RECOMMENDED ACTION:
Adopt Resolution No.0 accepting a substitute grant deed
for a portion of Tamarack Avenue.
ITEM EXPLANATION;
On May 19, 1981, City Council accepted a grant deed from Lake
Calavera Hills Associates for a portion of Tamarack Avenue
adjacent to Carlsbad Tract 76-12 (Calavera Hills). It has
since been discovered by staff that an error had been made in
this dedication. The property over which the easement had
been dedicated was not then and is not now owned by Lake
Calavera Hills Associates. The property as stated on a recent
title report is actually owned by Don Bowker as trustee of the
Martha Killefer Trust.
With the assistance of Roy Ward of Lake Calavera Hills Assoc-
iates, staff has now secured a substitute grant deed from
Mr. Bowker for the Tamarack Avenue dedication.
FISCAL IMPACT:
No immediate fiscal impacts will result. The roadway has been
constructed by the developer and once the improvements are
accepted by City Council this portion of roadway will have to
be included in the City's overall road maintenance program.

CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED
3 FROM DON BOWKER AS TRUSTEE, OF THE MARTHA KILLEFER
TRUST FOR STREET PURPOSES.

5 WHEREAS, Don Bowker as Trustee of the Martha Killefer Trust has
6 submitted a Grant Deed conveying an easement to the City of Carlsbad for
7 street purposes; said Deed tt $1$ is on file in the Office of the City Clerk
8 and is incorporated by reference herein;
9 WHEREAS, the City Council of the City of Carlsbad has determined it to
10 be in the public interest to accept said Deed;
11 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
12 Carlsbad, California, as follows:
13 1. That the above recitations are true and correct.
14 2. That the Grant Deed conveying an easement to the City of Carlsbad
15 for street purposes is hereby accepted.
16 3. That the City Clerk is hereby authorized to cause the original Deed
17 to be recorded in the office of the County Recorder of San Diego County,
18 State of California, with the appropriate Certificate of Acceptance attached.
19 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
20 Council held on the 5th day of January , 1982 by the following
21 vote to wit:
