CASE NO: CT 80-22(A)/CP-l01(A) APPLICANT: LATITUDE 33 STATEMENT OF THE NATI'ER: This item is a request for approval of an amendment to a previously approved tentative tract map and condominium permit by the addition of one unit. Approval of the amendment muld result in a density of 23 dwelling units per acre, which is in conformance with the general plan designation of 20-30 dwelling units per acre designated for this site. As amended, the Planning Conmission felt that this project meets all development standards and design criteria of the Condominium Ordinance. Comission believes that the proposed density of 23 dwelling units per acre is justified based on the project's design and amenities. Also, the Through staff review and Planning Conmission hearing, all issues on this matter have been satisfactorily resolved. The Planning Director has determined that this project will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated July 14, 1981, which was approved by the Planning Carrsnission on August 12, 1981. Planning Department. A copy of the environmental documents is on file in the FISCAL IMPACT The applicant will provide all required public improvements to the project. Also, the applicant has agreed to pay a public facilities fee to offset the oosts of providing all other public services. RECOMMENDATION Both the Planning Staff and Planning Comission recomnend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING CT 80-22(A)/CP-lOl(A), per Planning Connnission Resolution No. 1848. The project is consistent with all city public facility POI- icies and ordinance6 since: 0 The Planning Commission has, by inclusion of an appro- priate condition to this project, insured that the final map will not be approved unless the: City Council finds that sewer service is available ta serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that build- ing permits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the General Plan have been met insofar as they apply to sewer service for this project, School facilities will be available to this praject as indicated by the Carlsbad Unified Schaal District per letter dated June 19, 1981, Park-in-lieu fees are required as a condition of approval. All necessary public improvements have been provided or will be required as conditions of approval, The applicant has agreed and is required by the frrclusian of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for residential development on the General Plan. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on July 14, 1981 and approved by the Planning Commission on August 12, 1981. Approval is granted for CT 80-22(A)/CP-l01(A), as shown on Exhibit(s) "A -J", dated June 25, t981, incorporated by refer- ence and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that: the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is avail- able to serve the subdivision, This project is approved upon the express condition that: building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. This project is approved upon the express condition that: the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29 , 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant far pay- ment of said fee a copy of that agreement dated April 17, 1980, is on file with the City C1.erk and incorporated herein by reference. If said fee is not paid as promised, this ap- plication will not be consistent with the General. Location 14) All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the - sound. buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Direc- tor. 15) AI1 units shall provide space for laundry facilities to acco- modate a washer and dryer. 16) Prior to occupancy of any units, the visitor parking spaces shall be signed and labeled to the satisfaction of the Plan- ning Director. Engineering Conditions 17) The developer shall obtain a grading permit prior to the com- mencement of any clearing or grading of the site. 18) The grading for this project is deEined as "regular grading" by Section 11.06,170(a) of the Carlsbad Municipal Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any re- quired erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11-06 of the Carlsbad Municipal Code. 19) Lincoln Street shall be fully improved along the frontage of this project prior to occupancy of any units subject to Engineering standards and City Engineer approval, 20) The sump pump shall be designed and located to the satisfac- tion of the City Engineer. 21) Additional off-site drainage improvements shall be required if found necessary by the City Engineer to mitigate drainage impacts caused by this project on Walnut Avenue or adjacent property. STAFF REPORT August 12, 1981 Planning Commission P1 anning Department CT 80-22(A)/CP-I01(A) - LATITUDE 33 Request for an amendment to a previously approved tentative tract map and condominium permit by the addition of one unit (eight total) on property located on the east side of Lincoln Street between Pine Avenue and Walnut Avenue in the R-3 zone. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting approval of an amendment to a pre- viously approved tentative tract map and condominium permit by the addition of one unit. Approval of the amendment would result in an eight-unit condominium project on a -35 acre parcel, lo- cated as described above. This project would result in a density of 23 dwelling units per acre, which is in conformance with the General Plan Designation of 20-30 dwelling units per acre for this site. The project will consist of three residential build- ings which would be connected by breezeways and third floor bal- conies . The site of this project is level and occupied by an older single family dwelling. Several newer multiple family dwellings have been constructed in the vicinity of the proposed project. 11. ANALYSIS Planning Issues 1) Does the proposed condominium project conform with the development standards of the condominium ordinance? 2) Does the proposed condominium project conform with the design criteria of the condominium ordinance? 111. DISCUSSION Development Standards The applicant proposes to provide two parking spaces per unit within an enclosed garage. Most of the parking located underneath the units which thev serve. of the project, the parking for unit 2i will be spaces will be Due to the design located under units 1 and 4. Parking for units 3 and 7 will be in a garage loca- ted at the rear of the project. Although it would be more prefer- able to locate these garages underneath the units they serve, the giirages will be within 120 feet of the units and, therefore, staff is satisfied that they are adequately accessible to the units. Two guest parking spaces would be located on site and two additional guest parking spaces would be available on Lincoln Street. A spa and barbeque area would be 1ocated.to the rear of the pro- perty. Each of the units would have at least one balcony ranging in size from 72 square feet to 117 square feet. With both the bal- conies and the common recreational facilities, each unit would have the 200 square feet of recreation area required by the condominium ordinance. Storage would be provided by closets located in the garages. Additional storage would be provided by storage lockers located adjacent to the recreation area. DESIGN CRITERIA This project meets all of the requirements of the design criteria of the condominium ordinance. The driveways would provide adequate access to the units and the parking areas would not dominate the project. The open space and recreational areas are readily access- ible to each of the dwelling units. Pedestrian access has been , designed to allow safe convenient access between the units, recrea- tion area and garage. This project is surrounded by older duplexes and single family hones at the present time, however, a number of newer multiple family dwellings are located within a block of this project. Therefore, the project would be compatible with the existing and future development in this area. All other design criteria have been met by this project.. Overall, staff believes the project, with the addition of one unit, meets a11 requirements of the condominium ordinance and, therefore, staff can support a recommendation of approval. IV. ENVIRONMENTAL REVIEW . The Planning Director has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration dated July 14, 1981. V.
