Finance Director to refund $4,266.83 to Lake ca:avera Hi I ls Associates
ITEM EXPLANATION:
The City Council, on December 18, 1979, adopted Resolution No. 6000 approving
an agreement for construction and financing of the Lake Calavera Hills Sewage
Treatment and Wastewater Reclamation Facility. Section 2A of that agreement
provided that thP. developer bear all costs including professional services.
Section 40 of the ~greement provided that the City cooperate and assist in
obtaining necessary regulatory agency approvals and permits.
Because of the complexity of the process to obtain authorization and to
constri1ct and operate the wastewater treatment and reclamation faci I ity, the
Developer and City Staff agreed to retain a consultant to assist and advise
the City. Accordingly, L~ke Calavera Hills Associates deposited $10,000 with
the City to offset the costs of consulting services.
The Consultant contract is n~w complete and $5733,17 has been expended. Lake
Calavera Hills Associates have requested that the remaining $4266.83 be
refunded.
FISCAL IMPACT
City lrust Funds will be ;educed by $4266.83.
