Wf DEPARTMENT: City Clerk C' Subject: Application for Certificate of Convience and Necessity to Operate Taxi in City of Carlsbad - Applicant: Frank Barberi, dba "Frank's Cab" Statement of the Matter An application has been received from Frank N. Barberi, dba Frank's Cab, to operate a taxi service in the City of Carlsbad. His application is in order and all necessary inspections have been made and approved. His fares are proposed as follows: Initial drop - $1.00, including the 1st 1/5 mile $.20 per 1/5 mile thereafter $ 10.00 per hour waiting time At the present time, the City is being served by three companies. Since no limitations have been set as to the number of taxi companies that may operate in the City, applications are accepted and processed. Approval of this application would allow a total of four taxi companies to operate in the City of Carlsbad. Certificates issued to the other companies have been established so that they all expire April 21, 1984. The Certificate for this application has been prepared so that it will also expire on April 21, 1984, so that renewals for all taxi companies operating in the City will be before Council for consideration at the same time. Fiscal Impact There is no direct fiscal impact to the City. Citizens of Carlsbad will have the choice of calling an additional cab company for service, and will pay established rate. Recommendation Adopt Resolution No. £>S~6>/, determining that the public interest, convenience and necessity require the issuance of a Certificate to Frank's Cab to operate 1 taxicab in the City of Carlsbad and ordering the City Clerk to issue said Certificate subject to certain conditions. Barberi This is Co advise that we have accepted from Mr. Barberi a down payment to arrange insurance coverage on a 1972 Chrysler New Yorker to be used as a taxi cab. The coverages will be bodily injury and property damage liability with limits of 100,000/300,000/50,000 and uninsured motorist with limits of 15,000/30,000. (g) The City shall have the right to inspect all vehicles at any time to insure they are maintained in safe operating condition. (h) Applicant may only use the vehicle listed on his application. (i) Applicant shall file certification of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate. (j) No taxi stands are permitted. 4. That the City Clerk is hereby directed to issue a copy of this resolution as a certificate in accord with Chapter 5.20 of the Carlsbad Municipal code. 5. A description of the vehicle is detailed therein. I am planning on noticing this matter for public hearing on March 3 before the City Council. If you foresee a problem with completing the necessary inspections by that date, please let me know. However, per the Municipal Code, the matter must be brought forward within 30 days. Attached is the Applicant's check in the sum of $15.00 to cover your investigation fees.
