Subject: REQUEST TO REVISE SCHOOL FEES FOR ENCINITAS UNION
SCHOOL DISTRICT.
Statement of the Matter
The Encinitas Union School District has recertified overcrowding in
its attendance areas and is requesting that school fees collected
from developers, pursuant to SB 201 and Chapter 21.55 of the Munici-
pal Code, be increased 9.33%. The fee increase is summarized as
follows:

Code allows the Council to adjust the fees from time to time by

Dear Sir:
The Encinitas Union School District has reviewed their cost in pro-
viding interim facilities for developments that are contributing to
our overcrowding conditions.
The Encinitas Union School District has purchased five portable class-
rooms and three trailers for support services.
La Costa developments have contributed significantly to our dilemma.
These developments are approximately four to five miles from our
nearest school. Two of our schools are already substandard in
acreage, therefore, it is not feasible to place portables on these
sites. Another factor that the school district must take into con-
sideration is the cost of transporting these children.
The Encinitas Union School District has a ten-acre site in the La
Costa area. Our immediate future plan is to place interim modular-
type buildings that conform as closely as possible architecturally
with the community. These buildings could be moved to other sites.
Our future student population projections will be in the east and
northeast portion of our district.
We have placed four of our six schools on a year-round schedule and
we are nearing our capacity on this schedule. Our long range plans
are to lease/purchase the modular portable buildings in an attempt to
return, if at all possible, to a traditional schedule since the
majority of the community would prefer a traditional schedule accord-
int to our last survey.
EXCELLENCE IS OUR GOAL
The Encinitas Union School District established a base fee of $400.00
per bedroom in 1979. The base has remained the same using the ENR
(Engineering News Record Index) of 6.62% for 1980-81, 400 X 6.62% =
$426.00.00 per bedroom. The same ENR index is being used for 1981-82,
$426.00 X 9.33% = $465.00. The Encinitas Union School District devel-
opers fees' will be $465.00 per bedroom beginning 8/1/81 to 7/31/82.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING RESOLUTION 5999
REVISING THE AMOUNT OF FEES TO BE REQUIRED AS A
CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOP-
MENT WITHIN CERTAIN AREAS OF THE ENCINITAS UNION
WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the
lalifornia Government Code, the City Council of the City of Carls-
Dad, California has adopted a School Facilities Dedication and
Fee Ordinance (Carlsbad Municipal Code Chapter 21.55); and
WHEREAS, Section 21.55.150 of the Carlsbad Municipal Code
provides that the standards for the amount of fees to be required
pursuant to such ordinance shall be determined by the City Council
and set by resolution. The City Council's determination is to be
nade after consideration of recommendations from the governing
board of the affected school district; and
WHEREAS, the City Council established standards for the amount
of fees to be required pursuant to Chapter 21.55 in Resolution
No. 5999; and
WHEREAS, the City Council is in receipt of recommendations
in regards to revised amount of fees from the Encinitas Union
School District. Their recommendation is attached hereto as
xhibit A, and is made a part hereof; and
WHEREAS, the City Council fully considered the matter at the
regular meeting of August 18, 1981 at which the City Council
determined to concur in the revised standards as recommended by
|bhe Board of the Encinitas Union School District.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows: '
A. That the above recitations are true and correct.
B. That the standard for the amount of fees to be required
as a condition of approval for residential developments within
that portion of the City of Carlsbad, which is also within the
boundaries of the Encinitas Union School District, shall be as
contained in Exhibit A.
C. This determination is based upon the City Council's
concurrence in the recommendations made by the Governing Board of
the Encinitas Union School District, including the facts support-
ing such recommendations as contained in Exhibit A.
D. Unless the decision-making body especially determines to
the contrary, the City Council hereby determines that the following
findings and requirements shall apply to any residential develop-
ment of fifty units or less:
1. All such developments shall be required to pay fees
in accordance with the schedule in Exhibit A.

2. The City Council has reviewed that portion of the
General Plan which applies to the Encinitas Union
School District and finds that it provides for the
location of public schools.
3. That the fees to be paid shall be used for the
purpose of providing interim school facilities.
4. That the fees to be paid for each unit bear a reasonable
relationship to the burdens placed on the School
District by such unit and that the fees will be used
to mitigate that burden.
5. That the school facilities to be funded by the fees
are consistent with the City's General Plan.

E. The standards adopted by this resolution do not at this

time require the dedication of land. The Encinitas Union School

District is developing standards regarding such dedications.
When the District is prepared to make their recommendation in that
regard, the City Council intends to amend this resolution to
include provisions for requiring the dedication of land as they
determine to be in the public interests.
F. Effective Date The fee schedule approved by this
Resolution shall become effective on October 1, 1981.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
18th day of August , 1981 by the following vote,
to wit:

RESOLUTION RE CONDITIONS OF OVERCROWDING
IN SCHOOL ATTENDANCE AREAS
On motion of Member _ Nortman _ , seconded by Member
_ Mac, In tyre _ t^e following resolution is adopted:
WHEREAS, for some time past there has been a continuing and substantial
increase in population within the boundaries of the Encinitas Union School
District to the extent that the school facilities of this district have become
overcrowded; and
WHEREAS, in the absence of assistance in the form of financial contributions
or dedications of land from the developers of such new residential developments
this district would not have financial resources adequate to provide proper ed-
ucational facilities for all the children residing in this district; and
WHEREAS, Chapter 4.7 (commencing with Section 65970; added by Stats. 1977,
Chap. 955), Division 1, Title 7 to the Government Code making provisions for
financial or other assistance by developers to school districts if the governing
board of a school district has made a finding that conditions of overcrowding
exist in one or more attendance areas of the district including the specific data
specified in Government Code Section 65971; NOW THEREFORE
IT IS RESOLVED AND DETERMINED that, pursuant to Government Code Section 65971,
this governing board makes the following findings;
(1) Conditions of overcrowding exist in the following attendance areas of
the Encinitas Union School District which will impair the normal functioning of
educational programs in those areas:
Year-round /traditional schools: Capri, Flora Vista, Ocean Knoll,
Park Dale Lane. Pacific View - year
round at parental request

(2) Reasons for the conditions of overcrowding in the above-mentioned
attendance areas include the following:
a. An influx of large single and multiple family dwellings by large
developers.
b. Letters of availability issued to developers represent a potential
1740 students through 1990.
Under policy 1-43 we are not meeting the adequate needs of the community
according to the recent survey.
(3) All reasonable methods of mitigating conditions of overcrowding have
been evaluated and no feasible method for reducing such conditions exits. Miti-
gation measures considered by the governing board of this district to reduce
the overcrowded conditions include the following:
a. Year-round school adopted in four of six schools for overcrowding as per
District Policy 6159 requiring return to traditional track when facilities are
available.
b. Increased class size beyond Board practices from 27:1 to 32:1 teacher
contract maximum.
c. Passage of a lease/purchase bond was accomplished prior to Proposition
13.
d. Portable classrooms through lease/purchase - we have added two additional
units.
e. District maintains open intra-district boundaries to equally distribute
student population.
(4) The conditions of overcrowding in this District and the explosive
population growth projected for this area can only be accommodated by the new
schools for the long-term; placement of temporary use buildings/relocatable
structures and busing of students are stop-gap measures for the near-term only, and
in and of themselves do not significantly reduce the conditions of overcrowding.

Support by developers in the form of financial contributions or dedications
of land is necessary in order to try to keep abreast of population growth,
and even with such assistance, any significant reduction in the conditions
of overcrowding will not occur until additional classroom buildings can be
constructed.
BE IT FURTHER RESOLVED AND ORDERED that the Secretary of this Board deliver
certified copies of this resolution to the city councils and/or Board of Super-
visors of all cities and County within those boundaries the school district lies,
together with copies of this District's policy on the subject of developers',
subdividers', and builders' contributions to mitigate impact on school facilities,
to indicate the type and scale of assistance considered appropriate to meet the
needs of this District.
PASSED AND ADOPTED by the Board of Trustees of the Encinitas Union School
District of San Diego County, California, this 21st day of July, 1981.

Resolution Setting Developers' Fees
BACKGROUND: The County Board of Supervisors requires each school district
to submit a fee schedule for collection of fees and a justification for
the amount of the fees to all cities within the District boundaries.
RECOMMENDATION: The Superintendent recommends the following:
RESOLUTION: Be it resolved that the Board of Trustees of the Encinitas
Union School District does hereby continue the base fee of $426.00 per
bedroom and apply the Engineering News Record Construction Index of 9.33%,
therefore, setting the fees collected under 1-43 policy and S.B. 201 in
the amount of $465.00 per bedroom from August 1, 1981 to July 31, 1982.

The Encinitas Union School District fees were set at $400.00 per bedroom for
1979-80.
In 1980-81 the ENR (Engineering News Record Index) was used $400 X 6.62% =
$426.00 per bedroom
For 1981-82 the ENR (Engineering News Record Index) is still being used
$426 X 9.33% = $465.00 per bedroom.
The Encinitas Union School District developer fees' will be $465.00 per
bedroom beginning 8/1/81 to 7/31/82.
This index is the same one being used by other districts in the San Dieguito

Re: School Fees
We have over 500 active permit applications being processed in
the Building department. Many of these will become permits in
the next 45 clays. Our budget wi 11 not provide staff to re-
calculate all these permits, so we are notifying the applicants
of the coming fee increase which gives them a chance to avoid
the increase and reduces the city workload by decreasing th
number of permits to be rewritten. Those that are not issued
in the next 45 days will be rewritten, and the city will absorb
t h e c o s t.
We see, also, that our citizens are experiencing "fee" changes
in every phase of their lives and are increasing their resistance
to these changes. We intensify that resistance when increases
are ma d e without adequate notice.
This waiting period before increased school fees are collected is
thoughtful of the rights of the citizen and reasonable for the
city of Carlsbad and the school districts involved.
