HD.~~ CITY AT'dB CITY MGR. 5 -%L RECOMMENDED ACTION: Council approve the plans to develop a portion of the Cadencia site by constructing a multi-purpose athletic turf area. The work is to be performed by force account. ITEM EXPLANATION Because of lack of restrooms, safety, traffic, and parking problems, the residents surrounding the Cadencia open space area wish to ap;peal the proposed development of a multi-use athletic area on a part of the Cadencia open space site. Rs,ferT to Exhibit A. On May 25, 197'1, open space lots 115 and 117, totaling 4.07 acres, was deeded to the city as a condition to CT-76-3 La Costa Vale #4. Because it was functionally a part of San Marcos Canyon and its steep topo- graphy, it was deemed undevelopable. Some time in 1977, construction crews working for the La Costa Land Company, dumped a substantial amount of rock and debri on the subject open space area adjacent to Cadencia Street. A letter (refer to Exhibit B) was sent from the Parks and Recreation Department outlining corrective action. This additional fill created an area approximately one (1) acre that had the potential for a small multi-purpose athletic area. On September 11, 1979, a group of interested citizens approached Council regarding lack of athletic areas in Carlsbad. Staff outlined several potential sites that could be developed that would help alleviate the problem. Cadencia was one of the areas. On April 15, 1980, Council approved the application for a Roberti Z'berg grant for $6,900 that would be used to purchase materials for the con- struction of a multi-use athletic play area. This project was to be accomplished by force account, developed cn: a phased basis. On August 17, 1981, the Parks and Recreation Commission heard testimony from citizens who spoke in favor for and against the proposed Cadencia development. Area residents did not want an active play area, but rather a neighborhooc type park concept. They indicated a willingness to assist in the development. The Parks and Recreation Commission, on September 21 1981, voted four to two to utilize the site as a multi-purpose playing field as a tem- porary solution, until Alga Norte and Stagecoach are developed, at which time it would be offered to the community/neighborhood, if they will form an assessment district to pay for the maintenance. The residents would like to appeal a Parks and Recreation Department decision to use the Cadencia Street park as a soccer and baseball practice field. As residents in close proximity to the park, we feel that the traffic resulting from being constantly used for practice will constitute a serious traffic and safety hazard on Cadencia Street. We have other valid concerns about the park use, too. The fact that there is no plan to install restrooms, the hazard of balls being retrieved after going over the edge of the canyon, the aesthetics of the park (a backstop and bleachers are not: attractive) and the fact that many residents were told to expect a community park when they bought their homes -- all are reasons for our concerns. I We have had many neighborhood meetings about the park, and it is the general consensus that we are willing to donate out time, labor and money in order to have the park planned to fit into our neighborhood needs. We would appreciate a reply as soon as possible in regard to this matter. Gentlemen : Some time ago a considerable volume of unsuitable rock material was placed on portions of lot 504 of La Costa Vale, UnLte 83, CT 73-20, and a portion of canyon area just westerly of Lot 504. This area is b~ithin the bound- aries of the proposed Vale Unite #4 (CT 76-3)- This rock disposal was not in conformance to the approved grading plan for Vale #3. By letter dated October 7, 1976, Rick Engineering has informed us that it is La Costa's intention to place additional rock on the subject site, as well as renove the rock that has been placed in the canyon ares, In reviewing the matter, it is disturbing to us that fie16 . . personnel of your company chose to make unapproved modifi- . cations to approved plans based on economic or convenience logic without regard to land planning, environmental or legal concerns. The approved Tentative Map for Vale #4 calls for Lot 115 (and new Lot 117) to be open space lots.
