SUBJECT: ZONE CHANGE FROM R-l-7500 TO R-P ON ARBUCKLE PLACE CASE NO: ZC-229 APPLICANT: CITY OF CARLSBAD STATEMENT OF THE MATTER; ~~~ This item is a proposed zone change from R-l-7500 to R-P for 9 parcels located on the north and south sides of Arbuckle Place. The Planning Commission felt the zone change would eliminate a "spot zone" of R-l in an area that is predominately zoned R-P. Also, the Commission found the R-P zone to be consistent with the RMH/0 (Medium High-Residential/Professional) General Plan land use designation on the property. The existing single family residences on this street will remain legally conforming uses because such structures are permitted in the R-P zone. No opposition was expressed during the public hearing. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved. ENVIRONMENTAL REVIEW The Planning Director has determined that this, project will not cause any sig- nificant environmental impacts and, therefore, has issued a Negative Declaration, dated January 14, 1981, which was approved by the Planning Commission on February 11, 1981. A copy of the environmental documents is on file in the Planning Department. FISCAL IMPACTS The zone change in itself will not create any fiscal impacts. Subsequent applications for development on any parcels will be required to provide the necessary public improvements and also pay public facility fees. RECOMMENDATION Both the planning staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING ZC-229, per Planning Commission Resolution No. 1763. APPLICANT: CITY OF CARLSBAD CASE NO: ZC-229 WHEREAS, a verified application for certain property, to wit: A portion of Lot 47, Seaside Lands, in the City of Carlsbad, according to Map thereof No. 1722, filed in the Office of the County Recorder July 28, 1921. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the llth day of February, 1981, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. I. PROJECT DESCRIPTION AND BACKGROUND The proposed zone change, from R-l-7500 to R-P, involves nine parcels of land on the north and south sides of Arbuckle Place, more specifically identified on attached Exhibit "A", dated February 11, 1981. At the meeting of September 24, 1980, the Planning Commission recommended approval of a rezoning from R-l-7500 to R-P on two lots located on the northeast corner of Arbuckle Place and Madison Street. Citing the existence of spot R-l Zoning and the inconsistency with the land-use designation of the General Plan for the remaining properties on Arbuckle Place, the Commission directed staff to set to public hearing the consideration of rezoning of all the remaining R-l lots on Arbuckle Place. II. ANALYSIS Planning Issues 1) Is the proposed zone change consistent with the Land Use element of the General Plan? 2) Do the subject parcels meet the lot width and area requirements of the Zoning Ordinance for the proposed zone? 3) Would the proposed zone change adversely impact the subject area or surrounding properties? 4) Is the street system serving the subject properties adequate to handle any increase in traffic generated by the change of zone? Discussion The proposed zone change would reclassify nine parcels from R-l-7500 to R-P (Residential/Professional). This change of zone would be consistent with the RMH/O designation of the Land Use Element of the General Plan for this property. RMH/O denotes a combination district permitting residential development to a medium-high density and professional office and related commercial uses. The lots themselves are non-conforming R-l-7500 parcels by reason of inadequate lot area and frontage on a public street. The standards for minimum lot area and frontage are the same for both R-l-7500 and R-P zoning. Therefore, the lots would also be non-conforming to R-P standards. As the subject properties exist as non-conforming lots and the proposed rezoning would not affect this status, present uses or standards, staff feels the rezoning would be appropriate and not detrimental to any existing or permitted uses. The subject lots are bordered to the north and south by properties zoned R-P, to the west by C-2 (Central Business District) and R-P zoning and to the east by an R-3 (medium- high density) zone. The proposed zoning would be more compatible with surrounding zoning and uses. The project site is served by Madison Street and Jefferson Street. A slight increase in traffic generated on these streets and Arbuckle Place may be experienced as existing uses gradually convert to those uses permitted in the R-P zone. The street system, although portions are built at substandard right-of-way width, should be able to adequately handle any increase in traffic generated by any simple conversions. Some street improvements may become necessary in the future as developments of larger scale are introduced to the area. At this time, staff anticipates no change in existing uses nor adverse impacts to these properties associated with this zone change. Staff recommends that the subject lots be reclassified to R-P to eliminate a spot-zone and to bring the area into conformance with the General Plan. III. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and, therefore, has issued a negative declaration on January 14, 1981. Recommendation It is recommended that the Planning Commission APPROVE the negative declaration issued by the Planning Director and ADOPT Resolution No. 1763, recommending APPROVAL of ZC-229, —2 — t based on the findings contained therein.
