STATEMENT OF THE MAT
This item is a request for approval of a 10 unit tentative tract map and condo-
minium permit located on the west side of Santa Isabel Street, south of Alga
Road in the RDM Zone. The Planning Commission found that this project meets all
design criteria and development standards of the Condominium Ordinance. Also,
the Planning Commission felt the project's proposed density of 18.2 dwelling
units per acre was justified based on the project's recreational amenities,
ocean views and compatibility with adjacent developments.
Through staff review and Planning Commission hearing, all issues on this matter
have been satisfactorily resolved.
FISCAL IMPACT
The applicant is required to provide all necessary public improvements prior to
development of the site. Also, the applicant has agreed to pay a public facil-
ity fee to offset the cost of providing public services to the project.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any signi-
ficant environmental impacts and, therefore, has issued a Negative Declaration,
dated March 25, 1981, which was approved by the Planning Commission on April 22,
1981. The environmental documents for this project are on file in the Planning
Department.
RECOMMENDATION
Both the Planning staff and Planning Commission recommend that this application
be APPROVED and that the City Attorney be directed to prepare documents APPROV-
ING CT 81-8/CP-151 per Planning Commission Resolution No. 1799.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL
OF A 10 UNIT TENTATIVE TRACT MAP AND CONDOMINIUM •
PERMIT ON PROPERTY GENERALLY LOCATED ON THE WEST
SIDE OF SANTA ISABEL STREET
APPLICANT: WALTON

WHEREAS, a verified application for certain property to,
wit:
Lot 410 of La Costa Meadows Unit 2 according to Map 6905
filed April 21, 1971
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code? and
WHEREAS, at said public hearing, upon hearing and con-
sidering all testimony and arguments, if any, of all persons de-
siring to be heard, said Commission considered all factors rela-
ting to the Tentative Tract Map and Condominium Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
!Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of CT-81-8/CP 151, based
on the following findings and subject to the following con-
ditions:
Findings;
1) The project is consistent with the city's General Plan since
the proposed density of 18.2 du's/acre is within the density
range of 10-20 du's/acre specified for the site as indicated
on the Land Use Element of the General Plan and can be jus-
tified for the reasons stated in the staff report.

2) The site is physically suitable for the type and density of
the development since the site is adequate in size and shape
to accommodate residential development at the density pro-
posed and still meet all of the requirements of the Condo-
3) The project is consistent with, all city public facility pol-
icies and ordinances since:
a) The applicant has received 10 edu's from the Leucadia

not be approved unless the City Council finds that sewer
service is available to serve the project. In addition,
the Planning Commission has added a condition that a
note shall be placed on the final map that building per-
mits may not be issued for the condominium project un-

available, and building cannot occur within the project
unless sewer service remains available, the Planning
Commission is satisfied that the requirements of the
public facilities element of the General Plan have been
met insofar as they apply to sewer service for this ten-
tataive map and condominium permit approval.
15 c) School facilities will be provided by the San Marcos
School District.
d) Park-in-lieu fees are requiired as a condition of appro-
val.
e) All necessary public improvements have been provided or
will be required as conditions of approval.
f) The applicant has agreed and is^required by the inclu-
ion of an appropriate condition to pay a public facili-
ties fee. Performance of that contract and payment of
the fee will enable this body to find that public facil-
ities will be available concurrent with need as required
by the General Plan.

4) The land included within this project contains less than
five acres, each parcel abutts upon a maintained public
street and no dedications or improvements are required.
Therefore, in accordance with Section 20.20.050(1) of the
Carlsbad Municipal Code and Section 66426(d) of the
Subdivision Map Act, a parcel map may be filed in lieu of a'
final map.

5) The proposed project is compatible with the surrounding land

of Santa Isabel Street are being developed at a similar den-
sity and the surrounding area has also been designated for
medium-high density residential development.
6) This project will not cause any significant environmental
impacts, and a Negative Declaration has been issued by the
Planning Director on Mach 25, 1981 and approved by the
Planning Commission on April 22, 1981.
General Conditions
1) Approval is granted for CT-81-8/CP-151, as shown on Exhibits
"A""D" dated March 5, 1981, incorporated by reference and on
file in the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these con-
ditions.
2) This project is approved upon the express condition that the
final map shall not be approved unless the City Council
finds as of the time of such approval that sewer service is
available to serve the subdivision.
3) This project is approved upon the express condition that
building permits will not be issued for development of the
subject property unless the City Engineer determines that
sewer facilities are available at the time of application
for such sewer permits and will continue to be available
until time of occupancy. This note shall be placed on the
final map.
4) This project is approved upon the express condition that the
applicant shall pay a public facilities fee as required by
City Council Policy No 17, dated August 29, 1979, on file
with the City Clerk and incorporated herein by reference,
and according to the agreement executed by the applicant for
payment of said fee a copy of that agreement dated February
24, 1981, is on file with the City Clerk and incorporated
herein by reference. If said fee is not paid as promised,
this application will not be consistent with the General
Plan and approval for this project shall be void.

5) The applicant shall prepare a reproducible mylar of the
final condominium site plan incorporating the conditions
contained herein. Said site plan shall be submitted to and
approved by the Planning Director prior to the issuance of
building permits. This plan shall not exceed 24" x 36" in
size.
6) The applicant shall prepare a detailed landscape and irriga-
tion plan which shall be submitted to and approved by the
Planning Director prior to final map approval.

7) The applicant shall establish a homeowner's association and

effect at the time of building permit application.

corresponding covenants, conditions and restrictions. Said
CC&R's shall be submitted to and approved by the Planning
Department prior to final map approval.
8) The applicant shall pay park-in-lieu fees to the city, prior
to the approval of the final map as required by Chapter
20.44 of the Carlsbad Municipal Code.
9) The applicant shall provide school fees to mitigate condi-
tions of overcrowding as part of building permit applica-
tion. These fees shall be based on the fee schedule in
in conformance with the city's Sign Ordinance and shall re-
quire review and approval of the Planning Department prior
to installation of such signs.
11) All landscaped areas shall be maintained in a healthy and
thriving condition, free from weeds, trash, and debris.
12) Trash receptacle areas shall be enclosed by a 6 foot high
masonry wall with gates pursuant to city standards. Loca-
tion of said receptacles shall be approved by the Planning
Director.
13) All roof appurtenances, including air conditioners, shall be
architecturally integrated and shielded from view and the
sound buffered from adjacent properties and streets to the
satisfaction of the Planning Department and Building Direc-
tor.

Approval of this request shall not excuse compliance with
all sections of the Zoning Ordinance and all other appli-
cable city ordinances in effect at time of building permit
issuance.

Concrete wheel stops shall be provided two and one-half feet
from the end of each parking stall.

Additional public and on-site hydrants may be required by
the Fire Department.
The applicant shall submit two (2) copies of a site plan
showing locations of existing and proposed fire hydrants and
on-site roads and drives to the Fire Department for appro-.-,

All weather access road shall be maintained throughout con-
struction.

19) Water for fire protection shall be provided before combust-
ibles are on the building site.
20) Fire retardant roofs shall be required on all structures
subject to the approval of the Building Director and Fire
Marshall.
21) A dry standpipe system for Fire Department use shall be in-
stalled as required by the Fire Marshall.
22) All private driveways shall be kept clear of parked vehicles
at all times, and shall have posted "no Parking/Fire Lane/
Tow Away Zone" pursuant to Section 17.04.060 of the Carlsbad
Municipal code.
23) All fire alarm systems, fire hydrants, extinguishing sys-
tems, automatic sprinklers, and other systems pertinent to
the project shall be submitted to the Fire Department for
approval prior to construction
Parks and Recreation Department
24) All irrigation lines adjacent to the sidewalk shall be set
back at least 12" from the sidewalk.
25) The slope at the rear of the lot shall be heavily landscaped
with trees, shrubs and ground cover. Trees or shrubs shall
be planted at a ratio of one for every 100 square feet.
26) No street trees shall be removed during the construction of
this project without written approval of the Parks and Rec-
reation Department.
Engineering Department
27) The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
28) The grading for this project is defined as "regular grading"
by Section 11.06.170(a) of the Carlsbad Municipal Code. The
developer shall submit a grading plan for approval which
shall include all required drainage structures and any re-
quired erosion control measures. The developer shall also
submit soils, geologic or compaction reports if required and
shall comply with all provisions of Chapter 11.06 of the
Carlsbad Municipal Code.
29) The developer shall install street trees at the equivalent
of 40-foot intervals along all public street frontages in
conformance with the City of Carlsbad standards. The trees'
shall be of a variety selected from the approved Street Tree
List.

STAFF REPORT

SUBJECT: CT 81-8/CP-151 WALTON - Request for a 10 unit Tentative
Tract Map and Condominium Permit on Property Located on
the West Side of Santa Isabel Street, La Costa, in the
RDM Zone
I." PROJECT DESCRIPTION
The applicant proposes to construct two buildings providing a
total of 10 dwelling units on a previously graded .55 acre parcel
located as described above. Construction of this project will
require approximately 750 cubic yards of grading. The project
will result in a net density of 18.2 dwelling units-per acre
which is towards the high end of the General Plan designation of
10-20 du/ac for this site. The properties to. the south and north
have approved tentative tract maps for similar condominium
projects while the property to the west-is occupied by
condominiums. A Catholic church is located on the property to
the east.
II. ANALYSIS
Planning Issues
1) Does the project conform with the development
standards of the condominium ordinance?
2) Does the project conform with the design criteria of
the condominium ordinance?
III. DISCUSSION
The subject property is located on top of a hill that slopes
steeply to the west providing excellent views of La Costa and the
Pacific Ocean. The applicant has designed this project so that
all of the units in the westerly most building will take
advantage of this view. Also, this property is somewhat higher
than the property to the east and the applicant has located the
other building so that the residents will have a view of the back
county and a partial ocean view from'their balconies. Each of
the units will have a two car garage with automatic garage door
openers. Three of the five required guest parking spaces will be
provided adjacent to the recreation area while the other two will
be located on Santa Isabel Street, adjacent to the site. Each of
the units will have at least 480 cubic feet of storage space
accessible to the outdoors as required by the Condominium
Ordinance.
As proposed this project will have approximately 347 square feet
of recreation area per unit. The main recreation area will be
centrally located and consist of a swimming pool, Jacuzzi,
cabana, barbeque facilities and picnic tables. In addition, a
320 square foot common patio with barbeque facilities will be
constructed along the westerly edge of the property. Each unit
will have four balconies with a total area of approximately 220
square feet. As shown on Exhibit "C", the trash area will be
centrally located. Staff feels that this project me'ets all the
development standards of the condominium ordinance.
Design Criteria'
As designed, staff feels the proposed project meets all of the
design criteria of the Condominium Ordinance. The proposed
project will be compatible with similar condominium projects
under construction along Santa Isabel Street. This project has
been designed to minimize the amount of paving required to serve
the 10 dwelling units. The recreation areas are centrally
located and are conveniently accessible to all of the units.
The applicant is requesting that- the Commission approve the
project at a density of 18.2 dwelling units per acre which
approaches the maximum density designated for this site (1020
du/ac). Staff feels that this density is justified for the
following reasons: 1) The project will have a substantially
greater amount of recreation area than the 200 square feet per
unit required by the Condominium Ordinance? 2) all of the units
in one of the buildings will have an ocean view, while the other
units will have partial ocean views and back country views; 3)
the density of the project is compatible with the zoning and
previously approved condominium projects on Santa Isabel Street.
IV. ENVIRONMENTAL REVIEW "
The Planning Director has determined that this project will not
have a significant impact on the environment and therefore has
issued a Negative Declaration, dated March 25, 1981.
V. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Planning Director and adopt
Resolution No. 1799 Recommending APPROVAL OF CT 81-8/CP-151 to
the City Council based on the findings and subject to the
conditions contained therein. .
