Hd.~ c. Atty. V/:8 C. Mgr., ~ Annually the city carries out a Heed Abatement Program to e ,,ninate fire hazard and nuisance caused by weed and rubbish on lots. In May 1981, 381 pil,rcel owners were noti.fied· to clear lots by June 2. Private contractors will _do the work at a cost of $25.00 per hour plus $12 administrative fee. . . To date,.240 parcels have been cleared and 47 others have asked the city to cortract for the work. . · · The remaining 94 parcel owners have not complied. Council may now schedule a pub1ic hearing on June 16 to declare the 94 lots a publi'c nuisance and order city to clear the lots. Fiscal Impact Full cost of this program Js paid by owners of lots being abated. In the ~vent of non- payment, a lien wil·l be filed against the property for labor costs, plus $75 ,administrative fee. AfeROVED May 22, 1981 MEMORANDUM TO: City Manager FROM: Acting Director of Utilities & Maintenance Sl!BJECT: Status Report; Weed Abatement 1981 A visual inspection in early March identified 381 parcels as potential abatement problems. 81-085 Attached is a copy of a letter which was sent to the owners of these parcels in early May, explaining the Weed Abatement Program and listing information relating to fees, etc. A postcard was also included in this mailing to facilitate the owners advising us of the action they intend to take. A total of 47 parcel owners have indicated they wish the city to abate and they will pay the $12.00 administrative fee. 240 parcel owners have completed abatement efforts at their own expense at this time. Abate- ment has not yet been accomplished on 94 parcels, nor have we received information as to the owners' 1ntent, and these will require official noticing as a nuisance. Council will hear objections to this declaration at their meeting of June 16. Abatement by the city can proceed after that date. Parcel number as noted on mailing label, of which you are the owner of record, is one of those parcels which poses this potential hazard. Your parcel should be cleared of weeds no later than June 2, 1981 to preclude them being declared a public nuisance by the City Council at their meeting of June 2. You may abate these weeds yourself, or contract for the service. Note enclosed contractors list which you may contact to have the weeds cut prior to June 2. I have also included a postcard which you may return should you prefer that the City make arrangements for the abatement of your property. YOU WILL BE BILLED FOR THE COST OF ABATEMENT, PLUS A $12.00 ADMINISTRATIVE FEE. The fee was established Qctober 28, 1980 by City Council Policy Number 24. The work will be performed by private contract and inspected by the City Sanitation Inspector prior to bi1ling you for payment. THE CHARGE FOR ABATEMENT ON THE HOURLY BASE OF $30.00 IS FOR DISCJ~G AND $25.00 FOR MOWING. YOUR BILL WILL REFLECT THE TIME INVOLVEMENT TIMES THE H.:'IJRLY AATE, PLUS THE $12.00 ADMINI"TRATIVE FEE. If your parcel requires material to be hauled to a disposal site -the rate of compensa- tion will be establ'ishel. by the amount chargec.i by the disposal site. At the conclusion of the Public Hearing of June 16, the City Council shall in- struct the Sanitation Inspector to abate the nuisances in the City of Carlsbad. If your parcel has not been abated by this date your parcel will be aba~~d and a $75.00 ADMINISTRATIVE FEE WILL BE ADDED TO THE COST OF ABATEMENT. THIS TOTAi WILL BE SUBMITTED TO THE COUNTY OF SAN DIEGO TAX COLLECTOR AND WILL CONSTITUTE A LIEN ON YOUR PARCEL($) UNTIL SUCH TIME AS THE COUNTY TAXES ARE PAID. RESOLUTION NO. 6548 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING AS PUBLIC NUISANCES, RUBBISH AND REFUSE UPON PRIVATE PROPERTY IN THE CITY OF CARLSBAD. rhe City Council of the City of Carlsbad dpes hereby resolve as follows: 1. That this resolutio~, and all action taken subsequent hereto in . .,. connection herewith, is taken pursuant to the provisions of California Government Code Section 39560, et seq. (Article 2, Alternate Procedures Under Chapter 13, Weed and Rubbish Abatement). 2. Words used in this resolution and its subsequent action in connection herewith shall be defined as outlined in said Code Sections. 3.
