CITY MGR./^^5- jlf.f RECOMMENDED ACTION: Adopt Ordinance No. /fp I 0 increasing the Planned Local Drainage Area Fees by 25.0%. ITEM EXPLANATION: Section 20.09.040 of the Carlsbad Municipal Code provides for certain drainage fees per acre to be paid for subdivisions for the purpose of defraying the cost of re- moving storm water. These fees were originally calculated in January 1980 and placed in the Code. Section 20.09.070 of the Carlsbad Municipal Code provides that the fees shall be adjusted each June and December and the adjustment shall be based on the Engineer- ing News Record Construction Cost Index. This index for January 1980 for the City of Los Angeles (the closest comparison) was 3630.12 and for November 1981 it is 4538.59, an increase of 25.0%. The words "per gross acre" were left out of Section 20.09.040 of the Code and the attached ordinance will correct this. The first fee adjustment under the Code was to be accomplished in June 1981 and was inadvertently omitted. The next adjustment will be presented to Council in June 1982 and will cover the change in the index from November 1981 to May 1982. FISCAL IMPACT: This increase will result in an increase to developers of 25.0% in drainage fees. It will also keep these fees close to current cost so that, when the systems are constructed by the City, the money will be available to cover the cost. EXHIBITS: A. ORDINANCE NO. 961° 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 20, CHAPTER 20.09 OF THE 3 CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 20.09.040 TO REVISE DRAINAGE FEES _ 4 5 The City Council of the City of Carlsbad, California, does ordain as 6 follows : 7 SECTION 1: That Title 20, Chapter 20.09 of the Carlsbad Municipal Code 8 is amended by the amendment of Section 20.09.040 to read as follows: 9 "20.09.040 Drainage Fees Established; Pursuant to Section 66483 of the Subdivision Map Act, the following drainage fees shall be paid per gross acre 10 for subdivisions within the local drainage ar.eas established herein for purposes of defraying the costs of PLDF for the removal of surfaces and storm 11 waters from PLD areas as follows: 12 PLD Area: 1 $ -0- 2 -0- 13 3 3808 4 1686 14 5 2658 6 200 15 7 2273 8 -0- 16 9 2878 10 1196 IV 11 1630 12 4445 18 13 2858 19 The City Council finds that such fees are fairly apportioned within such areas on the basis of benefits conferred on property proposed for subdivision 20 or on the need for such facilities created by the proposed subdivision and development of other property within such areas. For the purpose of computing 21 the above-mentioned estimated costs and fees, acreage shall be computed as gross acreage to the centerline of streets abutting the property in question and 22 fees for fractional acreage shall be prorated." 23 EFFECTIVE DATE: This ordinance shall be effective thirty days after its 24 adoption, and the City Clerk shall certify to the adoption of this ordinance and 25 cause it to be published at least once in the Carlsbad Journal within fifteen^•* 26 days after its adoption. 27 INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council 28 held on the 1st day of December _ , 1981. •1 PASSED AND ADOPTED at a regular meeting of said City Council held on the 2 15th day of December, 1981 by the following vote, to wit: 3 AYES: Council Members Packard, Casler, Anear, Lewis and Kulchin 4 NOES: None 5 ABSENT: None 6 <RONALD C.
