SUBJECT: AGREEMENT FOR PROVISION OF AN ENVIRO~""TAL IMPACT REtDRT FOR
A 26 ACRE PUD (FDNTANA AND MUIX;E) .
S'I'A'l'EMENT OF THE MATTER:
Tne proposed project is a 26 acre Plalli!ed Unit Development. (PUD) located south
of Skylme Drive and west of Neblma Drivie. The caupleted mitial s-tudy res
indicated that a number of pdcential environmental impacts could result from the
proposed project~ Potential impacts were· identified relating to biology, arcre-
olo:JY, drainage, coastal caupatibility and ·landfonn alteraticn. The Plannmg I

Because both finns are qualified to provide this type of EIR, and both proposals
were equal in their treatment of the ida1tified issues, staff feels that selec-

PBR to provide the EIR. Also attacred is Resoluticn No. ~L/?/?'whicht if adopted,
approves an agreement ~ith Fbntana. and Mudge ensuring funding for provision of
the EIR.
FISCAL IMPACT
The developers (Fontana & Mudge) are respa1sible for provisicn of the fundmg
for this EIR. The developers have indicated that they will sign an agreement
and deposit the appropriate fw1ds ~to a trust account with the city, Approxi-
nately 50. to 60. hours of st.aff time will be utilized to process the EIR.

ter an agreement. with Fontana and Mudge to ensure adequate provisicn of funds
for the EIR.

A RESOLUTION ·oF THE.CITY COUNCiL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN
AGREEMENT BET\'lEEN THE CITY OF CARLSBAD AND
PHILLIPS, BRANDT, REDDICK FOR PREPARATiON
OF AN ENVIRONMENTAL IMPACT REPORT FOR A 26
ACRE PLANNED UNIT DEVELOPMENT.
The City Council of the City of Carlsbad, California,
does hereby resolve as follows:
1. That certain agreement between the City of Carlsbad
and Phillips, Brandt, ·Reddick for preparation of an environmental
impact report for a 26 acre Planned Unit Development, a copy of
which is on file with the City Clerk, and incorporated herein by
~eference, is hereby approved.
2. The Mayor of the City of Carlsbad is hereby author-
ized and directed to execute said agreement for and on behalf of
the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN
AGREEHENT BETWEEN THE CITY .OF CARLSBAD AND
FONTANA AND MUDGE, A DEVELOPMENT COMPANY,
WHEREBY THE CITY WILL ACCEPT FUNDS FROM THE
DEVELOPER FOR PROVISION OF AN EIR.
The City Council of the City of Carlsbad, California,
does hereby resolve as follows:
1. That certain agreement between the City of Carlsbad
and Fontana and Mudge, for provision of EIR funds, a copy of
which is on file with the City Clerk, and incorporated herein by
referencer is hereby approved.
2. The Mayor of the City of Carlsbad is hereby author-
ized and directed to execute said agreement for and on behalf of
the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Couucil of the City of Carlsbad, held on the 21st day of
