SUBJECT : CARLSBAD BOULEVARD BI KEWAY PROJECT
ACCEPTANCE OF SUBORDINATION AGREEMENTS
STATEMENT OF THE MATTER
In the fall of 1979, the City Council acquired property for the widening
of Carlsbad Boulevard for the Bikeway Project. Now, over 18 months later
the City is still completing the paperwork on the “corner cut-off1’ parcels.
In addition to the acceptance of 13 easements for sidewalk and wheelchair
ramps, the City also had to obtainsand accept subordination agreements for
those properties which have trust deeds. Essentially, the subordination
agreement is an agreement on behalf of the trust deed’holder acknowledging
that the City’s easement is prior and superior to the lien of their trust
deed. An additional subordination agreement has been received and is ready
for acceptance.

RECOMMENDATION
Adopt Resolution No.bL/7C/authorizing the acceptance of a Deed of Partial
Reconveyance from the Bank of America.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ACCEPTING
A DEED OF PARTIAL RECONVEYANCE
WHEREAS, Bank of America has submitted a deed of partial recon-
veyance to the City of Carlsbad for street purposes; said deed is on
file in the Office of the City Clerk and is incorporated by reference
herein; and
WHEREAS, the City Council of the City of'carlsbad has determined
it to be.in the public interest to accept said deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
1. That'the above recitations are true and correct.
2. That the deed of partial reconveyance conveying real property
to the-City of Carlsbad for street purposes, is hereby accepted.
3. That the City Clerk is hereby authorized to cause the original
deed to be recorded in the Office of the County Recorder of San Diego
County, State of California, with the appropriate Certificate of Acceptance
attached. -
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Council held on the 7th day of April ' , 19~ by the
following vote, to wit:
