DEPARTMENT: Planning CTY. MGR. SUBJECT : RESOLUTION OF NEGOTIATED PROPERTY TAX EXCHANGE RELATING TO THE UKEGAWA ANNEXATION. STATEMENT OF THE MATTER; ~~ Revenue and Taxation Code Section 99 requires that prior to the effective date of certain jurisdictional changes, the governing bodies of the affected jurisdictions shall establish, by resolution, the amount of property tax to be exchanged. Although the county has not adopted a tax exchange resolution on this specific property, a master tax exchange agreement for all future properties annexed into the city was approved by the Board of Supervisors earlier this year. The attached resolution and Exhibit A are based on this master agreement. The city share of the tax split would be 48%. Fiscal Impact The cost of services provided to the Ukegawa Annexation property would be offset by the revenue generated by the property tax exchange. Also, an application for development on the property would be conditioned for full public improvements and the payment of a public facilities fee. Council Action; 3-3-81 Council adopted Resolution No. 6448, regarding property tax exchange relating to jurisdictional changes - Ukegawa Annexation. 1 2 3 RESOLUTION NO. 6448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,'CALIFORNIA REGARDING PROPERTY TAX EXCHANGE RELATING TO JURISDICTIONAL CHANGES - UKEGAWA ANNEXATION. 4 WHEREAS, Revenue and Taxation Code Section 99 requires the 5 negotiation of any exchange of property tax revenues occasioned 6 by jurisdictiorial changes between the areas affected; and 7 WHEREAS, under such circumstances the City Council is 8 authorized to negotiate such property tax revenue exchanges 9 on behalf of the city of Carlsbad; and 10 WHEREAS, the attached jurisdictional change between the 11 county and the city is proposed; and 12 WHEREAS, the county has negotiated with the city of Carlsbad 13 to determine an equitable exchange of property tax revenue appli- 14 cable to such jurisdictional change; 15 NOW, THEREFORE, BE IT IS RESOLVED AND ORDERED that the juris- 16 dictional change shall result in the property tax exchanges shown. 17 on the attached Exhibit "A". 18 IT IS FURTHER RESOLVED AND ORDERED that the City Clerk'of 19 | the city of Carlsbad shall, on behalf of the city notify the 20 County Board of Supervisors, County Auditor and the Local Agency 21 Formation Commission of such negotiated exchange of property tax 22 revenues by forwarding to them a copy of this resolution. 23 24 //// 25 //// 26 //// 27 //// 28 //// 1 PASSED, APPROVED AND ADOPTED at a regular meeting of the 2 City Council on the 3rd day of March, 1981, by the following 3 vote, to wit: 4 AYES: Council Members Packard, Casler, Anear, Lewis and Kulchin 5 NOES: None 6 I ABSENT: None 7 8 "RONALD c.
