APPLICANT: CITY OF CARLSBAD CASE NO: ZCA-129 WHEREAS, the Planning Commission did, on the 28th day of January, 1981, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Code Amendment. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.22 (RESIDENTIAL WATERWAY ZONE) OF THE CARLSBAD ML'NICIPAL CODE BY DELETING SECTION 21.22.110, AND CHAPTER 21.47 (CONDOMINIUMS) OF THE CARLSBAD MUNICIPAL CODE BY AMENDING SUB- SECTION 21.47.130(2), TO REVISE THE PARKING REQUIREMENTS OF THE R-W ZONE The City Council of the city of Carlsbad, California, does xdain as follows: SECTION 1: That Title 21, Chapter 21.22, of the Carlsbad Jlunicipal Code is amended by the deletion of Section 21.22.110. SECTION 2: That Title 21, Chapter 21.47, Section 21.47.130 If the Carlsbad Municipal Code is amended by the amendment of Subsections (2) to read as follows: (2) Parking. RAUTENKRANZ, City Clerk (SEAL) -2- 6- STAFF REPORT 0 DATE : TO : FROM: SUBJECT: This item January 28, 1981 Planning Commission Plannlng Deparment ZCA-129,' CITY OF CARLSBAD, An amendment to the Zoning Ordinance to modify parking requirements in the R-W zone. was previously brought before the Planning Commission on November 12, 1980 (see attached staff report, dated November 12, 1980). At that time, staff recommended a number of changes to the R-W zone parking requirements essentially to bring them up to the same standards of other multi-family zones. The Planning Commission wanted staff to study the matter further and established a committee consisting of a Planning Commission representative and several (3) property owners of the Bristol Cove area. The committee has met twice since that time and has developed a recommendation to the Planning Commission. The committee has defined four areas of concern: 1. Tandem parking 2. Parking ratio requirements 3. Location of guest parking 4. Grandfather clause for developed lots Tandem Parking The committee feels that tandem parking is a potential, but not an overriding problem on Park Avenue because traffic hazards created by people backing onto Park Avenue could be minimized by better traffic control along Park Avenue. The committee therefore suggests that the matter of traffic control be brought before the city's Traffic Commission, Further, the committee recommends that tandem parking be allowed on all lots in the R-W zone which are less than 50 feet in width. This recommendation would modify staff's original recommendation to prohibit tandem parking in the R-W zone. Parking Ratio The current parking ratio requirement in the R-W zone is 1 space per unit. The committee feels this ratio is inadequate and agrees with staff's original recommendation of 2 spaces per unit plus guest parking (i.e., the same standard as the Condominium Ordinance). c .. .-. Location of Guest Parkins c Staff's original recommendation was to prohibit on-street guest parking. Staff's reasoning was that allowing guest parking on either Cove Drive or Park Avenue would magnify the existing parking shortage on both these streets at the time new development occurs. The committee recognizes the problem, however, feels this provision unfairly restricts developed properties which want to convert to condominiums. The committee, therefore, recommends that the provision of guest parking on-site apply only to new developments in Bristol Cove. Grandfather Clause A total of 19 lots are developed which could be considered for conversion to condominiums. These are relatively older developments and the committee feels most could not meet: the development standards of the Condominium Ordinance. The committee, therefore, is recommending that these existing developed lots and lots which have submitted applications for condominiums be excepted from the proposed parking standards of the R-W zone. Specifically, the committee and staff recommend the amendment of the following sections: Section 21.22.110, Parking Requirements - RW Zone - Presently this section provides for a parking ratio of 1 stall for every unit in the R-W zone. Staff recommends that this section be deleted from the ordinance. Parking requirements in the R-W zone would thus be the same as in any other residential ~ zone. Section 21.47.130(2), Condominium Ordinance - Parking - This section establishes parking standards for condominiums, Presently, this section has a provision excepting projects located in the R-W zone. Staff recommends that the wording excepting the R-W zone from the condominium parking standards be deleted for all undeveloped lots having no pending application for a condominium permit on them. Section 21.47.130(2) (C) , .Condominium Ordinance - On Street Parking - Presently, this section allows credit for on-street visitor parking. Staff recommends this section be amended to prohibit on-street visitor parking in the R-W zone for all undeveloped lots having no pending application for a condominium permit on them. Environmental Review The Planning Director has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on October 24, 1980. -2- RECOMMENDATION c. Q It is recommended that ,he Planning Commission APPROVE the Negative Declaration issued by the Planning Director and adopt Resolution No. 1723 APPROVING ZCA-129 based on the findings and subject to the conditions contained therein. The parking standards of the R-5r7 zone are considerably lower than those of other residential zones of the city, Presently one parking space per unit is the parking standard for both apartment and condominium developments in the R-W zone. The intent of establishing reduced parking standards for the R-W zone was to encourage high density development along a recreational waterway extending from Agua Hedionda Lagoon, Approximately one third of the R-W zone property has been developed with multiple-family residential structures and already it is apparent that parking is becoming a problem in the area, The parking problems fall into three general areas: 1) There is not enough parking on-site, thus, cars are forced to park in the street: 2) The narrow street width of Cove Avenue impedes traffic when cars are parked along the street: and 3) Allowance of tandem parking encourages more cars to park along the street instead of parking in stalls which do not have adequate ingress and egress, These parking problems were brought to the attention of the City Council by way of a report from Council Member Anear on August 29, 1980. At that meeting, the Council considered the matter and directed staff to prepare an amendment to the zoning ordinance to revise the R-W parking standards, To alleviate the increasing parking problem in the R-W zone, staff is recommending revisions to parking regulations in the R-W zone (Section 21-22}, the Condominium Ordinance (Section 21-47), and the Parking Ordinance (Section 21.44). Specifically, staff is recommending revisions to the following sections : Section 21.22.110, Parking Requirments - RW Zone - Presently this section provides for a parking ratio of 1 stall for every unit in the R-W zone. Staff feels this ratio is inadequate to meet the needs of projects in this zone and, therefore, is recommending that this section be deleted from the ordinance. If approved as recommended by staff, parking requirements in the R-W zone would be the same as in any other residential zone. ! Section 21.47.130, Condominium Ordinance - Parking - This section establishes parking standards for condominiums. Presently, this section has a provision excepting projects located in the R-W zone. Staff feels that the parking requirements of the Condominium Ordinance are just and fair and should apply to all condominium projects regardless of zoning. Staff is therefore recommending that the wording excepting the R-W zone from the condominium parking standards be deleted. Section 21.47.130(2) (C), Condominium Ordinance - On Street Parking - Presently, this section allows credit tor on- street visitor parking. Because of the narrow lot frontages (most are less than 50 feet) and the large amount of cars in the R-W zone, staff feels that projects built in the R-W zone should not receive credit for on-street visitor parking and is recommending a corresponding amendment to this section. Section 21.44.130(5)(B), Parking Ordinance - Tandem Parking - Currently, this section allows tandem parking in the front yard setback on residential lots with less than 50' of street frontage. Allowing tandem parking in certain instances can help to provide more on-site parking, however it creates three problems in the R-W zone. First, tandem parking encourages more people to park on the street who would otherwise park in an assigned stall but do not want to be blocked by other cars. Secondly, parking problems would be compounded by allowing the entire street frontage to be driveway, thus, eliminating the possibility of any curbside parking. Finally, cars tandemly parked are forced to back onto a narrow street (Cove Avenue) and a busy street (Park Avenue). Staff is therefore recommending that this section be amended to prohibit tandem parking in the R-W zone. These amendments are detailed in Exhibit "A" attached to this report. With these amendments to the zoning ordinance' staff feels that major parking problems in the Bristol Cove area will be prevented. Essentially, these amendments will bring the parking standards of the R-W zone up to the same level as other residential zones. The exceptions would be that where credit for on-street visitor parking can be considered by the city for condominium projects in other zones, it would not be allowed in the R-W zone. Also, tandem parking would not be allowed in the R-W zone. Given the potential for hicjh density development in Bristol Cove, the existing on-street parking problems, the narrow width of Cove Drive and the high traffic volume existing and anticipated on Park Drive, staff feels these amendments are justified and are essential to prevent future parking problems and facilitate the orderly development of this area. Environmental Review - The Planning Director has determined that this project will not have a significant impact on the environment and therefore has issued a negative declaration on October 24, 1980. -2- L ... .L . .'
