Statement of the Matter
The City Council, at your August 18, 1981 meeting, directed the
City Attorney to prepare documents granting an appeal of a
Planning decision to deny a conditional use permit for a parking
lot located between Laguna Drive and Stratford Lane. A
resolution granting the appeal and approving the conditional use
permit for the parking lot is attached. The resolution includes
recommended findings and conditions of approval as prepared by
the Planning Department. The City Council should satisfy itself
that the conditions of approval accurately reflect your
intentions in the matter.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, GRANTING AN APPEAL OF
A PLANNING COMMISSION DECISION AND APPROVING A
CONDITIONAL USE PERMIT (CUP-198) FOR
CONSTRUCTION OF A PAVED PARKING LOT ON
PROPERTY GENERALLY LOCATED ON A THRU-LOT BETWEEN
LACUNA DRIVE AND STRATFORD LANE IMMEDIATELY TO
TO THE NORTH OF THE CARLSBAD CIVIC CENTER.
APPLICANT: CITY OF CARLSBAD
WHEREAS, the Planning Commission of the City of Carlsbad
did on July 22, 1981 hold a duly noticed public hearing to
consider the application of the City of Carlsbad for a
Conditional Use Permit (CUP-198) to allow construction of a paved
parking lot on property generally located on a thru-lot between
Laguna Drive and Stratford Lane immediately to the north of the
Carlsbad Civic Center, more particularly described as:
All that portion of the Northwest one quarter Section 6,
Township 12 South,. Range 4 West, San Bernardino Meridian, in
the City of Carlsbad, County of San Diego, State of Califor-
nia, also known as assessor's parcel number 156-164- 23 and
parcels 1 and 2 of Parcel Map No-. 3975 filed July 28, 1975 as
File No. 75-195933, being a division of a portion of the
Northwest Quarter of Section 6, Township 12 South, Range 4
West, San Bernardino Meridian, in the City of Carlsbad,
County of San Diego, State of California, according to the
official plat thereof;
and
WHEREAS, the Planning Director has determined that this
project will not cause any significant environmental impacts and,
therefore, has issued a Negative Declaration, dated May 8, 1981,
which was approved by the Planning Commission on July 22, 1981;
and
WHEREAS, at the conclusion of said hearing, the
Planning Commission, after making certain findings, recommended
denial of CUP-198; and

WHEREAS, a duly noticed public hearing was held by the
City Council on August 18, 1981 to consider the matter at which
time all persons interested in or opposed to the proposed
Conditional Use Permit were heard and the decision of the
Planning Commission considered.
WHEREAS, the City Council, after considering all
relevant factors in this matter, makes the following findings:
1) That, as conditioned, all of the yards, setbacks, walls,
fences, landscaping and other features necessary to adjust
the requested uses to existing or permitted future uses in
the neighborhood will be provided and maintained and, there-
fore, the Conditional Use Permit will not be detrimental to
surrounding areas. Specifically, walls will be provided
along all interior property lines, a .heavily landscaped set-
back will be provided on Stratford Lane, all lighting will be
directed away from adjoining property and substantial land-
scaping will be provided in the parking area.
2) That the street system serving the proposed uses is adequate
to properly handle all traffic generated by the proposed use
since all access will be taken from Laguna Drive.
3) That the site for the intended uses is adequate in size and
shape to accommodate these uses.
4) That this Conditional Use Permit will allow temporary use of
the properties until permanent expansion of City Hall is com-
pleted.
5) That the proposed uses are desirable to the development of
the community and in harmony with the various elements and
objectives of the General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
A. That the above recitations are true and correct.
B. That the appeal by the City of Carlsbad, of the
Planning Commission's decision to deny the CUP-198, is hereby
granted.

C. That the Conditional Use Permit is granted for the
reasons set out in this resolution.
D. That the City Council hereby approves the
Conditional Use -Permit (CUP-198) for the construction of the
paved parking lot on the above-described property subject to the
satisfaction of the following conditions of approval:
1) Approval is granted for CUP-198, as shown on Exhibit A, dated
6/2/81, and Exhibit B, dated 8/18/81, incorporated by
reference and on file in the Planning Department.
Development shall occur substantially as shown unless
otherwise noted in these conditions.

This Conditional Use Permit shall expire five years from the
date of this resolution or when permanent facilities are
completed, whichever occurs first, unless an extension is
granted by the City Council.
A final site plan for the modular structures, including
placement, orientation and architectural treatment of
buildings as well as retention of any parking spaces, shall
be submitted to and approved by the Planning Director prior
to building permit issuance.
The applicant shall prepare a detailed landscape and irriga-
tion plan for both projects, which shall be submitted to and
approved by the City Council prior to the issuance of
grading or building permits.
All lighting for the parking lot shall be directed away from
adjacent properties.
A six-foot high, view-obscuring wall shall be erected along
all interior property lines of the parking lot to the
satisfaction of the Planning Director.
Applicant shall provide and maintain a minimum five foot
landscaped setback adjacent to all interior property lines of
the parking lot.
The applicant shall grant an easement for road purposes along
the southerly ten feet of the property which shall be land-
scaped.
Minimum inside turn radii in the parking lot travel lane
shall be 15 feet.

10) The parking area shall observe a heavily landscaped setback
from Stratford Lane equivalent to the existing front setback
of the residence on the adjacent property to the west. A
view-obscuring wall or fence shall be erected at this setback
line.
11) All curbed islands within the parking lot shall be land-
scaped .
12) Police cars using the lot shall be located in the portion of
the parking lot adjacent to Laguna Drive.
13) Testing of lights and sirens in the lot or immediately
adjacent thereto shall not be allowed.
14) There shall be no access to or from Stratford Lane to or
from the parking lot.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California, on the
