G 7 / 9 DATE: August 18, 198i DEPARTMENT:' ENGINEERING SUBJECT: TRAFFIC ENGINEERING SERVICES STATEMENT OF THE MATTER RAB/cle 69 Initial: Dept. Head C. Atty C. Mgr-g--.-,-„ The City, for the last several years, has provided its traffic engineering services by means of a consultant contract. The firm of Berryman & Stephenson provided those ser- vices during FY 80-81 for the rate of $32 per hour. In an effort to provide traffic engineering consulting services after expiration of the Berryman & Stephenson contract, the City Engineer received new proposals from Berryman & Stephenson and from SANDAG. The Berryman & Stephenson proposal was for $40 per hour and the SANDAG proposal was for $15 per hour for the balance of the fiscal year with a new figure to be negotiated for 8T-82. The Berryman & Stephenson service rate was a reason- able rate for a consulting firm. The SANDAG rate was so low because they had a personal services contract with an individual. ,Their rate, therefore, did not include a consulting firm's overhead expense or corporate profit. Since the Berryman & Stephenson contract had expirer the City, by purchase order, arranged for the use of the SANDAG consultant. Berryman & Stephenson complained to SANDAG claiming unfair competition but, since the action was neither illegal or unethical and since it is SANDAG's policy tc provide such services to smaller cities, no action was pursued. SANDAG has negotiated a new service contract with its traffic engineering consultant. They have quoted a price to the City of $19 per hour, which includes its consultant's hourly rate plus 151Z for SANDAG's overhead. FISCAL IMPACT Revised SANDAG contract would cost approximately $12,000 per year. This is a savings Of approximately $13,000 per year of a similar service level provided by a consulting firm. Funds are available in Account No. 1-127-2450, Engineering Professional Services. ENVIRONMENTAL IMPACT Services contracts are categorically exempt. RECOMMENDATION That Council adopt Resolution No. approving agreement between the City and SANDAG for traffic engineering services. EXHIBITS 1. SANDAG's letter of June 18, 1981. 2. WHEREAS, the City of Carlsbad (City) requires the services of a part-time traffic engineer; and WHEREAS, the San Diego Association of Governments (SANDAG) has offered to supply such services, the parties hereunto agree as follows: SANDAG shall supply the services of traffic engineer accep- table to the City on the basis of 12 hours a week at a not - to -exceed cost of $19 per hour. Such traffic engineer shall be under the direction of the City Engineer and shall prepare staff reports, supply traffic engineering expertise and review of traffic engineering related problems, observe and report on traffic problems and complaints, and work in close coordination with City staff to provide specialized traffic advice. The traffic engineer shall be in the total employ of SANDAG and the City shall not bear overhead or liability for his employ- ment status. The City shall maintain a record of the traffic engineer's work and report monthly to SANDAG on number of hours worked. The specific hours of work shall be set by the City Engineer in consultation with SANDAG and the traffic engineer to allow flexibility in meeting the mutual commitments of the in- volved agencies. City agrees to indemnify and hold harmless SANDAG, its officers, agents, and employees against any and all claims, ,demands, damages, expenses, actions, liabilities or losses which may arise from, or be incurred as a result of, injury or damage to persons or property in connection with the performance of traffic engineer under this agreement, provided, however, that City's obligation under this paragraph shall be limited to the extent that SANDAG is required by the employment agreement between SANDAG and traffic engineer to indemnify and hold harm- less traffic engineer. The City shall compensate SANDAG for services performed upon billing by SANDAG. This agreement may be terminated by either party giving written 30-day notice. This agreement shall become effective upon July 30, 1981, and supersede any prior informal arrangement. IN WITNESS WHEREOF, we have hereunto set our hands and seals.
