Mgr. -4w DEPARTMENT: SUBJECT: RESOLUTION OF INTENTION TO VACATE A PORTLON OF JEFFERSON AVENUE STATEMENT OF THE MATTER At its October 7, 1980 meeting, the City Council considered a request to vacate a portion of Jefferson Avenue between Las Flores Avenue and the 1-5 overpass. The Council tabled the matter until staff could evaluate the possibility of future widening of Jefferson. The realignment of Jefferson Avenue by CALTRANS in 1969/70 as part of the overpass con- struction, has created a triangular shaped piece of excess right-of-way on the westerly side of the street immediately south of the overpass across 1-5. A request to vacate this excess was made by Buff E Hensman Architects and Associates, one of the adjacent property owners. SDGEE, Vista Sanitation, Pacific Telephone and Util- ities and Maintenance have been notified and request reservation of easements. Portions vacated wi 11 be granted to the adjacent property owners, preserving a1 1 pub1 ic uti 1 i ty easements. Staff has investigated Jefferson Avenue from Elm to the 1-5 overpass. Jefferson from Elm Avenue to Las Flores has a 48-foot paved section, fully improved, in a 60-foot right-of-way. The 48-foot section could ultimately provide four lanes of traffic with no parking and no bicycle lane. How; ever, the Council may choose to maintain 84 feet of right-of-way to insure that it would not have to be purchased should Jefferson ever be upgraded from a collector to a secondary arterial. Prior to exchange of property, sidewalk shall be installed by owner. FISCAL IMPACT 1. Maintain 60 feet of right-of-way: Approximately 6,000 sq. ft. of land to be returned 2. Maintain 84 feet of right-of-way: Approximately 4,500 sq. ft. of land to be returned to tax rolls (approximate value of land - $48,000). to tax rolls ($38,000). EXHIBITS 1. Location and Plat Map 2. Adopt Resolution No. 6324, declaring the intention to vacate a portion of Jefferson Avenue and set a date for a public hearing. A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DECLARING INTENTION TO VACATE A PORTION OF JEFFERSON AVENUE - T.he City Council of the City of Carlsbad, California,does hereby resolve as follows: 1. The City Council of the City of Carlsbad does hereby declare its intention to proceed under the provisions of Street Vacation Act of 1941 to vacate that certain portion of Jefferson Avenue located on the westerly side of the street, immediately south of the overpass, across Interstate 5, and on Exhibit "A" attached hereto. 2. A public hearing shall be held at the City 1200 Elm Avenue, Carlsbad, California at 6 P.M. on Apr purpose of hearing all persons interested in or object vacation.
