ITEM EXPLANATION This item is a request for a 22 unit industrial tentative tract map and condominium permit located as described above. The industrial building has been built and presently is being leased to various industrial companies and businesses. As an industrial condominium, the project is not subject to the development standards of the Condominium Ordinance, however, it is subject to the underlying P-M zoning standards. The Planning Commission found that the project, as conditioned, meets all the development standards of the P-M zone. Also, the Commission found the project meets all requirements of the Subdivision Ordinance. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved. ENVIRONMENTAL REVIEW The Planning Director has determined that this project is categorically EXEMPT from environmental review pursuant to Section 19.04.070(1)(H) of the Carlsbad Environmental Ordinance. FISCAL IMPACT The applicant has provided all required public improvements to the project. Also, the applicant has agreed to pay a public facilities fee to offset the costs of providing other public services to the project. EXHIBITS A. PC Resolution No. 1880 B. Lot 7 of Carlsbad Tract 73-49, Unit No. 1 according to map thereof No. 8054 filed December 31, 1974. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the'Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 28th day of October, 1981, hold a duly noticed public hearing as prescribed by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and considering • , all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis- sion as follows: (A) That the foregoing recitations are true and correct. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 4) The proposed project is compatible with the surrounding land uses since surrounding properties have been developed with industrial uses or designated for industrial development. 5) The Planning Director has determined that this project is categorically exempt from environmental review according to Section 19.04.070 (1) (H) of the Carlsbad Environmental Ordi- nance. 6) The applicant has given and will give additional notice as specified in the Subdivision Map Act and the Carlsbad Municipal Code of the proposed conversion and right to purchase to the tenants of the project. 7) The project meets all development standards and design cri- teria of the condominium ordinance and underlying P-M zone relative to a non-residential condominium project.19 Conditions20 General Conditions :21 1) Approval is granted for CT 81- 38/CP-184 , as shown on Exhibit(s) "A"-"H", dated September 17, 1981, incorporated by reference and on file in the Planning Department. Develop- 23 ment shall occur substantially as shown unless otherwise noted in these conditions. 24 2) This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is avail- able to serve the subdivision. /// /// PC RESO 1880. -2- 1 3) This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by 2 City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and 3 according to the agreement executed by the applicant for pay- ment of said fee a copy of that agreement dated August 19, 4 1981, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this ap- 5 plication will not be consistent with the General Plan and approval for this project shall be void. 6 4) The applicant has given and shall give additional notice of 7 the conversion to all tenants as required by the Subdivision Map Act and the Carlsbad Municipal Code. 8 5) Approval of this request shall not excuse compliance with all 9 sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu- 10 ance. 11 Planning Department; 12 6) The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. 13 Said site plan shall be submitted to and approved by the Planning Director prior to approval of the final map. 14 7) The applicant shall establish an owner's association and cor- 15 responding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning 16 Department prior to final map approval. 17 8) The applicant shall prepare a detailed landscape and irriga- tion plan which shall be submitted to and approved by the 18 Planning Director prior to final map approval. All landscape improvements shown on this plan shall be completed prior to 19 final map approval. 20 9) All parking lot trees shall be a minimum of 15 gallons in size. 21 10) All landscaped areas shall be maintained in a healthy and 22 thriving condition, free from weeds, trash, and debris. 23 11) A comprehensive sign program shall be submitted to and approved by the Planning Director prior to approval of a 24 final map. 25 12) six (6) trash receptacle areas shall be provided and enclosed by a 6 foot high masonry wall with gates pursuant to city 26 standards. Location of said receptacles shall be approved by the Planning Director. An extension may be requested by the applicant. Said extension shall be approved or denied at the discretion of the City Council. In approving an extension, the City Council may impose new conditions and may revise existing conditions. 14) Prior to final map approval, the compact parking spaces shall be clearly marked with pole signs denoting "Compact Cars Only". Request for a 22 unit industrial tentative tract map and condominium permit to convert an existing indus- trial building to condominiums on the north side of the intersection of Camino Vida Roble and Las Palmas Drive , in the P-M zone. I. PROJECT DESCRIPTION The applicant proposes to convert a recently constructed indus- trial building to industrial condominiums, located as described above. The subject building is a single story, multi-tenant industrial building which has been divided into 22 separate units, a few of which are being leased at the present time. The site is in the middle of the Palomar Airport Business Park and is surrounded by industrial development and lots designated for in- dustrial development. II. ANALYSIS Planning Issues 1) Does the project conform with the development standards of the Condominium Ordinance? 2) Does the project conform with the design criteria of the Condominium Ordinance? Development Standards The condominium ordinance requires that the proposed conversion meet all of the development standards of the underlying zone. As constructed, the building meets all of the development standards of the P-M zone. Staff is recommending a condition of approval requiring that the six trash enclosures as shown on Exhibit "A" be constructed prior to final map approval. Also, additional signs will be added by the applicant to identify the compact parking spaces. This project meets all the applicable develop- ment standards of the P-M zone. ""6 Design Criteria designed, staff feels that the proposed conversion complies with> all of the applicable design criteria of the condominion ordinance. The project provides for adequate parking and circu- &a.taon and conforms to the requirements of the Planned Industrial zone. Also, this project is compatible with the existing and planned development for the Palomar Airport Business Park. The only change created by the approval of this tentative tract map and condominium permit will be the ownership of the buildings. III. ENVIRONMENTAL REVIEW The Planning Director has determined 'that this project is cate- gorically exempt from environmental review according to Section 19.04.070 (1) (H) of the Carlsbad Environmental Ordinance. IV. REC OMMENTATION It is recommended that the Planning Commission adopt Resolution No. 1880 recommending approval of CT 81-38/CP-184 to the City Council based on the findings and subject to the conditions con- tained therein.
