RECOMMENDED ACTION:
Both the Planning Staff and Planning Commission recommend that
this application be APPROVED and that the City Attorney be di-
rected to prepare documents APPROVING CT 81-13/PUD-25, per Plan-
ning Commission Resolution Nos. 1873 and 1874.
ITEM EXPLANATION
This item is a request for a 3 unit tentative tract map and
planned unit development on 1.72 acres of land located as des-
cribed above. The subject property has three different zones:
P-C (Planned Community) on the eastern portion; R-A- 10,000 on
the middle portion; and R-l-15,000 on the extreme western por-
tion. The applicant is using the PUD process to develop the pro-
perty into three lots since no development standards are
established in the P-C zone.
The Planning Commission found this project to meet all require-
ments of the underlying zones, the Subdivision Ordinance and the
Planned Unit Development Ordinance as it applies to the portion
of the property zoned P-C. Also, the Commission found that the
proposed density of 1.72 du's/acre does not exceed that allowed
by the General Plan on this site.
Through staff review and Planning Commission hearing, all issues
on this matter have been satisfactorily resolved.
ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not
cause any significant environmental impacts and, therefore, has
issued a Negative Declaration, dated May 1, 1981, which was ap-
proved by the Planning Commission on October 14, 1981. A copy of
the environmental documents is on file in the Planning Depart-
ment.
FISCAL IMPACTS
The applicant will provide all required public improvements to
the project. Also, the applicant has agreed to pay a public
facilities fee to offset the costs of providing all other public
services.

Findings:
1) The project is consistent with the city's General Plan since

range of 0-4 du's/acre specified for the site as indicated on
2 the Land Use Element of the General Plan.
4 2) The site is physically suitable for the type and density of
the development since the site is adequate in size and shape
5 to accommodate residential development at the density pro-
posed.
6 3) The project is consistent with all city public facility pol-
7 icies and ordinances since:
8 a) The Planning Commission has, by inclusion of an appro-
priate condition to this project, insured that the final
9 map will not be approved unless the City Council finds
that sewer service is available to serve the project. In
10 addition, the Planning Commission has added a condition
that a note shall be placed on the final map that build-
11 ing permits may not be issued for the project unless the
City Engineer determines that sewer service is available,
12 and building cannot occur within the project unless sewer
service remains available, the Planning Commission is
13 satisfied that the requirements of the public facilities
element of the General Plan have been met insofar as they
14 apply to sewer service for this project.
15 b) School facilities will be provided by the Carlsbad School
District per letter of agreement dated May 1, 1981.

c) The payment of park-in-lieu fees is required as a
17 condition of approval.
18 d) All necessary public improvements have been provided or
will be required as conditions of approval.

e) The applicant has agreed and is required by the inclusion
20 of an appropriate condition to pay a public facilities
fee. Performance of that contract and payment of the fee
21 will enable this body to find that public facilities will
be available concurrent with need as required by the
22 General Plan.
23 f) Assurances have been given that adequate sewer for the
project will be provided by the City of Carlsbad.

4) The proposed project is compatible with the surrounding
25 future land uses since surrounding properties are designated
for residential development on the General Plan.

5 1) Approval is granted for CT 81-13, as shown on Exhibit "A",
dated September 25, 1981, incorporated by reference and on
g file in the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these
7 conditions.
8 2) This project is approved upon the express condition that the
final map shall not be approved unless the City Council finds
9 as of the time of such approval that sewer service is
available to serve the subdivision.
10 3) This project is approved upon the express condition that
11 building permits will not be issued for development of the
subject property unless the City Engineer determines that
12 sewer facilities are available at the time of application for
such sewer permits and will continue to be available until
13 time of occupancy. This note shall be placed on the final
map.
14 4) This project is approved upon the express condition that the
15 applicant shall pay a public facilities fee as required by
City Council Policy No. 17, dated August 29, 1979, on file
16 with the City Clerk and incorporated herein by reference, and
according to the agreement executed by the applicant for
17 payment of said fee a copy of that agreement dated May 7,
1981, is on file with the City Clerk and incorporated herein
18 by reference. If said fee is not paid as promised, this
application will not be consistent with the General Plan and
19 approval for this project shall be void.

to the approval of the final map as required by Chapter 20.44

22 6) Approval of this request shall not excuse compliance with all
sections of the Zoning Ordinance and all other applicable
23 city ordinances in effect at time of building permit
issuance.

7) Approval of this Tentative Tract Map shall expire eighteen
25 months from the date of City Council approval unless a final
map is recorded. An extension may be requested by the
26 applicant. Said extension shall be approved or denied at
the discretion of the City Council. In approving an
27 extension, the City Council may impose new conditions and
may revise existing conditions.

8) The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
9) The grading for this project is defined as "controlled
grading" by Section 11.06.170(a) of the Carlsbad .Municipal
Code. Grading shall be performed under the observation of a
civil engineer whose responsibility it shall be to
coordinate site inspection and testing to insure compliance
of the work with the approved grading plan, submit required
reports to the City Engineer and verify compliance with
Chapter 11.06 of the Carlsbad Municipal Code.
10) The owner shall relinquish direct access rights to Tamarack
Avenue from lots 1, 2 and 3.
11) The applicant shall enter into a future public improvement
contract for the improvement of Skyline Drive along the
frontage of Lot 1.
12) The Tamarack Avenue right-of-way shall be dedicated on the
final map as it is shown on the tentative map. The
subdivider shall construct the full width improvement of
Tamarack Avenue based on a 52 foot curb to curb width
including sidewalks/ retaining walls, street trees,
landscaping and irrigation as required by the City
Engineer.
13) Drainage down the driveway serving Lot 1 shall be conducted
to the street via a sidewalk under drain as approved by the
City Engineer.
14) All exposed slopes shall be hydroseeded or otherwise
stabilized immediately upon completion of grading activities
to the satisfaction of the City Engineer.
15) High Ridge Avenue shall be dedicated prior to final map
approval based on a right-of-way width of 42 feet.
16) High Ridge Avenue shall be improved based on a right-of-way
width of 42 feet prior to occupancy of any new buildings.
17) The developer shall pay the current local drainage area fee
prior to approval of the final map.
Fire Department
18) The applicant shall install a fire hydrant capable of
delivering a minimum of 1250 G.P.M. at 20 P.S.I residual
pressure at the southwest corner of High Ridge Avenue and
East Pointe Avenue. Said hydrant shall be installed in
conjunction with street improvements or prior to
combustible building materials being located on-site,
whichever occurs first.

SUBJECT: CT 81-13/PUD-25, SCHWAB - Request for a 3-unit/lot
Tentative Tract Map and Planned Unit Development
located immediately east of Skyline Drive and north of
Tamarack Avenue (extended). The property is located in
3 different zones. The eastern majority of the
property is in the P-C zone, the middle, the R-A-10,000
zone, and a small western section is located in the
R-1-15,000 zone.
I. PROJECT DESCRIPTION AND BACKGROUND
The applicant requests a 3-unit Tentative Tract Map and Planned
Unit Development on 1.72 acres of land as described above. The
applicant's intent is to subdivide the property and sell each
lot in an undeveloped state, allowing new owners to build custom
homes on them. Since the P-C zone does not have specific
development standards, the Planned Unit Development process is
used as a tool to provide standards for parcels zoned P-C which
are less than 100 acres in size. It should be noted that
certain development standards of the Planned Unit Development
Ordinance (i.e., common recreation areas, etc.) need not apply
to non-conforming (under 100 acre) parcels within the P-C zone.
The proposed project is a normal, single-family subdivision, not
a true Planned Unit Development, that meets the requirements of
the R-1 zone. Staff, through previous Planning Commission
action (CT 80-1/PUD-14), finds this acceptable.
II. ANALYSIS

1) Is the proposed subdivision comprehensively designed
and compatible with surrounding developments?
2) Does the proposed subdivision meet all development
standards of the Zoning Ordinance and Subdivision
Ordinance?
III. DISCUSSION
The proposed 3-unit/lot subdivision has been designed to take
access off of future High Ridge Avenue, a street developed in
connection with approved CT 76-15. Lots along this street will
be single-family in nature and compatible with the three lots
requested in this subdivision. No access will be allowed from
Tamarack Avenue. Staff had some concern with regard to the

amount of grading required to create building pads. A total of
approximately 16,300 cubic yards of fill will take place on the
site. To mitigate this concern, staff recommends the inclusion
of a condition requiring the immediate planting of all slopes
after grading. Since the grading will be consistent with that
proposed for CT 76-15 and other projects in the vicinity, staff
feels it is acceptable and that it will not create substantial
adverse impacts to the site.
The proposed subdivision meets the development standards and
requirements as each lot has a substantial open area for private
recreation and vehicle storage. This subdivision conforms to all
the requirements of R-1 zoning and the Subdivision Ordinance.
IV. ENVIRONMENTAL•REVIEW
The Planning Director has determined that this project will not
have a significant impact upon the environment and, therefore,
has issued a Negative Declaration, dated May 1, 1981.
V. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Planning Director and ADOPT
Planning Commission Resolution Nos: 1873 and 1874, recommending
APPROVAL of CT 81-13/PUD-25, to the City Council based on the
findings and subject to the conditions contained therein.

The Planning Department of the City of Carlsbad intends to
prepare a Negative Declaration for the following project:
Project Description: The applicant proposed a subdivision of 1.72
acres of land into four lots for a single family planned unit
development. The project proposed 20,800 cubic yards of grading
on property that slopes moderately to the east.
Project address/Location: Immediately east of Skyline Drive and
