SUBJECT: 6 LOT TENTATIVE TRACT MAP; EAST SIDE OF PARK DRIVE BETWEEN CALAVO DRIVE AND HILLSIDE DRIVE IN THE R-1-10,000 ZONE CASE NO. 81-23 APPLICANT: A & W VENTURES, INC. STATEMENT OF THE MATTER: This item is a request for approval of a six lot tentative tract map on 2.5 acres located as described above. The lots would vary in size from 11,640 to 18,200 square feet and one of these would be a panhandle lot. The Planning Commission found that the proposed subdivision meets all requirements of the subdivision and zoning ordinances, and therefore, recommends approval of this item. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated August 13, 1981, which was approved by the Planning Commission on August 26, 1981. A copy of the environmental documents is on file in the Planning Department. FISCAL IMPACTS This project, as conditioned, will provide all necessary public improvements. Also, the developer has agreed to pay a public facilities fee to offset the cost of providing all other necessary public services. RECOMMENDATION Both the Planning Staff and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING CT 81-23, per Planning Commission Resolution No. 1852. AND HILLSIDE DRIVE IN THE R-1-10,000 ZONE. APPLICANT: A & W VENTURES, INC. CASE NO: CT 81-23 WHEREAS, a verified application for certain property, to wit: Parcels 2 and 3 shown at page 6328 of Parcel Maps, filed September 6, 1977 and a portion of Lot "I" of Rancho Agua Hedionda according to Map No. 823 filed November 16, 1896. has been filed with the city of Carlsbad, and referred to the Plan ning Commission; and WHEREAS, said verified application.constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 26th day of August, 1981, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Tent ative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis- sion as follows: A) That the above recitations are true and correct. The project is consistent with all city public facility poli- cies and ordinances since: a) The Planning Commission has, by inclusion of an appropri- ate condition to this project, insured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addi- tion, the Planning Commission has ad(5ed a condition that a note shall be placed on the final map that building per- mits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer ser- vice remains available, the Planning Commission is satis- fied that the requirements of the public facilities ele- ment of the General Plan have been met insofar as they apply to sewer service for this project. b) School facilities will be available to this project as indicated by the Carlsbad Unified School District per letter dated August 12, 1981. c) Park-in-lieu. fees are required as a condition of approval . d) All necessary public improvements have been provided or will be required as conditions of approval. e) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the The proposed subdivision is compatible with surrounding and future land uses since it is being developed- as residential property and the surrounding properties have been or will be developed for residential purposes. This project as conditioned will not cause any significant environmental impacts and a Conditional Negative Declaration has been issued by the Planning Director on August 13, 1981, and approved by the Planning Commission on August 26, 1981. PC RESO 1852 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Conditions of Approval General Conditions; 1) Approval is granted for CT 81-23, as shown on Exhibit "A", dated July 29, 1981, incorporated by reference and on file in the Planning Department. Development shall occur substanti- ally as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is avail- able to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. 4) This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for pay- ment of said fee a copy of that agreement dated June 8, 1981, is on file with 'the City Clerk and incorporated herein by re- ference. If said fee is not paid as promised, this applica- tion will not be consistent with the General Plan and approval for this project shall be void". 5) The applicant shall pay park-in-lieu fees to the city, prior to the approval of the final map as required by Chapter 20.44 of the Carlsbad Municipal Code. 6) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issuance. Planning Department; 7) The applicant shall submit a street name list consistent with the city's street name policy subject to the Planning Direc- tor's approval prior to final map approval. 8) Lots 3-6 inclusive shall provide at least 3 on-site parking spaces per lot. Prior to final map approval the applicant shall enter into an agreement with the owner of property directly to the east of the proposed subdivision (Assessor's Parcel No. 207-360-12) to dedicate the panhandle portion of said property to the city for the construction of Whitey Drive. Approval of this tentative tract map shall expire eighteen months from the date of City Council approval unless a final map is recorded. An extension may be requested by the appli- cant. Said extension shall be approved or denied at the dis- cretion of the City Council. In approving an extension, the City Council may impose new conditions and may revise existing conditions. The developer shall obtain a grading permit prior to the com- mencement of any clearing or grading of the site. The grading for this project is defined as "controlled grad- ing" by Section 11.06,170(a) of the Carlsbad Municipal Code. Grading shall be performed under the- observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to insure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. No Grading shall occur outside the limits of the subdivision unless a letter of permission is obtained from the owners of the affected properties. Additional drainage easements and drainage structures shall be provided or installed as may be required by the County Depart- ment of Sanitation and Flood Control or the City Engineer. The developer shall pay the current local drainage area fee prior to approval of the final map or shall construct drainage systems in conformance with the Master Drainage Plan and City of Carlsbad Standards as required by the City Engineer. Land for all public streets and easements shown on the tenta- tive map shall be dedicated on the final map and shall be granted to city free and clear of all liens and encumber- ances. Direct access rights for all lots abutting Park Drive shall be waived on the final map. All public streets shall be improved by the developer based on the typical sections shown on the tentative map and in confor- mance with City of Carlsbad Standards prior to occupancy of any buildings. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. Fire Department; 23) Two fire hydrants shall be installed by the applicant, one located between lots 1 and 2 and one located at the corner of Park Drive and Whitey Drive. I. PROJECT DESCRIPTION The applicant proposes to subdivide three parcels with a combined area of 2.5 acres into six lots, one of which will be a panhandle lot. The lots created by this subdivision will vary in size from 11,640 to 18,200 square feet. Whitey Drive, an existing driveway serving a panhandle lot to the east of the proposed subdivision, will be improved and widened to public street, standards to serve the lots created by the proposed subdivision. Exhibit "B" shows the three existing lots that will be subdivided by the proposed tentative map. Although two of the three lots have substantial frontage on Park Drive, significant regrading of the property would be required to gain access to these lots from Park Drive. At the present time, the westerly edge of these properties is approximately 15 feet above Park Drive. The subject property has been rough graded in the past and is partially covered with weeds at the present time. The site slopes down from an elevation of approximately 130 feet in its easternmost corner to approximately 70 feet on the west edge. Along the west edge of the site, a nearly vertical cliff over- looks Park Drive. Most of the surrounding properties have been developed with single family homes on larger lots. II. ANALYSIS 1. Does the proposed tentative tract map meet the requirements of the Carlsbad Zoning Ordinance? 2. Does the proposed tentative tract map meet the requirements of the Carlsbad Subdivision Ordinance and the State Subdivi- sion Map Act? IV. DISCUSSION All of the lots created by this subdivision will have more than the 10,000 square foot minimum lot size required by the R-1- 10,000 zone. Lot 5, the panhandle lot, will have a buildable area greater than the 10,000 square foot minimum required by the Carlsbad Zoning Ordinance. All of the lots created by this sub- division will have frontage on and gain access from Whitey Drive, which will be a public street. As proposed, this subdivision meets all of the requirements of the Carlsbad Subdivision Ordinance and the Subdivision Map Act. The proposed map and improvements are consistent with the Carls- bad General Plan. Whitey Drive is a private street presently owned by the property owner located east of the subject site. The applicant would be required to enter into an agreement with the property owner to the east to obtain dedication of the panhandle portion of his lot to allow for the improvement of Whitey Drive to public street standards. The site is physically suited for the type and den- sity of development proposed by the applicant and the proposed subdivision will not cause any substantial environmental damage or serious health problems. The design of the subdivision does not conflict with any easements. An existing 12' wide SDG&E easement across lot 4 will be abandoned prior to final map re- cordation. The building pads created by this subdivision will allow the future owners to construct homes with excellent views of Agua Hedionda Lagoon and the Pacific Ocean. Since the proposed tenta- tive tract map meets all of the requirements of the Carlsbad Zoning Ordinance and Subdivision Ordinance, as well as the State Subdivision Map Act, staff recommends that the Commission approve CT 81-23. IV. ENVIRONMENTAL REVIEW The Planning Director has determined that as conditioned this project will not have a significant impact on the environment and therefore has issued a Conditional Negative Declaration dated August 13, 1981. V. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Condi- tional Negative Declaration issued by the Planning Director and adopt Resolution No. 1852, recommending APPROVAL of CT 81-23 to the City Council based on the findings arid subject to the condi- tions contained therein.
