Introduce Ordinance No. 704 /Amending Chapter 13.10.020(c) (7) of the Carlsbad
Municipal Code.
ITEM EXPLANATION:
Section 13.10.020 of the City Municipal Code has a procedure for determining
EDU requirements. The Code calls for 2.67 EDUs for restaurants with no seating
and an additional EDU for each 7 seats or fraction.
A recent study of the average water usage of some of Carlsbad's restaurants
revealed that the "fast food'' restaurants in the City (Jack-in-the-Box, Carl Is
Jr., Kentucky Fried Chicken and Baker's Tacos) have all had similar water usages,
which are considerably lower on a per seat basis than "dinner house'' type
restaurants such as Dooley McCluskey's and Reubens. This is due to the use of
disposable plates and utensils.
For "fast food" and delicatessen restaurants, a connection fee based on fewer
EDUs seems more equitable. It is proposed that the 2.67 EDU base be retained,
but one EDU be requiredfor each 21 seats or fraction.
FISCAL IMPACT
While the revised Code would result in lower capacity fees (less EDUS) and
lower monthly service charges (per Resolution 5957, charges are based on EDUS),
overcharging would be el iminated.

SUBJECT: SEWER CONNECTION FEES - RESTAURANTS
The Engineering Department has recieved numerous complaints from fast food
restaurants (such as Carls) that they are being overcharged for sewer connect ion
fees. Section 13.10.020 of the Carlsbad Municipal Code establishes dwelling
unit equivalents (EDUS for restaurants at 2.67 EDUs plus one EDU for each seven
seats. The Engineering Department reviewed the water usage in restaurants and
found that the fast food establishments use relatively less water/sewer than
regular dinner houses.
Based on research of actual water use, we recommend that fast food restaurants
and delicatessens be assigned equivalent dwelling units using a different formula
than other restaurants. The proposed dwelling unit equivalencies for delis and
fast food restaurants would be reduced to 1 EDU for each 21 seats (instead of the
current 7 seats).

The City Council of the City of Carlsbad, California does ordain
as follows:
SECTION 1: That Title 13, Chapter 13.10, Section 13.10.020 of the
Carlsbad Municipal Code is amended by the amendment of Subsection (c) (7) to
read as follows:

BE IT RESOLVED by the City Council af the City of Carlsbad as follows:
1. This resolution sets sewer service charges for all persons whose
premises in the City are served by a connection wSu1 the City sewer system
whereby sewage or other waste material is disposed of through such systemt
effective from December 1, ,1979, shall pay a sewer service charge per equiua-
lent dwelling unit as follows:

facilities surcharge to the sewer service fee;

2. That the monthly sewer service charge will consist of a
service charge and a capital facilities surcharge which shall be
applicable to all premises in the City hooked up to Encina Water
Pollution Control Facility.
3. That the capital facilities surcharge will be effective
beginning September 15, 1980, 2s shown on Exhihit "A" attached
hereto and incorporated herein by reference,
4. That the monthly capital facilities surcharge will be
placed in the Sewer Construction Fund and shall be used to pay for
the capital improvements of said system.
