ITEM EXPLANATION /,/ Envi~onmental Impact Report 81-2 covers approximately 26 acres located on the west side of Neblina Drive, just south of Sunny Hill Drive (map attached). EIR-81-2 was required at the time the applicant requested the processing of a 99 unit Planned Unit Development (because of a reduction in coastal requirements the proposal is now for about 79 units). The EIR identifies several significant plant species, one of which would be removed if development is approved as proposed on the site. EIR 81-2 was recommended for certification by the Planning Commission on December 9, 1981. For further information please see the Plan- ning Commission staff report dated December 9, 1981. FISCAL IMPACT The EIR consultant, PBR, was hired by the city and paid for by the applicant. Certification of EIR 81-2 will have no fiscal impact on the city of Carlsbad. EXHIBITS A. BACKGROUND Environmental Impact Report 81-2 identifies and discusses the impacts created by a proposed 26-acre, 99-unit Planned Unit Development located on property west of Neblina Drive and south of Skyline Drive as shown on the attached map. The proposed pro- ject originally included 20 units of affordable housing and 79 units of market rate housing. However, because of a change in state law removing the Coastal Commission's housing authority, the 20 afforable units will not be required. The project will now contain less than 79 lots. II. MAJOR IMPACTS 1) Biology Two biological studies were done on the site. The second study was necessary when the first report was found to be inadequate during the public review process. Several significant plant species were identified on the site along with the San Diego Horned Lizard, a species considered to be sensitive. One of the significant plant species, Ceanothus verracosus, is located in one of the few developable areas of the property. The EIR is recommeding that this particular species not be preserved because it would mean the relocation of development to the east- ern area of the property (see map attached). This would divide the open space area in half and would create more impact on neighboring residents. A finding of overriding considerations will be necessary in the resolution approving the project to allow development to occur over the stand of c. verracosus. 2) Drainage The site is located in the drainage area of Agua nedionda Lagoon. Therefore, there are very real concerns about the potential impact of the project's increased runoff volume and peak flow relative to lagoon sedimentation. Because much of the storm water from the site does not flow through natural channels, the majority of the project area does not contribute to the sediment problem in Agua Iledionda Lagoon. EXHIBIT 11 A11 c& However, the northern 1/3 of the project site flows through on- site and off-site improved storm drain systems to a wash. The increase in peak flows and run-off from the portion of the pro- ject could affect the stability of the. wash and slightly increase ·sedimentation flow into the lagoon. Another drainage related issue is the capacity of the two off-site drain systems which handle flows from the .southern 2/3 of the site. Mitigation measures for this potential impact include: detention basins to reduce flood peaks, energy ~issipators to reduce velo- cities and stabilization measures to reduce channel erosion. Appropriate measures should be determined by the City Engineer and, if possible, implemented cooperatively by the Carlsbad Pali- sades and Telescope Point developers. In conclusion, the project does impact the drainage system in the area but these impacts are fully mitigable. 3) The traffic analysis indicates that the Telescope Point pro- ject itself will not impact traffic or Girculation in the area. However, it will add a small increment to. the traffic problems to be created by extending Tamarack Avenue to El Camino Real which creates an east-west arterial route to I-5. The traffic problems created will result in an acceptable but inconvenient service level for the intersection of High Ridge and Tamarack and for Tamarack Avenue between Skyline and I-5. The significance of the project's contribution to the traffic situation is illustrated by the fact that if the project's units are increased or decreased by 1/3 or eliminated entireJy the service levels of the intersec- tions and roadways in the area of High Ridge and Tamarack as well as Tamarack between Skyline and I-5 which will still have incon- venient but acceptable levels. No mitigation measures are recom- mended. Staff feels that EIR 81-2 has been prepared in compliance with the city's Environmental Protection Ordinance and adequately identifies and mitigates potential impacts on the environment. III. RECOMMENDATION It is recommended that the Planning Corr~ission APPROVE Resolution No. 1899 recommending to the City Council that they certify EIR 81-2. PLANNING COMMISSION RESOLUTION NO. 1899 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF ENVIRONMENTAL IMPACT REPORT (EIR 81-2) FOR A PLANNED UNIT DEVELOPMENT APPLICANT: FONTANA-MUDGE CASE NO: EIR 81-2 WHEREAS, on December 9, 1981, the Planning Commission of the city of Carlsbad, held a public hearing on EIR 81-2 pursuant to the provisions of Title 19 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission has considered the comments and documents of all those persons testifying at the public hear- ings; and WHEREAS, the Planning Commission has received EIR 81-2 ac- cording to the requirements of Title 19 of the Carlsbad Municipal Code; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the city of Carlsbad as follows: 1. 2. 3. 4. That the foregoing recitations are true and correct. That the Environmental Impact Report EIR 81-2 will be amended to include the comments and documents of those testifying at the public hearing and responses thereto hereby found to be in good faith and reason by incorporating a copy of the min- utes of said public hearings into the report. That the Planning Commission finds and determines that the Environmental Impact Report EIR 81-2 has been completed in conformance with the California Environmental Quality Act, the state guidelines implementing said Act, and the provi- sions of Title 19 of the Carlsbad Municipal Code and that the Planning Commission has reviewed, considered and evaluated the information contained in the report. That the Environmental Impact Report EIR 81-2 as so amended and evaluated, is recommended for acceptance and certifica- tion as the final Environmental Impact Report and that the final Environmental Impact as recommended is adequate and provides reasonable information on the project and all rea- sonable and feasible alternatives thereto, including no pro- ject. • ~ 5.
