RECOMMENDED ACTION:
Both the Planning Staff and Planning Commission recommend that this application
be DENIED without prejudice, and that the City Attorney be directed to prepare
documents DENYING CT 80-35 and PUD-26, per Planning Commission Resolution Nos:
1892 and
ITEM EXPLANATION
This application was deemed complete in December 1980. Since that time, the
property has changed ownership and the new owner has not pursued this
application. Staff has contacted the applicant on several occasions during the
past six months, however, no progress has been made. In order to meet the 1
year time limit mandated by California Assembly Bill 884, staff is recommending
that this application be denied without prejudice.
FISCAL IMPACT
No fiscal impacts would be created if this application is denied without
prejudice.

OF CARLSBAD, CALIFORNIA, RECOMMENDING DENIAL WITHOUT
PREJUDICE OF A 111 LOT TENTATIVE TRACT MAP ON
PROPERTY GENERALLY LOCATED EAST OF SIERRA MORENA
AVENUE BETWEEN TAMARACK AVENUE AND CHESTNUT AVENUE

WHEREAS, a verified application for certain property, to
wit:
Portion of Lot "J" of the Rancho Agua Hedionda, in the
County of San Diego, Map No. 823, filed November 16,
1896.
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 18th day of
November, 1981, hold a duly noticed public hearing as prescribed
by law, to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to the
Tentative Tract Map; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis-
sion as follows: -
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing,
the Commission recommends DENIAL without prejudice of CT 80-

SUBJECT: ZC-218/CT 80-35/PUD-26, HAWORTH - Request for approval
of: 1) Zone Change from A(1)-8 (County) to R-1 and 2) a
105 unit Tentative Tract Map and Planned Unit
Development.
DISCUSSION
This application was submitted in November 1980. The Planning
Commission may recall considering an appeal of a Conditional
Negative Declaration which required the extension of Pontiac
Avenue through to Tamarack, outside the limits of the project.
At that time, the Commission upheld the staff's decision to
require the extension of Pontiac Avenue. The applicant had a
choice of agreeing with the condition or submitting a focused
environmental impact report addressing the traffic concerns.
Since that time, the property has changed ownership and the new
owner has not pursued this application. Staff has contacted the
applicant on several occasions during the past six months,
however, no progress has been made. In order to meet the 1 year
time limit mandated by California Assembly Bill 884, staff is
recommending that this application be denied without prejudice.
RECOMMENDATION
Both the planning staff and Planning Commission recommend that
this application be DENIED without prejudice, and that the City
Attorney be directed to prepare documents DENYING ZC-218, CT 80-
35, and PUD-26, per Planning Commission Resolution Nos: 1892,
1893 and 1894.
