RECOMMENDED ACTION:
City Council adopt Resolution No./,73/ approving the contract
between the City of Carlsbad and the San Diego Gas and Electric
Company to provide beach clean-up and maintenance for the prop-
erty owned by the San Diego Gas and Electric Company and auth-
orizing the Mayor to execute the agreement.
ITEM EXPLANATION
The San Diego Gas and Electric Company has a need to clean and maintain their 1300' of beach property adjacent to the warm water
jetty. The company, however, does not have the manpower available
to perform this service.
The State of California was approached regarding this matter, but
has no funding budgeted for this purpose. As a final alternative,
the City has agreed to provide the cleanup and maintenance on a contractual basis from October 1 to December 31, 1981 at a cost
of $300.00 per week.
The San Diego Gas and Electric Company is currently negotiating
with the State to lease or purchase the property after
December 31.
FISCAL IMPACT
The City will acquire $3900 in revenue from the San Diego Gas E Electric Company for services rendered.
Two staff will work 24 manhours per week to perform the task.
24 hours/week x $lO.OO/hour = $240.00/week x 13 weeks = $3120 x 25% overhead = $3900

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING All AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE SAN DIEGO GAS AND ELECTRIC COMPANY, SAN DIEGO,
CALIFORNIA, FOR BEACH CLEAN-UP AND
#AINTENANCE AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT.
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. That an agreement between the City of Carlsbad, Cali-
fornia and the San Diego Gas & Electric Company, San
Diego, California, for beach clean-up and maintenance,
a copy of which is attached hereto marked Exhibit A
and incorporated herein by reference, is hereby approved
2. That the Mayor of the City of Carlsbad is hereby author-
ized,and directed to execute said agreement for and on
behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
2ity Council of the City of Carlsbad, California, held on the 1st

AGEEMENT FOR THE PROVISION
OF
BEACH CLEAN-UP AND MAINTEXAXCE
..
This agreement entered into this day of ¶
1981, by and between the City of Carlsbad, a municipal corporation
of the State of California, hereinafter referred to as "Carlsbad"
and the San Diego Gas and Electric Company, a California corpor-
ation, hereinafter referred to as "San Diego Gas and Electric".
WITNESSETH :
WHEREAS, Carlsbad is engaged in various maintenance
programs including beach clean-up to promote the safety, health axd
general welfare of it's citizens and;
WHEREAS, Carlsbad maintains personnel and equipment for
the purpose of cleaning and maintaining the beach;
WHEREAS, the San Diego Gas and Electric Company owns
approximately 1300' of beach property adjacent to the warm water
jetty in the City of Carlsbad and;'.
WHEREAS, San Diego Gas and Electric has a need to pro-
vide beach clean-up and maintenance of their beach property to pro-
mote the safety, health, and general welfare of the citizens of
Carlsbad;
NOW, THEREFORE, IT 1S.AGREED as iollows:
SECTION 1: DUTIES OF CARLSBAD: Carlsbad will carry
out a program of beach clean-up and maintenance as
follows : ?

A. Beach maintenance and trash pick-up will be
.conducted on Friday, Saturday, and Sunday for four
hours per day by two maintenance personnel at a total
of 24 manhours per week.

B; Maintain any equipment that is necessary to
conduct the clean-up and maintenance.
SECTION 1: - TERM: This agreement shall be effective
October 1, 1981, and shall terminate on December 31,
1981.
SECTION 2: PAYMENT: Payment to Carlsbad at $300.00
per week for a total of $3900 for the entire contract
period.

This amount is to be paid in full to the City
SECTION 3: HOLD HARMLESS SECTION: San Diego Gas E Elec-
tric agrees to defend, indemnify, save and hold harmless
any and all liabilities, penalties, loss, damages, fines
or any damage to goods, properties or affects of any
person whatsoever, or personal injuries or death caused
by the activities of San Diego Gas E Electric, its
officers, agents, and employees upon the above-described
beach property.
Carlsbad agrees to defend, indemnify, save and hold
harmless. San Diego Gas E Electric, its officers and
employees frum and against any and all liabilities,
penalties, loss, damages, fines or any damage to goods,
properties or affects of any person whatsoever, or per-
sonal injuries or death caused by the activities of
Carlsbad, its officers, agents, and employees upon the

above-described beach property.
SECTION.4: NOTICES: All notices required herein shall
be in writing and delivered in person or sent by mail.
Notices to Carlsbad shall be addressed: City Manager,
