SUBJECT:AN APPEAL OF A CONDITIONAL USE PERMIT TO PROVIDE A PAVED PARKING
FACILITY LOCATED ON LACUNA DRIVE AND STRATFORD LfiNE.

STATEMENT OF THE MATTER:
This item is an appeal of Planning Commission decision to deny a proposed park-
ing facility for City Hall, located as described above. As part of this appli-
cation, the Planning Commission approved a request to construct temporary modu-
lar office structures to be located in the rear Carlsbad Civic Center parking
lot. The Commission denied the request for the temporary parking lot because
they felt such a parking facility would have an adverse impact on the surround-
ing single family residences. Also, the Commission believed there were not
sufficient guarantees provided ensuring that the parking lot would be a tempor-
ary facility and eventually removed.
During the public hearing, staff indicated they wished to change the parking lot
configuration to add additional property and to exclude the property fronting on
Stratford Lane, as shown on Exhibit "C". The reason for the change was that the
additional property was currently in escrow and that the parking lot would have
less impacts since it would not front on Stratford Lane. The city now owns the
property and the request before the Council includes this additional property.
Also, a parcel map has been applied for to create single family lots which would
be sold for single family purposes when permanent facilities are constructed.
This parcel split is shown on Exhibit "D".
At the public hearing, a number of surrounding residents expressed opposition to
the parking lot. Their main concerns were the potential reduction in property
values, visual impacts, adverse impacts created by lighting of the parking lot,
and the late night use of the lot by the Police Department.
Staff believes that the parking lot could be adequately buffered and uses regu-
lated so that there would be minimal adverse impacts on surrounding properties.
Also, the amount of city property available to provide a parking facility to
serve the Police Station is extremely limited, and logistically, this site seems
to be the most feasible.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any signi-
ficant environmental impacts and, therefore, has issued a Negative Declaration,
dated May 8, 1981, which was approved by the Planning Commission on July 22,
1981. A copy of the environmental documents is on file in the Planning Depart-
ment.
COUNCIL ACTION:
8-18-81 Council directed the City Attorney to prepare documents granting the appeal.
FISCAL IMPACTS
No fiscal impacts are anticipated by this project.
RECOMMENDATION
It is recomnended that the City Council APPROVE the appeal of CUP-198, APPROVING
a temporary parking facility and that the City Attorney be directed to prepare
documents APPROVING the project as authorized by the City Council.

8 of Carlsbad and referred to the Planning Commission; and
9 WHEREAS, said verified application constitutes a request as

Laguna Street, based on the following findings and subject to
the following conditions:
Findings;
1) That approval of the Conditional use Permit for the modular
offices will not be detrimental to surrounding uses or to
and other features necessary to adjust the modular office use
to existing or permitted future uses in the neighborhood will

5) That the request to construct a paved parking lot on the
north side of Laguna would be detrimental to surrounding
residential uses located on Stratford Lane. Also, the
proposed parking lot is not desirable to the development of
the community and is not in harmony with the various elements
and objectives of the General Plan for the following rea-
sons:
a. As presently proposed, that a parking lot facility is not
compatible with a single family residential area.
19 b. As presently proposed, cars using the facility would
create noise impacts on surrounding residential proper-
ties located on Stratford Lane
c. As presently proposed, it appears that the parking lot
will be a permanent facility. The Planning Commission is
not satisfied that the parking lot would in fact be
temporary and that additional, permanent parking
facilities will be constructed at a different location in
the near future.24

27 1) Approval is granted for CUP-198, for the proposed modular
office uses only, as shown on Exhibit "A" dated, June 2,
1981, incorporated by reference and on file in the Planning
Department. Development shall occur substantially as shown
unless otherwise noted in these conditions.

2) Approval of this request shall not excuse compliance with
all sections of the Zoning Ordinance and all other
applicable city ordinances in effect at the time of building
permit issuance.
3} This Conditional Use Permit shall expire five years from the
date of this resolution or when permanent facilities are
completed, whichever occurs first, unless an extension is
granted by the Planning Commission.
4) A final site plan for the modular structures, including
placement, orientation and architectural treatment of
buildings as well as retention of any parking spaces, shall
be submitted to and approved by the Planning Director prior
to building permit 'issuance.
5) The applicant shall prepare a detailed landscape and
irrigation plan for the project, which shall be submitted
to and approved by the Planning Director prior to the
issuance of grading or building permits.

I BACKGROUND AND PROJECT DESCRIPTION
This item was previously considered and approved by the Planning
Commission at its meeting of June 10, 1981. However, staff inad-
vertently failed to notify the surrounding property owners of the
public' hearing on June 10, 1981, thereby necessitating the re-
scheduling of the item at this time.
The proposed project involves two separate permits: first, the
construction of temporary modular office structures totaling
approximately 3,538 square feet to be located to the rear of the
Carlsbad Civic Center in the area that is presently utilized as a
parking lot for police vehicles, immediately east of the Police
Lepartment offices. The office structures will constitute a tem-
porary relocation of two city departments and will be designed
and landscaped to aesthetically compliment the present permanent
facilities.
The Civic Center is located in an R-P-Q zone and, as such, the
proposed use is permitted in conjunction with the issuance of a
conditional use permit or site development plan.

a .77 acre thrulot to accommodate approximately 70
Access to the parking lot will be from Laguna Drive
only and the applicant will relinquish rights of. access to Strat-
ford Lane. The property is zoned R-l-7500 and is used primarily
for agricultural purposes with a smal1, single-family house loca-
ted in the north-west corner of the lot.
The proposed temporary facility is allowed, contingent upon the
issuance of a conditional use permit under Section 21.42.010 (J)
which provides for "accessory public and quasi-public utility
buildings and facilities" in all zones including residential.
II. ANALYSIS
Planning Issues
1) Do the proposed uses meet the required findings for a
Conditional Use Permit?
Pi scussion
The proposed site for the temporary office structures is the most
centrally-located yet inconspicuous area of the Civic Center.
.Additionally, there is sufficient room in this area to accommo-
date the planned buildings. The necessity for the structures is
brought about by the increased growth rate of development in the
city which is accompanied by the need for an expanded City Hall.
The City Council has been considering alternatives for a perma-
nent expansion of City Hall or a new location for the Ci-vic
Center but nothing firm has been decided yet, thus necessitating
the need for temporary facilities.
The usual impact of the buildings will be minimized by color and
design treatment as well as landscaping. The structures will be
compatible with the existing City Hall buildings.
The decrease in the present number of parking spaces will be more
than off-set by the additional temporary parking lot across the
street from this site.
The proposed site for the temporary paved parking lot is a rec-
tangular thru-lot, as shown on exhibit "B", and will only take
access from Laguna Drive to minimize the effect of numerous vehi-
cles upon the residential neighborhood of Stratford Lane. Addi-
tionally, along the side-lot lines, a 6-foot view-obscuring fence
will be installed, with all parking lot lights directed away from
any adjacent properties to minimize any impacts upon the sur-
rounding neighborhood. As the project is temporary in nature,
the setbacks may be reduced in this case. Staff feels, however,
that a minimum five-foot landscaped setback on all sides is de-
sirable and has conditioned.the permit to accomplish this. Any
other areas on the property that are not actual parking spaces,
iiicl -j. di ng the Laguna Drive and Stratford Lane setbacks, are to be
heavily landscaped.
Staff has found that the requested temporary uses are necessary
and desirable for the development of the community, are essen-
tially in harmony with the various elements of the General Plan,
and, as conditioned, are not detrimental to existing or future
uses in the zone. Further, the sites are adequate in size and
shape to accommodate the proposed uses, all of the yards, set-
backs, walls, fences, landscaping, and other features necessary
to adjust the requested use to surrounding uses will be provided
and maintained, and the traffic system serving the proposed uses
is adequate to properly handle all forseeable traffic generated.

III. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not have a
significant impact on the environment and therefore has issued a Nega-
tive Declaration on May 8, 1981.

IV. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the Negative
Declaration issued by the Planning Director and a'dopt Resolution No.
1814, APPROVING CUP-198, based on the findings and subject to the con-
ditions contained therein.

Reference is made to your hearing scheduled for August 18,
1981 to consider the application for a Parking Lot on property
located on the north side of Laguna Street west of Slmwood
Street and east of Pio Pico Drive.
I own the property at the corner of Laguna and Elmwood (2955
iHlmwood) and I am in favor of the City locating the Parking
Lot on Laguna.
It is noted the City's intention is to obtain a Conditional
Use Permit to locate the Parking Lot on Laguna which means
five years from now this matter will have to be considered
again.
Considering the continued success of Carlsbad under your
leadership I would like to recommend at this time that you
consider ammending the General Plan and change the land use
designation on Laguna to permit use of property on this street
for purposes other than the current Low Medium Density designation,
