DISCUSSION This application was submitted in November 1980. The Planning Commission may recall considering an appeal of a Conditional Negative Declaration which required the extension of Pontiac Avenue through to Tamarack, outside the limits of the project. At that time, the Commission upheld the staff's decision to require the extension of Pontiac Avenue. The applicant had a choice of agreeing with the condition or submitting a focused environmental impact report addressing the traffic concerns. Since that time, the property has changed ownership and the new owner has not pursued this application. Staff has contacted the applicant on several occasions during the past six months, however, no progress has been made. In order to meet the 1 year time limit mandated by California Assembly Bill 884, staff is recommending that this application be denied without prejudice. RECOMMENDATION Both the planning staff and Planning Commission recommend that this application be DENIED without prejudice, and that the City Attorney be directed to prepare documents DENYING ZC-218, CT 80- 35, and PUD-26, per Planning Commission Resolution Nos: 1892, 1893 and 1894.
