Adopt Resolution No. 67Or to summarily vacate a portion of Pi0
Pic0 at Knowles Avenue and approve to refund $400 street vacation
fee per Council Policy No. 26 since the City did not utilize the
eas emen t .
ITEM EXPLANATION:
A request to vacate a surplus easement on Pi0 Pic0 was made by
Kenneth A. Bagley. The Engineering Department has reviewed the
request and concluded that the excess easement contains no public
facilities and no usable access to the adjoining property.
Utility companies were notified and responded that they have no
utilities on the easement and have no objections to the vacation.
According to Council Policy No. 26:
Upon approval of a "Resolution" to abandon a public
street "The Council may also choose to refund the
$400 application fee, if the City never utilized the
s t ree t . ''
FISCAL IMPACT:
Approval of this vacation will result in approximately 634 Sq. Ft.
of land to be returned to tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA SUMMARILY VACATING AN EASE-
MENT OVER A PORTION OF PXO PIC0 AND KNOWLES AVENUE.
WHEREAS, that easement previously dedicated contains no
public facilities or appurtenances,and provides no usable access
to the adjoining property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. The above facts are true and correct.
2. That, pursuant to Section 8334a of Chapter 1050 of
the California Street and Highways Code, said ease-
ment referenced above, be summarily vacated.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council held on the 3rd day of Novaher . , 1981,
by the following vote, to wit:
