DATE: JUNE 2, 1981 City Atty\)F/ DEPARTMENT: Engineering ; CIty M9r/g\j~, SUBJECT: FINAL MAP AND PARK DEDICATION FOR CARLSBAD TRACT 74-25 UNIT NO. 2 (TANGLEWOOD) STATEMENT OF THE MATTER Engineering staff has completed checking the final map of Carlsbad Tract 7^-25, Unit No. 2, for conformance with the State Subdivision Map Act and applicable ' local ordinances of the City of Carlsbad. The final map conforms substantially with the conditions of the tentative map approved by City Council on September 3, 1975 per Council Resolution No. 3076. Condition No. 9 of the above stated resolution requires that the subdivider dedicate their final park site concurrent with the recordation of the final map for this tract. The owner-developer has, therefore, submitted a grant deed and partial reconveyance for Council acceptance in satisfaction of this requirement. FISCAL IMPACT All road improvements are either existing or will be constructed by the developer. After acceptance of the impr&vements the City will assume the.ongoing maintenance responsibility for the public streets. The cost of the development of the park site will be borne by the City. Funds for its development are currently included in the proposed five-year Capital Improvement'Program. The developer has addition- ally-contributed $7732 for park site development as a requirement of the tentative .map^conditions. Since this project was approved prior to the institution of the revised Council Policy 17, the developer is not required to pay any public fac- ilities fees. ENVIRONMENTAL INPACT Environmental impacts of this development were considered at the tentative map stage and were either satisfied or mitigated at' that time. RECOMMENDATION Adopt. Resolution No. ££~s£ , accepting the Gramf Deed and Partial Reconveyance for the park site; APPROVED •^'&MWi^ce.'I EXHIBIT NO. 1 VICINITY EXHIBIT NO. 2 10 11 12 1' RESOLUTION NO.. 6558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED FROM THE HIGHLAND COMPANY AND A PARTIAL RECON- VEYANCE FROM TITLE INSURANCE AND TRUST COMPANY FOR PARK PURPOSES. _ WHEREAS, the Highland Company has submitted a Grant Deed, and Title Insurance and Trust Company has submitted a Partial Reconveyance conveying >• " . real property to the City of Carlsbad for park purposes; said Deed # 793 , and a Partial Reconveyance #__794_, is on file in the Office of the City Clerk and is incorporated by reference herein; and WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public interest to accept said Deed; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Grant Deed and Partial Reconveyance conveying real property to the City of Carlsbad for park site is hereby accepted. - 3. That the City Clerk is hereby authorized to cause the original Deed and Partial Reconveyance to be recorded in the Office of the County Recorder of San Diego County, State of California, with the appropriate Certificates of Acceptance attached.
