DEPARTMENT: City Manager Subject: CONSENT TO TRANSFER OF PROPERTY FROM VISTA UNIFIED SCHOOL DISTRICT TO CARLSBAD UNIFIED DISTRICT Statement of the Matter The Vista and Carlsbad School Districts are proposing to transfer territory between the districts. One piece of property to be transferred, Lake Calavera, is owned by the City. The County Board of Education is asking if the City of Carlsbad, as owners of the property, consent to the transfer. The school districts agree to the transfer. The districts are attempting to align school district boundaries with city boundaries. The territories (Areas 2 and 3 on the map) are uninhabited. Fiscal Impact The exchange of territory will have no direct impact on the City but would result in the more efficient provision of school services to city residents. Copies of the petition, legal description and map of the territory proposed to be transferred are included for your information. If the County Committee approves the petition to transfer both parcels, it shall order that the petition be granted pursuant to Education Code Section 35709 if both governing boards of the school districts and owners of the territories consent to the transfers. As a property owner of record, you are hereby requested to provide written consent to this proposed transfer which was initiated at the request of the affected school districts. If the transfers of territory are granted by the County Committee and subsequently approved by the Board of Supervisors, the transfers shall be effective for all purposes on July 1, 1982. If you have any questions or concerns about the proposed transfers of territory, please contact the undersigned at (714) 292-3746. We would appreciate your returning the enclosed consent form to the County Superintendent of Schools prior to April 1, 1981. A return envelope is enclosed for your convenience. The fund balance for our SB-201/I-43 collected funds is $488,795.00.' During the 1979-80 school year we purchased three (3) portable class- rooms for $49,690.76 and had an architectural expense of $1,500.00 - a total of $51,190.76. We have also employed an architect for the 80-81 school year to design and handle the necessary documents for two (2) additional facilities - one to be placed at Capri School and the other at Ocean Knoll School. The cost of these two facilities, alone, will be an additional $100,000.00. I hope this is the information you require under Section 21.55.260 of the Carlsbad Municipal Code. RECEIVED City Berk's Offic* Ctty of Carlsbad March 31, 1981 Ronald Packard, Mayor City of Carlsbad City Council 1200 Elm Avenue Carlsbad, California 92008 Re: Chapter 21.55 Dedication of Land and Fees for School Facilities Dear Mayor Packard: City Ordinance No. 21.55.210 states that if a School Fee Payment is required from an Owner/Builder, such payment shall be made when the building permit is approved and is sued. At this time, we propose a minor amendment to the ordinance. This amendment would allow an Owner/Builder to furnish a Secured Agreement to the San Marcos Unified School District in lieu of paying these fees when building permits are approved and issued. Fees would then be payable when the Notice of Completion is recorded. " We feel that this change is an opportunity for the City to assist in reducing the housing costs associated with municipal fees. Since almost all costs of con- struction are financed with construction loans, any funds not required during the ten to twelve months during which the project is being completed should help in reducing the builder's expense and the ultimate cost of housing to the buying public. We believe this change to be in the best interest of the general public, and that you, who formulate your city's policies, will want to initiate this ordinance change. This has been discussed with the San Marcos Unified School District and they are in complete agreement with this proposal. Thank you for your kind consideration and attention to this matter.
