MGR.G� SUBJECT: PROPOSED ENERGY ORDINANCE STATEMENT OF THE -MATTER: This item, for your consideration and review, is an ordinance regulating energy conservation. It requires solar heating for all new swimming pools, requires all new residential construction to be pre -plumbed for solar and requires other energy conservation standards. This item was first reviewed by the City Council in January of 1981. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have any signif- icant environmental impacts and has issued a Negative Declaration. The Negative Declaration is attached and will require City Council action. FISCAL IMPACT There will be no direst fiscal impact to the city other than staff time necessary to enforce the provisions of the ordinance. The increased demand on staff time would be negligible. It is estimated that pre- plumbing a house for solar equipment will add $200-500 per unit as opposed to $3,000-5,000 per unit for the installation of solar equipment. Based on the available research, requiring solar heaters for pools in this ordinance is cost- effective (see attached memo). The City Energy Committee recommends that the City Council certify the Negative Declaration and that Ordinance No. i&_73 is introduced. ATTACHMENTS 1. Memo to City Manager, dated July 20, 1981 2. APPROVED r- MEMORANDUM DATE: July 20, 1981 TO: City Manager FROM: Chairman City Energy Committee SUBJECT: ENERGY CONSERVATION ORDINANCES The primary reason for proposing this ordinance to require solar heaters for new swimming pools is the natural gas savings. The County of San Diego estimated in 1979 that 300-800 therms of nat- ural gas per year could be saved if a similar ordinance were en- acted. Total, non -pool gas consumption for homes using gas for water and space heating is approximately 700 therms per year. Therefore, pool heating represents a potential 40-100% increase in gas consumption. Annual gas savings from this ordinance will increase each year as more pools subject to its provisions are built. However, as the price of natural gas increases the econo- mic considerations of pool owners will have the same effect. Cost analyses prepared for the County of San Diego ordinance in- dicate that when a pool owner regularly uses a pool cover and rarely uses the gas heater during the swim season (May-october), a solar system would not be cost effective. However, if the cover is not used and the pool is heated, a solar system is cost- effective. (See Table 1) Whether or not to adopt this ordinance involves more than deci- sions based on cost-effectiveness. Energy savings and the long term effects in stimulating conservation technology must also be considered. The fact that the ordinance may not prove cost-effective for peo- ple who use their gas heater infrequently or who keep their pool covered all the time would argue against the ordinance. However, after weighing all the factors, the City Energy Committee recom- mends adoption of this ordinance for the following reasons: 1. There would be a substantial savings in natural gas. 2. Pool heating may be considered a non -essential use of natural gas. 3. Adoption of this ordinance would further encourage solar technology development. K The other main feature of this ordinance, requiring all new resi- dences to be pre-plumbed'for solar, was recommended by the City Council earlier this year. PRWECT DESCRIPTION: It is proposed to amend Chapter 18.30 of the Carlsbad Municipal Code to require an active or passive solar system for all new swimming pools and requires other energy conservative measures. An additional resolution is proposed to set standards for passive solar design in subdivisions. The City of Carlsbad has conducted an environmental review of the above described project pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the. Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, a Negative Declaration (declaration that the project will not have a significant impact on the environ-nent) is hereby issued for the subject project. Justification for this action is on file in the Planning Department. A copy of the Negative Declaration with supportive documents is on file in the Planning Department, City Hall, 1200 Elm Avenue, Carlsbad, CA. 92008. Continents from the public are invited. The Energy Committee has reviewed these exceptions and offers the following comments: Item 2 is a valid concern. It was never our intention to man- date pre -plumbing on units that could not possibly benefit from a future solar installation. If the Council believes that this exception should be incorporated into the ordinance, an ordinance modification will be prepared. Items 1 and 3 propose waivers based on alternate energy sources or future technology. The Committee believes that staff and applicant time to process these waivers would far exceed the minimum cost for pre -plumbing. After the Council adopted the Energy Ordinance Vice Mayor Casler suggested that, prior to second reading of the ordinance, I convey through letter the concerns of CIF regarding the pre - plumbing requirement. In response to the Vice Mayor's sugges- tion, below is a brief discussion of our continued concerns. Section 18.30.030 of the proposed ordinance requires that all new residential units include plumbing designed to allow the later installation of a solar water heating system. Mandating pre -plumbing in all new residential units is unwise. Just as your Council has provided flexibility in the Energy Con- servation Design Standards by allowing for exceptions to the standards, your Council should also allow for exemptions to the pre -plumbing requirement. Clearly not every new home constructed in Carlsbad will be able to take advantage of solar energy. The configuration of some existing parcels prohibits the desired building and roof orientation. Other parcels are shaded by trees or neighboring buildings. Still other applicants may have little reason to install solar because similar or greater energy savings will be achieved through other technologies. S K Mayor Packard & Council Members August 6, 1981 Page 2 It is therefore our recommendation that your Council modify the ordinance to allow for exemptions under the following conditions: (1) The applicant can demonstrate to the satisfaction of the Planning Director that solar water heating is not cost effective for the subject project. (2) The subject project is unable to accomodate solar water heating because of physical impediments. (i.e. shaded parcel, orientation of building/roof, con- figuration of the parcel). (3) The applicant can demonstrate to the satisfaction of the Planning Director that the subject project will achieve energy savings equal to or greater than those projected for solar water heating through alternate design or technology. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Title 18 of the Carlsbad Municipal Code is amended by the addition of Chapter 18.30 to read as follows: Chanter 18.30 ENERGY CONSERVATION REGULATIONS Sections: 18.30.010 Purpose and application. 18.30.020 Solar water heater pre -plumbing required. 18.30.010 Purpose and application. This article is intended to decrease dependence upon nonrenewable energy sources by encouraging and in some instances requiring the installation of devices, structures or materials for the conservation of energy on certain structures within the city. The provisions of (this chapter are intended to supplement and not supersede other regulations and requirements imposed by this title. 18.30.020 Solar water heater pre -plumbing required. All new residential units shall include plumbing specifically designed to allow the later installation of a system which utilizes solar energy as the primary means of heating domestic potable water. No building permit shall be issued unless the plumbing required pursuant to this section is indicated in the building plans. This section shall apply only to those residential dwelling units for which a building permit was applied for after the effective date of the ordinance adopting this chapter. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
