Statement of the Matter
The City Council is being asked to approve the final map foi
CT 80-25 Meadowbrook located in La Costa. The Engineering '
has completed checking the final map for conformance with t
State Subdivision Map Act and applicable local ordinances o
City of Carlsbad. The final map substantially conforms wit
conditions of the tentative map approved by the City Counci August 19, 1980, per City Council Resolution No. 6273. The
Council has previously determined that the requirements for
dedication may be satisfied by existing park credits held b La Costa Land Company (condition 10 of the resolution appro
the tentative map); however, the parks agreement between th of Carlsbad and the La Costa Land Company requires that San
Marcos Creek Park be dedicated or deeded to the City by La
or its successors, as a condition of approval of the first
subdivision map for an area designated by an exhibit to the
agreement. This applicant is bound by the contract between
City and La Costa and CT 80-25 is the first final map in th
designated under the agreement. The Daon Corporation, La C
successor in interest under the parks agreement,is unable

this time. In addition, the Parks and Recreation Director
determined that San Marcos Creek Park may not be a desirabl
site and is reconunending deferral of dedication of the park

Because a similar situation exists for CT 80-9 (Hidden Meadc
which will be filing a final map within the next few weeks,
Staff is recommendating that the Council modify the parks agreement requirement for that subdivision as well.
FISCAL IMPACT
Improvements and private streets associated with Carlsbad T
80-25 will be built by the developer. Increase in demand f(
City services will be offset by the payment of public facil
fees. Park credits are available under the parks agreement
satisfy the requirements for this subdivision.

CARLSBAD, CALIFORNIA,. DELAYING THE TIME AT WHICH SAN MARCOS CmEK PARK SHALL BE DEDICATED PURSUAN
TO THE AGREEMENT BETWEEN LA COSTA LAND COMPANY A
THE CITY OF CARLSBAD APPROVED BY CITY COUNCIL
RESOLUTION NO. 5286.
WHEREAS, the City Council, of the'City of Carlsb
has by Resolution rN0.5286 approved the parks agreement 3:
the City of Carlsbad and the La Costa Land Company; and

WHEREAS, Paragraph No. 4 of said Agreement provi

In accordance with the Agreement with La Costa Land Co., dated January 3 (Resolution No. 5286), this statement regarding this subdivision's oblig
