RECOMMENDED ACTION:
Both the Planning Staff and Planning Commission recommend that
this application be DENIED and that the City Attorney be directed
to prepare documents DENYTNG without prejudice CT 81-1/CP-146,
per Planning Commission Resolution No. 1886.
ITEM EXPLANATION
This application was originally submitted on February 1, 1980.
During staff review, a number of concerns were raised regarding
the design and grading of the project. The applicant indicated
that he would redesign the project addressing staff's concerns,
however, no new plans were submitted to staff and the application
was subsequently withdrawn on January 6, 1981.
A new application was submitted on January 15, 1981. The site
plan had the same problems as before and again the applicant in-
dicated that a redesigned site plan would be submitted. Nearly a
year has passed and no revised plans have been submitted. Under
California Assembly Bill 884, the city only has a maximum of one
year to render a decision on a project or else it is deemed auto-
matically approved. Staff believes the applicant is not serious
about developing the property at this time and the Planning Com-
mission is recommending that this application be denied without
prejudice.

7 WHEREAS, a verified application for certain property
8 to, wit:
9 Lot 185, La Costa South Unit No. 1, in the city of

Carlsbad, County of San Diego,
has been filed with the city of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a
request as provided by Title 21 of the Carlsbad Municipal Code;
and
WHEREAS, the Planning Commission did, on the 28th day
of October, 1981, hold a duly noticed public hearing as
prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Tentative Tract Map and Condominium Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends DENIAL without prejudice of
CT 81-1/CP-146, based on the following findings and subject
to the following conditions:

COSTA AVENUE BETWEEN EL CAMINO REAL AND NUEVA CASTILLA
WAY IN THE RDM ZONE.
I. DISCUSSION
This application was originally submitted on February 1, 1980.
During staff review, a number of concerns were raised regarding
the design and grading of the project. Although the applicant
indicated that he would redesign the project addressing staff's
concerns, no new plans were submitted to staff and the applica-
tion was subsequently withdrawn on January 6, 1981.
A new application was submitted on January 15, 1981. • The site
plan had the same problems as before and again the applicant in-

II.RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution
No. 1886 DENYING WITHOUT PREJUDICE CT 81-1/CP-146 based on the
findings containedtherein.
