environmental
impacts and a negative declaration has been issued by
the Planning Director on December 30, 1980 and approved
by the Planning Commission of January 28, 1981.

Approval is granted for ZC-225, as shown on Exhibit "A"
dated January 13, 1981, incorporated by reference and on
file in the Planning Department.
This project is approved upon the express condition that
the applicants shall pay a public facilities fee as required
by City Council Policy No. 17, dated August 29, 1979, on file
with the City Clerk and incorporated herein by reference, and
according to the agreements executed by the applicants for
payment of said fee a copy of those agreements dated August
29,1980, and October 20, 1980, are on file with the City
Clerk and incorporated herein by reference. If said fee
is not paid as promised, this application will not be
consistent with the General Plan and approval for this
project shall be void.

SUBJECT: ZC-225/MP-149(F) -BOSTON - Zone change from P-C
and C-2 to RDM and an amendment to the La Costa
Master Plan on property located on the west and
east sides of Centella Street, south of Levante
Street in La Costa.
I. PROJECT DESCRIPTION
The applicant requests a change of zone from P-C to RDM
and from C-2 to RDM on property as described above (see
attached location map). Also, the applicant requests an
amendment to the La Costa Master Plan to delete that por-
tion of the property currently zoned P-C from this Master
Plan. The applicant's intent is to develop a multi-
family residential rental complex on the site. The
site is 4.5 acres in size and has been previously
graded.
II. ANALYSIS
1) Ib the proposed RDM zone consistent with the
General Plan Land Use designation for this site?
2) Are uses allowed in the RDM zone compatible with
surrounding land uses and zoning?
3) Will deletion of this site from the La Costa
Master Plan adversely affect this plan?
The City Council amended the General Plan land use
designation for this site from N (Neighborhood Com-
mercial) to RMH (Residential - Medium High Density/ 10-
20 du's/acre) on January 20, 1981. Staff feels the RDM
zone is consistent with this land use designation in
that it allows multi-family residential uses at a
density specified by the General Plan. In this case,
either condominium or rental units having a density
within 10-20 du's/acre would be consistent with the RMH
designation.
With respect to land use compatibility, surrounding
land uses include condominiums to the north, vacant
parcels to the east, and single family residences to
the south and west. A primary concern of staff is the
impact of future residential units on the adjacent
single family residences. These residences are located
at a lower elevation than the subject property and if
proper setbacks are not provided, a large multi-family
residential project would be looking down into the
backyards of these single family homes.
Staff feels that the subject site is large enough to
ensure that buildings can be setback to reduce adverse
impacts on the adjacent residences if adequate site
review takes place. Staff is recommending, therefore,
that the Commission rezone the property to RDM with a Q
overlay. The Q overlay would require a Site Develop-
ment Plan review process prior to any development of
the property and the Commission could ensure that
impacts on the single family residences would be
minimal.
Staff feels the deletion of the property from the La
Costa Master Plan will not adversely affect the exist-
ing Master Plan. This plan currently designates the
site as Neighborhood Commercial, however, recent amend-
ments to the Master Plan have increased the amount of
commercially designated property in La Costa. A reduc-
tion of neighborhood commercial at this location should
not significantly reduce the amount of commercially
designated land in this vicinity.
Overall, staff can support both the change of zone to
RDM and the deletion of -this site froni the La. Costa
Master Plan.
III. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project
will not have a significant impact on the environment
and, therefore, has issued a Negative Declaration on
December 30, 1980.
IV. RECOMMENDATION
It is recommended that the Planning Commission approve
the Negative Declaration issued by the Planning Direc-
tor and adopt Resolutions 1756 and 1757 APPROVING ZC-
225 and MP-149(F) based on the findings and subject to
the conditions contained therein.
