RECOMMENDED ACTION:

Adopt Resolution No. 6700 declaring the intention to vacate a portion of
El Camino Real at Elm Avenue,;Ind setting a public hearing for 6:OO P.M. Novem-
ber17, 1981. ITEN EXPLANATION:
A request to vacate a portion of El Camino Real north of Elm was made by Brian Smith Engineering, Inc., acting agent for Elm Properties. The utili-
ty companies were notified. SDGeE requested an easement for their exis- ting utilities. Utilities/Maintenance informed us that there is a drainage ditch that will have to be maintained by the property owner if the vacation is approved. The area that includes this land was acquired by the County of San Diego by grant deed recorded March 19, 1968 and was annexed to the
City of Carlsbad on September 25, 1974.
FISCAL IMPACT:
Approval of this vacation will result in approximately 36,982 square foot of land to be returned to tax rolls.

PORTION OF EL CAMINO REAL NOR" OF ELM
The City Council of the City of Carlsbad, California, does hereby resolve

1. The City Council of the City of Carlsbad, California, hereby declares
its intention to proceed under the provisions of public streets, highways and
;emice easement vacation law of 1980 to vacate portion of El Camino Real north
)f Elm Avenue.
2. A public hearing shall be held at the City Council Chanibers at 1200
3.m Avenue, Carlsbad, California, at 6:OO P.M. on November17, 1981, for the
mrpose of hearing all persons interested in or objecting to said proposed
racation.
