Statement of the Matter
The Carlshad School Distr'ict is installing an electrical trans-
former to serve new cultural arts building at the higkr school.
Service to the transformer will be underground. The existing
service line is beneath the Darking lot now owned by the city.
SDG&E has requested an easement from the city. On October 28,
1980 the Council approved an easement forr?. prepared by City
Attorney. Pespite the fact '3DG&F has accepted that form on
several occasions durinq the last four years, SDG&E is now unwil-
lins to accept the wording 07 the city easement.
In order to resolve this issJ.e, a Feeting was held April I, 1981.
Agreenent was reached on conpronise wording for this project
The city prefers to have the riqht to use the around surface for
any purpose which does not interfere with the utility line while
SDG&E wishes to prohibit any use. The revised easement prohibits
use without SDG&E ' s approval which cannot 'oe unreasonably with-
held. Additional meetinus will be held with SDG&E to resolve how
to handle future easexents.
Fiscal Impact
The School District could relocate the electrical line on school
property at a cost of $8,000. If city urants easement the cost
to School Oistrict would be $1,600.

on behalf of the city.
