RECOMMENDED ACTION:
Adopt resolution No. 7S_ accepting the donation of Three Hundred
Dollars ($300.00) to strengthen the library's outreach program. Authorize
staff to execute Agreement with Grantee, and deposit funds to account
Oi- W-2572, (Library Adult Services - Book Account).
ITEM EXPLANATION:
B. Dalton Booksellers, through the Dayton Hudson Foundation, contributes five
percent of pre-tax income annually to communities in which they have retail
bookstores. A $300 00 grant is being made to the library to strengthen the
library's outreach program. Funds are to be used to purchase hard -cover and
paperback books for the bookmobile.

This contribution is to be used towards efforts to strengthen the library's
outreach program.
Our check is enclosed along with two copies of Agreement with Grantee form
which will require your signature. Kindly return a signed copy to me as soon
as possible. We would also appreciate you listing B. Dalton Bookseller in
any publication showing business contributors to the Carlsbad City Library
and most particularly to the outreach program.
I have enclosed for your convenience in preparing the appropriate announcements
3 and publicity releases a fact sheet on B. Dalton as well as the address of our
Carlsbad store. If you need additional information or would like to arrange

AGREEMENT WITH GRANTEE
The Dayton Hudson Foundation has approved a grant of $ 300
to the Carlsbad City Library
for the purpose of crrengtharming nyitrparh prngramc
A Foundation check is enclosed for $300
This grant is forwarded with the understanding that the entire
amount will be expended for the stated' purpose. It is further under-
stood that none of this grant will be used in such a manner that it
constitutes a taxable expenditure as detailed in Secion 4945 of the
Internal Revenue Code, that is:
—to carry on progaganda or otherwise attempt to
influence legislation;
—to influence the outcome of any specific public
electica or to carry on, directly or indirectly,
any voter registration drive;
—for ary grant to an individual which does not
coyly with the requirements of section 4945(d)
(3) or (4); or
--for any purpose other than one specified in section
170 (c) (2) (B) of the Code,'i.e., a religious,
ch.-z itabl.e, scientific, literary, or educational
purpose.
Within three months -of the end of the grantee's fiscal year,
the grantee agrees to submit to the Foundation (a) a written state-
ment indicating how the funds were spent and (b) a copy of the
orgam zatiom's latest financial statement. If the funds have not
been completely expended at the end of the fiscal year, the grantee
agrees to prov:de a statement of the brlance and the plans for
utilizing the remaining funds. The grantee's annual report (may)
(may not) be submitted in lieu of items (a) and (b).
-The grantee agrees to repay to the Foundation any portion
of the funds remaining unspent after a protracted period and
following discussion with the Foundation.
The Foundation reserves the right to discontinue or modify
the terms of tbis'grant if necessary at any time to comply with
the law.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING A DONATION OF
3 THREE HUNDRED DOLLARS ($300.00).

5 WHEREAS, B. Dalton Booksellers, through the Dayton Hudson Foundation, has
6 donated $300.00 to the Carlsbad City Library to strengthen the library's out-
7 reach program; and
8 WHEREAS, the City Council wishes to accept this donation for the purchase
9 of books for the bookmobile;
10 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Carlsbad,
11 California, as follows:
12 1. That the above recitations are true and correct.
13 2. That the City Council accepts the donation of Three Hundred Dollars
14 ($300.00) on behalf of the City Library.
15 PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad
16 at a regular meeting held the 5th _ day of _ January 1982 by the
17 following vote, to wit:
