ITEM EXPLANATION: The City Council, on October 26, 1981, adopted Resolution No. 6700, a Resolution of intention for vacating a portion of El Camino Real at the northeast corner of Elm Avenue. The City Council set November 17, 1981, at the hour of 6:OO P.M. as the time, and the City Council Chambers, 1200 Elm Avenue, as the place for a public hearing. The utility companies were notified. Staff recommends that this vacation be conditioned for street improve- ments adjacent to the area to be vacated. Improvements to be completed include sidewalk tree planting and street lights. The cost of the im- provements will be about $42,000. As shown in the resolution, the City Clerk is instructed not to record this vacation until improvements are complete. A time limitation of one year is also included. FISCAL IMPACT: Approval of this vacation will result in approximately 36,982 square feet of land to be returned to tax rolls. EXHI BITS : A. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That all publication and posting of notices regarding the proposed vacation of a portion of El Camino Real pursuant to Resolution of Intention No. 6700 have been given as required by law. 2. That .the City Council did hear the evidence offered by all persons interested in said proposed vacation and does find from all the evidence submitted that a portion of El Camino Real northeast of Elm Avenue in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit "A" attached hereto and by this reference incorporated herein, is unnecessary for present or prospective street purposes and does hereby make this order vacating said portion of El Camino Real. 3. That the Council finds the area to be vacated is not suitable for bikeways. 4. That the vacation of said portion of El Camino Real is conditioned upon the Elm Properties constructing street improvements along the frontage of the proposed vacation within a year or at the option of Elm Properties securing such - improvements at an earlier time provided that the improvements shall be installed within one year. Such improvements shall include sidewalks and street lights. The City Clerk is instructed not to record this R--olution of Vacation until the improvements are instal- ed or secured according to Condition 4.
