DATE: June 16, 1981 DEPARTMENT: PERSONNEL Subject: PROPOSED PERSONNEL RULE CHANGE Statement of the Matter Initial: Dept.Hd.� C. Atty. C. Mgr.;�--_� As the result of a Personnel Board hearing conducted on December 18, 1981, the city was directed to meet and confer with representatives of the Carlsbad Police Officers' Association regarding a possible personnel rule change. The CPOA proposed the following language as a rule change involving anniversary date changes upon promotion. Second paragraph Section 5, Rule IV, Page 9. A police employee serving in Salary Step E, shall be eligible upon promotion for subsequent salary step increases in a higher range on the annual anniversary of the date of promotion. When a police employee is promoted from Step A, B, C, or•D, that employee shall retain the anniversary date which --was in effect in the salary range from which the employee was promoted. The purpose of this proposed change is to eliminate an apparent inequity resulting from the current rule. Because similar inequi- ties have not arisen in other departments and the Personnel Board directed the meeting with CPOA, the change applies only to the Pdiice Department. At present when a police employee is promoted, a new anniversary date is established. In the case which was referred to the Personnel Board, this action delayed.a step increase for about ten months. This delay proved to cause a salary disparity among, peers. As an example, if an officer is promoted before reaching the next anniversary date of employment the promotion brings a salary increase` equal to a step increase. The employee must then wait a year for the next step increase. Whereas, if the employee waits until the normal step raise and then is promoted, a two step increase is received. In the Police'Department two individuals were promoted under these conditions. The result was that junior employees further down on the promotional list received two increases. Fiscal Impart The maximum fiscal impact would be the cost of one step increase, or approximately 4.9% per employee per promotion. The dollar amount would vary with salary range and step. Exhibit 1. Rule Change The attached agenda bill and resolution are a result of the Personnel Board hearing in the case of Sergeant SHIPLEY, and Senior Police Officer STAPLETON. The Personnel Board on the conclusion of that hearing directed the city -to meet and confer with representatives of the Carlsbad Police Officers' Association in an effort to reach agreement concerning a modification to the personnel rules. This modification was intended to correct situations such as that which occurred in the case of Senior Police Officer Stapleton. In this case Officer STAPLETON was promoted prior to her normal anniversary elate and received what equated to a one step increase upon promotion from Police Officer to Senior Police Officer. Contemporaries who were on the same promo- tional list but promoted after their anniversary date received a step increase in their previous range and then another approximate step increase upon promotion to Senior Police Officer. Therefore, they received two salary increases during the same period that Officer STAPLETON received one and Officer STAPLETON at one point was -not scheduled to receive another salary increase until ten months later than the appointment of her more junior contemporaries. Therefore, the language shown in the attachment resolution and agenda bill constitutes a recommendation for a change to the existing personnel rules concurred in by the CPOA and the City of Carlsbad. h � _ JNEUP/RO&MEN. WHEREAS, the present rule governing the change in anniversary date upon promotion of police personnel has resulted in unequal treatment among personnel; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2. That the following language is directed and authorized as an addition to Section 5, Rule IV, Personnel Rules and Regula- tions, Resolution No. "B. Anniversary Date Adjustment upon.Promotion: A police employee serving in Salary Step E,- shall be eligible upon promotion for subsequent salary step increases in a higher range on the annual anniversary of the date of promotion. When a police employee is promoted from Step A, B, C, or U, that employee shall retain the anniversary date which was in effect in the salary range from .,;hich the employee was promoted."
