CASE NO: ZCA-136 APPLICAWI?: CITY OF CARLSRAD STATEMENT OF THE MATI'ER: This item is an amendment to the R-1, R-A, R-E and E-A zones establishing development standards for mobile homes and conventional houses on single family lots. This amendment would implement Government Code Section 65852.3 (Senate Bill 1960, adopted September 1980) which prohibits cities from imposing restrictions on mobile homes in R-1 zones if such restrictions do not apply to amventional houses. to garage structures, roof pitch, siding material and foundation type. All of the proposed standards would apply to both mbile homes and conventional single family houses. PACKARD, Mayor STAFF REPORT DATE: June' 10, 1981 TO: Planning Commission FROM : Pl anning Department SUBJECT: ZCA-136, CITY OF CARLSBAD - Amendment to the Zoning Ordinance to allow. mobilehomes to be located lots in si ngl e fami 1 y resi denti a1 zones. 1.PROJECT DESCRIPTION AND ANALYSIS This Zone Code Amendment proposes to amend the single family zones (the R-1, E-A, R-A and R-E) to'allow mobilehomes to be located on single family lots. On September 26, 1980, the state legislature added Section 65852.3 to the Government Code (Senate Bill 1960) which allows newer mobile homes, those built after 1974, to be located on lots zoned for single family homes. As gle family homes. As a result of the Planning Cornmission consid- eration of this report, the Commission directed staff to amend the single family zones to develop a set of criteria which would supplement the existing zoning standards and which would apply to mobile homes as well as conventional- built homes to insure that they would be compatible with existing homes anywhere in the city. Staff has developed a set of development standards that would be applied to homes in all single family zones. The Commission ch/Juld be aware that Section 65852.3 permits the city to subject ' any mobile home to the same development criteria applied to con- ventionally built housing in the R-1 Zone. Staff has examined a number of mobile home parks and attempted to determine which fea- tures tend to make a mob.ile home resemble a conventionally built home. Staff has prepared a slide presentation that will be pre- sented at the Commission meeting which will help identify those features which make mobile homes more compatible with single family homes. Many mobile homes have long carports along one side of the struc- ture rather than a garage. Staff feels that this type of a car cover is not compatible with a typical residential neighborhood. A standard width two car garage would be more compatible with a single family residential neighborhood. As well as being more aesthetically appealing, a two car garage would provide better secur.ity and protection. I f \ '< the Commission will recall, at the May 13, 1981 meeting, staff '\ submitted a report concerning mobile homes on lots zoned for sin- '\ -..- Section 65852.3 requires that mobile homes located on single fam- ily lots be placed on a permanent foundation. Staff feels that this is a valid requirement since all homes located on single family lots are on permanent foundations. Staff also feels that corragated aluminum sidings, awnings and roofs are not compatible with sing1 e family neighborhoods and suggests these features be pPohibited and that all roofing and siding materials would be brick, wood or masonry exterior unless some other exterior mate- rial would be compatible with the existing homes in the neighbor- hood and, therefore, be specifically permitted by the Planning Director. Staff feels that all roofs should have a pitch of at least 3 inches in' 12 inches. A mobile home with a pitched roof would be far more compatible with a single family residential neighborhood than would one with a flat roof. The addition of the proposed amendments to the Carlsbad Zoning Ordinance could slightly increase the amount of time necessary to review a building permit for a single family home; however, staff feels that it is the best way to implement Government Code Sec- tion 65852.3 while protecting the value of existing and future homes in the city of Carlsbad. 11. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a signiffcant impact on the environment and, therefore, has issued a Negative Declaration on June 7, 1981. 111. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Nega- . tive Declaration issued by the Planning Director and adopt Reso- lution No. 1817, recommending APPROVAL of ZCA-136 to the City Council based on the findings and subject to the conditions con- tained therein.
