CITY MGR."5^= RECOMMENDED ACTION: If the City Council concurs, your action is to adopt Resolution No. 6^733 approving GPA-59(B)f 59(C)f 59(D), 59(E), 59(H)f 59(1) and 59(J). ITEM EXPLANATION: The City Council, at your meeting of November 17, 1981, directed the City Attorney to prepare the necessary documents to amend the land use element of the General Plan to change the land use designations for six areas of the General Plan and to amend the text to allow density limits on planned community developments. A resolution approving GPA-59(B), 59(C), 59(D), 59(E), 59(H), 59(1) and 59(J) has been prepared and is attached. GPA-59(B); 59(C); 59(D); 59(E), 59(H); 59(1) AND 59(J). CITY OF CARLSBAD. WHEREAS, the Planning Commission did on October 28, 1981 hold a duly notice public hearing as prescribed by law to consider amendments to the Land Use Element of the General Plan in six different locations within the City's sphere of influence (GPA-59(B); 59(C); 59(E); 59(H); 59(1); 59(J)) and to amend the text of the General Plan to allow density limits on planned communities (GPA-59(D); and WHEREAS, the Planning Director has determined that GPA- 59(E)r 59(H), 59(1) and 59(J) will have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed. An environmental Impact Report has been certified for GPA-59(B), 59(C) and 59(D), all in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act; and WHEREAS, the City Council, on November 17, 1981, held a duly advertised public hearing to consider said amendments and at said time received the recommendations, objections, protests and comments of all individuals and parties who desired to be heard; and WHEREAS, the City Council, after considering all the proposed changes to the text and land use elements of the o CD3 <3du. O £ it* 1 2 5 4 5 6 7 6 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 General Plan, directed the City Attorney to return with the appropriate documents to allow the City Council to vote on the changes individually as a part of one single amendment to the Land Use Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That this resolution and GPA-59(B); 59(C); 59(D); 59(E); 59(H); 59(1) and 59(J) are all part of a single amendment to the land use element of the General Plan. C. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 1884 constitute the findings of the City Council. The Council further finds that the amendment to Page 22 of the land use element text is based on discussions and comments made during the public hearing held by the Planning Commission and need not be referred back to them for further recommendations. D. That the text and map of the land use elements of the General Plan are amended as follows: 1. GPA-59(B)-Santa Fe Company. Change the land use designation from Neighborhood Commercial, Residential Medium Density and Residential Low Medium Density to Planned Industrial on property generally located east of El Camino Real and north of Palomar Airport Road, more particularly as shown on the map marked Exhibit 1 attached hereto and made a part hereof. 2. GPA-59(C)-Occidental. GPA-59(D)-Rancho Carrillo. In accordance with the recommendations set out in the Planning Department Staff Report, dated October 28, 1981, on file in the Planning Department and incorporated by reference herein, change the existing land use designations to Residential Low Medium density; Residential Medium Density; Residential Medium High density; Community Commercial; Recreation Commercial; Planned Industrial and Elementary School on property consisting of approximately 758 acres, generally located 5.5 miles inland from the Pacific Ocean, bounded on the north by the Carlsbad Raceway, on the east by San Marcos, on the south by La Costa and on the west by unincorporated San Diego County, more particularly as shown on the map marked Exhibit 3 attached hereto and made a part hereof. In addition, pursuant to the amendment contained in Section D.8. of this resolution, the maximum number of residential units for the area included in this amendment shall be 2,998 units. This limit shall be shown on the land use map. 4. GPA-59(E)-Carltas. GPA-59(H)-City of Carlsbad. Change the land use designation from Planned Industrial to a Combination District comprised of Commercial Travel Services/Professional(Office) and Related on property generally located along the frontage of Paseo del Norte southerly of Palomar Airport Road and northerly of Alta Mira, more particularly as shown the map marked Exhibit 5 attached hereto and made a part hereof. 6. GPA-59(I)-James Hieatt. Change the land use designation from Non-Residential Reserve to Planned Industrial on property generally located on the north side of the northern 3. boundary of Palomar Airport approximately 6000 feet west of El * Camino Real, more particularly as shown on the map marked Exhibit 6 attached hereto and made a part hereof. 7. GPA-59(J)-City of Carlsbad. Change the land use element by creating a new, higher density, residential designation titled "Very High Density", as shown on Exhibit 7, attached hereto and made a part hereof. 8. The Land Use Element of the General Plan, at Page 22, is amended by the amendment of Chapter IV, Section C, Subsection 1—Residential by the addition of a fourth paragraph to read as follows: ' "Certain areas of the of the City designated for planned communities may have several residential designations or combinations of residential designations. In order to accommodate good design and planning, as well as environmental and topographical factors, planned communities shall be controlled by a master or specific plan. The residential density for the planned community may be set at a maximum number of dwelling units which is less than the total number of dwelling units which would be allowed at the high end of the density ranges specified for the area. Consistent with the housing element, the maximum dwelling units designated may be exceeded to provide low and moderate income housing."
