STATEMENT OF THE MATTER:
This item is the second phase of an industrial Planned Unit Development to include
11 buildings totalling 164,575 square feet on property located on Avenida Encinas
between Cannon Road and Palomar Airport Road in the P-M zone.
The Planning Commission found the project to meet the development standards and
design criteria of the Planned Unit Development Ordinance.
found the project to be compatible and integrated with the previously approved
Phase I development on the site.
Further, the Commission
Through staff review and Planning Commission hearing, all issues on this matter
have been satisfactorily resolved.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any significant
environmental impacts and , therefore , has issued a Negative Declaration 'dated
January 6, 1981, which was approved by the Planning Commission on January 28, 1981.
A copy of the environmental document is on file in the Planning Department.
FISCAL IMPACT
The provision of necessary public improvements for the project has been made a
condition of approval and will be provided by the developer. Other additional
improvements that may be required by the development will be paid for by public
facility fees.
RECOMMENDATION
Both the planning staff and Planning Commission recommend that this application
be APPROVED and that the City Attorney be directed to prepare documents APPROVING
CT 80-15(A)/PUD-l7(A) per Planning Commission Resolution Nos: 1703 and 1704.

THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL FOR A 6 LOT TENATIVE TRACT MAP ON
BETWEEN PALOMAR AIRPORT ROAD AND CANNON ROAD.

WHEREAS, a verified application for certain property to,
wit:
Parcel 2 of Parcel Map 10801 recorded December 17, 1980.
has been filed with the city of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 28th day of
January, 1981, hold a duly noticed public hearing as prescribed
by law to consider said request; and
WHEREAS, at said public hearing, upon.hearing and considering
all testimony and arguments, if any, of all persons desiring
to be heard, said Commission considered all factors relating to
the Tentative Tract Map.
NOW, THEREFORE, BE IT HEREBY RESOVED by the Planning
Commission as follows:
A) That the above r.ecitations are .true and correct.
R) That based on the evidence presented at the pubic hearing,
the Commission recommends APPROVAL of CT 80-15(A), based
on the following findings and subject to the following conditions:

1. The proposed tentative map is consistent with the city’s
general plan since the site is designated by the land use
plan for planned industrial and, as conditioned, the

project is consistent with all other general plan elements.
The site is physically suitable for the type of development proposed since the basically flat topography of the site
reduces the need for major land form alteration.
The project is consistent with all city public facility policies and ordinances since:
a) The Planning Commission has, by inclusion of an
appropriate condition to this project, insured that
the final map will. not be approved unless the City
Council finds that sewer service is available to serve the project. .In addition, the Planning Com- mission has added a condition that a note shall be
placed on the final map that building permits may
not be issued for the project unless the City Engineer
determines that sewer service is available. Since
the final map cannot be approved unless sewer service is available, and building cannot occur within the
project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the General
Plan have been met insofar as they apply to sewer service for this project.
All necessary public improvements have been provided or will be required as conditions of approval.

c) The applicant has agreed and is required by the
inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and
payment of the fee will enable this body to find
that public facilities will be available concurrent
with need as required by the General Plan.
The Planning Director,has determined that the proposed
project has been addressed in previously approved environ-
mental documents and issued a Notice of Prior Environmental Compliance on January 7, 1981.
Conditions
1. All previous conditions of CT 80-15 (Resolution 1638) are no longer applicable and shall be superseded by
the conditions of approval contained herein.
2. Approval is granted for CT 80-15(R), as shown on Exhibits
E, H, 1 and M and Exhibit S, dated August 26, 1980 and December 4, 1980, incorporated by reference and on file in the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these
conditions.

This project is approved upon the express condition that
the final map shall not Se approved unless the City Council
finds as of the time of such approval. that sewer service
is available-to serve the subdivision.
This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available
until time of occupancy.
This project is approved upon the express condition' that the applicant shall pay a. public facilities fee as required by
City Council Policy No. 17, dated August 29, 1979, on ffle
with the City Clerk and incorporated herein by reference, and
according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated February
28, 1980, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General

Trash receptable areas shall be enclosed by a 6 foot high
'masonry wall with gates pursuant to city standards. Location
of said receptacles shall be approved by the Planning Director.
All roof appurtenances, including air conditioners, shall
be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building
Director.
The project shall provide bus stop facilities at locations
subject to the satisfaction of the North County Transit District. Said facilities shall at. a minimum include a bench, free from advertising and a pole for the bus stop sign. The bench and pole shall be designed in a manner so as to not detract frorn the basic architectural theme of the
project and said design shall be subject to the approval of the Planning Director and North County Transit District.
The project shall attempt to develop a ride to work and home program for its employees with the North County Transit
District. Furthermore, the project shall attempt to limit
the staggering of worker shifts so as to facilitate the success of said program.
All conditions of Resolution No. 1704, for PUD-l7(A) shall be met.

The subdivider shall dedicate and improve Avenida Encinas
based on a right-of-way width of 70' and a curb-to-curb
width of 60'. The limits shall be from the existing terminus of Avenida Encinas, along the subdivision frontage, extending off-site to Cannon Road. The right-of-way shall be dedicated prior to the approval.of the final map and shall be free and clear of any li-ens and encumbrances. The improvements shall be for the full street width including median and shall conform to the city of Carlsbad standards subject to the
approval of the City Engineer and shall be completed prior to
final occupancy of any units.
Improvement plans prepared by a registered civil engheer
must be approved by the City Engineer, required security
posed, and improvement agreement executed prior to approval
of the final map.
Interior private streets and driveways shall be built to full
width to serve a11 buildings being constructed.
The subdivider shall submit to the City Engineer letters of
permission from all easement holders on the subject property
prior to approval of the final map.

The applicant shall submit two (2) copies of a site plan
showing locations of existing and proposed fire hydrants and
on-site roads and drives.
An all weather access road shall be maintained throughout construction.
Water for fire protection shall be installed prior to
placement if any on the building site.
Recommended minimum standards by the Fire Department for driveways into all types of building construction shall
be no parking land - 24 feet, parking one side 34 feet,
and parking. both sides 44 feet.
Adequate emergency vehicle turn-arounds shall be provided by a cul-de-sac or a hammerhead when a driveway is mor= than 150 Zeet deep from property line at street.
All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "no parking/fire lane/ tow away zone" as per condition in Municipal Code.
A11 fire alarm systems., fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be installed pursuant to Fire Code and Building Code requirements and shall be submitted to the
Fire Department for approval prior to construction.

comprehensively and imaginatively designed facility which will contribute to the general well being of the community.
The proposed development will not be detrimental to the health safety or general welfare of persons residing or
working in the same vicinity, nor would the project be
injurious to property or improvements in this area.
All design criteria set forth in Section 21.45.110 and all minimum development standards set forth in Section 21.45.120 will be met.
The proposed project will be consistent with all elements of
the General Plan.
The applicant has agreed and is required by the inclusion of
an appropriate condi.tion to pay a public facilities fee.
Performance of that contract and payment of the fee will
enable this body to find that public facilities will be available concurrent with need as required by the General Plan.
That. the applicant has 'provided sufficient additional
amenities including increased landscaping along Avenida
Encinas, increase of the number ofsparking spaces required
under the P-M zone, and recreational amenities consisting of an exercise course for use by the employees to justify t.he modifications to t.he P-M zone yard and lot area requirements.
The Planning Director has determined that the project was addressed in previously approved environmenta-1 documents and issued a Notice of Prior Environmental Compliance on
January 7, 1981.
General, Conditions
1. Approval is granted for PUD-17(A) as shown of Exhibits
E, I, H and M dated August 26, 1980 and Exhibit S dated
December 4, 1980 on file at the Planning Department and
incorporated by reference. Development shall occur sub-' stantially as shown on these exhibits unless otherwise
noted in these conditions.
2. All previous conditions of PUD-17 (Resolution No. 1639) are'no longer applicable and shall be superseded by the conditions of approval contained herein.
3. All conditions of approval of Resolution No. 1703, for
CT 80-15(A), shall be met. Failure to do so shall void this Planned Unit Development.

and PUD-l7(A), for the approval of the Planning Director.
5. The standards of the P-M (Planned Industrial) zone regarding permitted uses, conditional uses, building height, outdoor storage and industrial waste discharge shall apply to the
subject proper-ty. No encroachment into any required yard,
other than is permitted by this application shall be allowed
unless a revised Planned Unit Development application is approved.
6. Prior to the issuance of any building permits, the applicant shall submit a detailed landscape and irrigation plan, subject to the approval of the Planning Director. Native drought tolerant plant species shall be utilized to the maximum extent feasible. Said landscape plan shall include a detailed description of the employee recreation area. Said landscape plan shall include solid planting of
the west property line to visually screen the project from the adjacent properties to the west.
7. All roof top appurtenances shall be completely screened from
adjacent properties to the west, Interstate 5, and Avenida
Encinas and integrated into the design of the building,
subject to the approval of the Planning Director prior to the issuance of building permits.'
8. All lighting of buildings and parking areas shall be directed away from adjacent properties, in particular those residential properties to the west, so that no direct light or light spillover occurs on any such properties.
9. Per the requirements of the P-M zone, noise emanating from

DAVIS I- - Request for approval of the second phase
of a planned industrial development on Avenida
Encinas between Cannon Road and Palomar Airport
Road in the P-M zone.
I. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting approval of an industrial
complex consisting of 11 buildings totalling 164,575
square feet in area on 15.2 acres of land as described
above. The request is for the second phase of a two-
phased development on 22.7 acres. The subject 22.7 acre parcel was previously part of a larger 50 acre
parcel but was split off as a separate parcel by Parcel
Map No. 10801. The applicant proposes to sell the buildings and suites within the buildings as industrial condominiums. . .. D.
The Planning Commission, at its meeting of May 28,
1980, approved Phase I consisting of 16 lots and 8
buiidings totaling 103,895 square feet. Exhibit "M" depicts the development plan for both phases and
includes the square footage of each building.
The proposed land uses for.Phase I1 include offic'e/pro- fessional on lot 1, research and development on lots 2-
4, multi-tenant industrial on lot 5 and comnion open
area on lot 6.
At the public hearing for Phase I, the Planning Com-
mission allowed modifications and reductions of the normal P-M zoning standards through the PUD process. Specifically, the Commission approved individual lots for each building,,a reduced front yard setback from
50' to 30' and parking partially within the rear and
side yard setbacks. The Commission justified the
reductions by the applicant's inclusion of additional on-site amenities including increased landscaping, increased on-site parking and an on-site recreation
area for use by the employees.
This request was originally scheduled to be heard at the Planning Commission meeting of October 8, 1980. However, the applicant requested that this item be
continued to the October 22, 1980 meeting and then to
the November 26, 1980 meeting to allow time for re- visions to be made to the tenative map. At the time of
the November 26, 1980 Planning Commission hearing the
applicant was still actively working on revising the tentative map and requested that this item be continued until tonights meeting.
11. ANALYSIS
Planning Issues
1. Does the project meet the design criteria of the
PUD Ordinance?
2. Is the project comprehensively designed and well
integrated with the previously approved first
phase of the development?
111. DISCUSSION
As proposed, staff feels the project meets the design
criteria of the PUD Ordinance. To enhance the overall design, the applicant is requesting a variation of the
P-M zoning standards as part of this application. Specifically, a reduced front yard setback from 50' to
35' for buildings 4, 18 & 20 and from 50' to 40' for building 3, encroachment of parking spaces into the side yard, and a reduced rear yard setback from 30' to
20' for building 6. To justify the reduced standards,
the Planning Commission must find that the overall
project is comprehensively designed and well integrated
with respect to buildings, driving areas and pedestrian walkways. Also, the Commission may require additional
amenities over and above the normal development standards.
To support the reduced standards, the applicant is pro-
viding substantial landscaping and recreational ameni-
ties. A 35' landscape strip will be maintained along
Avenida Encinas. Also, a jogging and exercise course
will be provided for the employees for use during lunch and break times along the eastern property line. Staff
feels the project's design and the additional amenities
provided justifies the modifications to the normal
zoning standards.
As designed, the project appears very compatible and well integrated with the approved Phase I. Also, the project provides adequate open space, circulation, off- street parking and recreational facilities as shown on the attached exhibits. Futher, the development would
be compatible with surrounding development. Staff
feels that the project meets both the design criteria
and the development standards of the Planned Unit Development Ordinance.

V.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project
has been addressed in previously approved environmental
documents and has issued a Notice of Prior Compliance on January 6, 1981.
RECOMMENDATION
It is recommended that the Planning Commission APPROVE
the Notice of Prior Compliance issued by the Planning
Director and adopt Resolution No. 1703 recommending
APPROVAL of CT 80-15(A) and Resolution No. 1704 recom-
mending APPROVAL of PUD-l7(A) based on the findings
' and subject to the conditions contained therein.

Industrial/Office space on 50.2 acres located on Avenida Encinas, between Cannon and
Palomar Airport Roads. The project will be constructed - in phases due to lack of sewer. -
Avenida Encinas will be extended - through the site to Cannon Road. The site is flat,
devoid of any significant flora or fauna; the soil does not represent prime agricultural .
land. Additional grading is necessary to ensure proper drainage and to accorlimodate the
extension of Avenida Enci nas, however, grading wi 11 not adversely affect any envi ron- --
