Subject: Application for Certificate of Convience and Necessity to
Operate Taxi in City of Carlsbad - Applicant: Frank Barberi,
dba "Frank's Cab"
Statement of the Matter
An application has been received from Frank N. Barberi, dba Frank's
Cab, to operate a taxi service in the City of Carlsbad. His application
is in order and all necessary inspections have been made and approved.
His fares are proposed as follows:
Initial drop - $1.00, including the 1st 1/5 mile
$.20 per 1/5 mile thereafter
$ 10.00 per hour waiting time
At the present time, the City is being served by three companies.
Since no limitations have been set as to the number of taxi companies
that may operate in the City, applications are accepted and processed.
Approval of this application would allow a total of four taxi companies
to operate in the City of Carlsbad.
Certificates issued to the other companies have been established so
that they all expire April 21, 1984. The Certificate for this application
has been prepared so that it will also expire on April 21, 1984, so
that renewals for all taxi companies operating in the City will be before
Council for consideration at the same time.

Fiscal Impact
There is no direct fiscal impact to the City. Citizens of Carlsbad
will have the choice of calling an additional cab company for service,
and will pay established rate.
Recommendation
Adopt Resolution No. £>S~6>/, determining that the public interest,
convenience and necessity require the issuance of a Certificate to
Frank's Cab to operate 1 taxicab in the City of Carlsbad and ordering
the City Clerk to issue said Certificate subject to certain conditions.

On 2/9/81, applicant BARBERI initiated an application to operate a
taxi within the city limits of Carlsbad. Taxi will be a 1972 Chrysler
New Yorker. Vehicle was inspected by James BERTELSON, Utilites and
Maintenace Supervisor who indicated that initially the brakes would
have to be replaced, which was done, prior to passing inspection.
A record check with local agencies, DMV, CII and NCIC revealed no
criminal record.
The Undersigned can not foresee any special policing problem in the
acceptance of this application.

To Whom It May Concern:-
Re: Frank N. Barberi
This is Co advise that we have accepted from Mr. Barberi a down payment
to arrange insurance coverage on a 1972 Chrysler New Yorker to be used
as a taxi cab. The coverages will be bodily injury and property damage
liability with limits of 100,000/300,000/50,000 and uninsured motorist
with limits of 15,000/30,000. The insurance company will be National Fire
and Marine.
We are awaiting definite instructions from Mr. Barberi as to when the in-
surance coverage is to become effective.

NOTICE IS HEREBY GIVEN that the City Council of the
City of Carlsbad, California, will hold a public hearing
in the City Council Chambers, 1200 Elm Avenue, Carlsbad,
California, on Tuesday, June 2, 1981, at 6:00 P.M., to
consider an application submitted by Frank N. Barberi for
a Certificate of Convenience and Necessity to operate
taxicab service in the City of Carlsbad, to be known as
Frank's Cab, in accordance with Ordinance No. 6010 of the
City of Carlsbad, California.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE
3 PUBLIC INTEREST, CONVENIENCE, AND NECESSITY
REQUIRE THE ISSUANCE OF A CERTIFICATE TO
4 ' FRANK N. BARBERI, DBA "FRANK'S CAB" TO OPERATE
ONE TAXICAB IN THE CITY OF CARLSBAD AND
5 ORDERING THE CITY CLERK TO ISSUE SAID
CERTIFICATE SUBJECT TO CERTAIN CONDITIONS.6

8 WHEREAS, Frank N. Barberi DBA "Frank's Cab" in accord with
Chapter 5.20 of the Municipal Code has applied for a Certificate
10 of Convenience and Necessity to operate taxicab service within•
11 the City of Carlsbad; and
12 WHEREAS, pursuant to said chapter a public hearing was held
13 on June 2, 1981, to determine whether or not the public
14 interest, convenience, and necessity require the issuance of the
15 certificate applied for and;
16 WHEREAS, at said hearing all persons having interests in the
17 matter were heard;
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
19 City of Carlsbad, as follows:
20 1. That the above recitations are true and correct.
21 2. That1'the public interest, convenience and necessity
22 require the issuance of the certificate applied for.
23 3. That said certificate is hereby issued to Frank N.
24 Barberi, dba, "Frank's Cab", to expire on^april 21, 1984,
25 subject to the following terms and conditions:

(a) The certificate permits service throughout the
City of Carlsbad.
(b) One taxicab' vehicle is authorized.
(c) The schedule of fares to be charged shall be:
"" Initial drop $1.00 including first 1/5 mile; $.20 for each
additional 1/5 mile; waiting time $10.00 per hour.
(d) The certificate and the operation of taxi service
pursuant thereto shall be subject to all of the provisions
of Chapter 5.20 of the Municipal Code.
(e) s The certificate is issued to commence on the
date of adoption of this resolution and to expire on
April 21, 1984.
(f) Applicant's application form which is on file in
the Office of the City Clerk, shall be made a part of this
certificate, and is incorporated by reference herein.
(g) The City shall have the right to inspect all
vehicles at any time to insure they are maintained in safe
operating condition.
(h) Applicant may only use the vehicle listed on
his application.
(i) Applicant shall file certification of insurance in
the amounts of $100,000/300,000 with the City Clerk prior to
commencing service pursuant to this certificate.
(j) No taxi stands are permitted.
4. That the City Clerk is hereby directed to issue a copy
of this resolution as a certificate in accord with Chapter 5.20
of the Carlsbad Municipal code.
5. That the certificate shall not be issued until the

ditions .

SUBJECT: APPLICATION FOR CERTIFICATE OF
CONVENIENCE & NECESSITY
Attached is a copy of an Application for a Certificate of
Convenienced & Necessity to operate taxi service in the City
by Frank's Cab. A description of the vehicle is detailed
therein.
I am planning on noticing this matter for public hearing on
March 3 before the City Council. If you foresee a problem
with completing the necessary inspections by that date, please
let me know. However, per the Municipal Code, the matter must
be brought forward within 30 days.
Attached is the Applicant's check in the sum of $15.00 to cover
your investigation fees. By copy of this Memorandum, I am
advising the City Business License Clerk and the Mechanical
Maintenance Superintendent, Jim Bertelsen, who also have approvals
and inspections to make.
