Creek Park must be dedicated.
ITEM EXPLANATION:
Engineering staff has completed checking the Final Map of Carlsbad Tract
79-25 (B) (a 116 unit condominium project) for the conformance with the
State Map Act and the Carlsbad Municipal Code. The Final Map conforms
substantially with the conditions of approval and the Tentative Map as
approved by City Council on October 6, 1981.
Environmental impacts of this development were considered at the Tenta-
tive Map stage and were satisfied or mitigated at that time.
Conditions of the Condominium Permit have not yet been met, however, no
Building Permits will be issued prior to all conditions of the Condomin-
ium Permit being met. This condition is posted on the Record Map.
Park requirements for this subdivision will be satisfied by granting the
developer a credit against excess park land already dedicated. This is
being done because the Parks and Recreation Department is in the process
of amending the Parks Master Plan and Daon has not yet revised the parks
agreement. A resolution modifying the parks agreement is required to
grant this credit and is attached.
Because a similar situation exists for CT 81-12 (Meadowridge) which is
also requesting a Final Map approval, the above resolution modifies the
parks agreement for that subdivision as well.
FISCAL IMPACT:
The increased need for City services resulting from this development
will be offset by the payment of the Public Facilities Fee. A Home Owners
Association will be created to maintain all private streets and recrea-
tional facilities associated with this project.

SUBJECT: PARK LAND DEDICATION CREDITS - Carlsbad Tract 79-25B (Meadow
Crest) and Carlsbad Tract 81-12 (Meadowridge)
In accordance with the agreement with La Costa Land Company, dated January 3,
1978 (Resolution No. 5286), this statement regarding this subdivision's obli-
gation for park dedication has been prepared.
The applicant is requesting approval of a final map and is not proposing to
dedicate any park land at this time. The agreement provides" that, if excess
park land has been dedicated previously, credit may be given to subsequent
subdivisions. Resolution No. 6503 (dated April 21, 1981) provides that Para-
graph 4 of the Parks Agreement does not apply to CT 80-25 and CT 80-9. A
resolution has been prepared to extend this exemption to CT 79-25B and
CT 81-12 as well.

RESOLUTION NO. 66.91
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, DELAYING THE TIME AT WHICH SAN MARCOS CREEK
PARK SHALL BE DEDICATED PURSUANT TO THE AGREEMENT BETWEEN
LA COSTA LAND COMPANY AND THE CITY OF CARLSBAD APPROVED
BY CITY COUNCIL RESOLUTION NO. 5286
WHEREAS, the City Council, of the City of Carlsbad, has by Resolution

No. 5286 approved the parks agreement between the City of Carlsbad and the La
Costa Land Company; and
WHEREAS, Paragraph No. 4 of said Agreement provides:
"As a condition of approval of final subdivision map for
the subdivision of any part of the property within the
boundaries marked "Area C", on Exhibit "B", attached
hereto and made a. part hereof, La Costa shall deed or
dedicate to City, free of any liens and encumbrances, by
appropriate instrument acceptable to City, the site
designated on the revised Master Plan and shown on "Ex-
hibit B", hereto as San Marcos Creek Park. Said park
shall consist of 14.7 acres for which La Costa shall re-
ceive credit as herein provided equal to 10.7 acres com-
puted according to the provisions of Chapter 20.44 of the
Carlsbad Municipal Code and this agreement."

WHEREAS, the City Council has previously adopted Resolution No. 6503

which waived the requirements of Paragraph 4 of the Parks Agreement for sub-

divisions CT 80-25 and CT 80-9 and now desires to do the same for CT 79-25B
19
and CT 81-12 despite the provisions of Paragraph 3 of Resolution 6503; and
20
WHEREAS, CT 80-25 (Meadowbrook), CT 80-9 (Hidden Meadows), CT 79-25B
21
(Meadow Crest) and CT 81-12 (Meadowridge) have been or will be submitted within
22
a short period^of time after the date of this resolution for final map approval;

and

WHEREAS, CT 80-25, CT 80-9, CT 79-25B and CT 81-12 are final subdivi-
25
sion maps for subdivisions within the area designated in Paragraph 4 of the
26
Parks Agreement; and

WHEREAS, the City Council finds that it is desirable to allow the
final maps for CT 80-25, CT 80-9, CT 79-25B and CT 81-12 to be approved; and
WHEREAS, the La Costa Land Company, or its successor in interest, the
Daon Corporation, are not prepared at this time to dedicate the entire 14.7
acres of San Marcos Creek Park; and
WHEREAS, the requirements of provision of park land or payment of fees
in lieu thereof pursuant to Chapter 20.44 .of the Carlsbad Municipal Code and
the Parks Agreement between the La Costa Land Company and the City shall be com-
plied with by the applicants for CT 80-25, CT 80-9, CT 79-25B and CT 81-12;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. .That the foregoing recitations are true and correct.
2. That the requirement under Paragraph 4 of the Parks Agreement to
dedicate 14.7 acres known as San Marcos Creek Park shall not apply to the final
subdivision maps for CT 80-25, CT 80-9, CT 79-25B and CT 81-12.
3. That this resolution shall not apply to any other subdivision in
the area designated in Paragraph 4 of the Parks Agreement between the La Costa
Land Company and the City of Carlsbad.
4. That this resolution shall not constitute or be considered a
waiver of any of the City's rights under Paragraph 4 of the Parks Agreement
between the La Costa Land Company and the City of Carlsbad.
5. That except as provided in Paragraph 2 above, nothing in this
resolution shall relieve La Costa Land Company or its successors in interest
from meeting its obligations under Paragraph 4 any other provisions of the
Parks Agreement.
6. That the requirement to provide park land or payment of fees in
lieu thereof pursuant to the provisions of Chapter 20.44 of the Carlsbad Munici-
pal Code and the Parks Agreement for CT 80-25, CT 80-9, CT 79-25B and CT 81-12

shall be met either by the payment of park- in- lieu fees or from credit existing
in favor of the La Costa Land Company for previously dedicated park land under
such Parks Agreement.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
